View Full Version : Making a Third Party Insurance Claim on the policy of someone who hit you

Does anyone have any experience/advise here
as I put in a claim 2 weeks ago and am still waiting
to hear back. I am not insured myself so cannot get
my insurance company to pursue my claim.
Any advise appreciated

2 weeks is not a long time. Have you spoken to anybody at the company? The police?

Ring them every day, get someones name and ring them every day until you get your cheque. They wil stuff you around forever otherwise!!!

If you manage to sort this little one out quietly , find your self some insurance!!!:angry2:
When you apply though, they will ask about any previous accidents. If you say yes to the one above, you may get a small increase in premium.
If you say no, and need to claim at a later date, it is possible to be declined, as you may bee seen to be in a high risk group, which you did not declare, which voided you agreement....and so on. Get the drift?
Otherwise, it's up to you to chase this up. Dave is right. Unless you have some kind of legal clout they will be ssssssslowwwww.

Thanks for the replies guys
Your comments echo an article on the "Thunderbike
Sports" website which says getting a settlement will
take a long time. On the website they suggest to
pursue the money from the person who caused the
accident as insurance companies are not interested
in third party claims which I find hard to understand
as I was paid out in 2 weeks on another claim that
was not my fault also but I did have insurance that
time and my insurance company made the claim
for me.
I will be ringing the person who hit me this week
informing them of the delay and payment to me
is on the condition that charges are not laid which
is what the officer attending the accident proposed.
I was not insured due to the low value of
my bike and getting legal advice would cost
as much as my claim is worth. I do not see this
accident affecting any future insurance as it is
on police records that it was not my fault.
I will post the final outcome

If you don't get action in a week or so, lodge a claim at the disputes tribunal. It doesn't cost much and will force the other driver to get his insurer moving.

Not even 3rd party? Its worth it for the chasing up the insurance company will do. Oh well.
This crash probably wont affect any insurance rating, but if no disclosed, it may be reason enough to decline any payout.
What is the attitude of the other involved?
Perhaps suggest police perss charges? May speed things up?

It is good to go through the proper channels first to get what is rightly yours but sometimes people can hide behind faceless organisations and stall so they do not have to pay out.
When this happens I have found that serious action can be called for (in the right circumstances) as the law does not protect victims as well as it protects the criminal. Sometimes you just have to take the law into your own hands and threaten to beat the fuck out of them if they do not pay up, or resort to mindless vigilante justice and pay them back by some appropriate method which (if nothing else) will make you feel better

I had an accident, I was not insured he was with ami they refused to pay said I was partly to blame. went to loss link insurance assessors in henderson told them the story. gave them my witness information. they got $3000 from ami for a bike i paid $1500 for and charged me $300 my lawywer told me his costs would not make it worthwile and to take it to small claims, if you are not insured the insurance companies will fob you off, hoping you will go away.

I guess I was lucky in the end as the other drivers insurance
paid up what I claimed after a 2 month wait. Apparently the
police failed to notify him that I was uninsured.
When I claimed through my own insurance company for my insured car hit
by another insured driver the wait was only 2 weeks.
Too bad you cant claim for lost time and hassle also.

The best thing to do is get in touch with the Insurance co - they need to make certain that you are uninsured before they will accept your claim. They will also not accept your claim if you are partly at fault for the accident.
The best thing to do is to keep contacting them - but be nice about it, remember you are lucky if the other person actually has insurance that will cover you as well! Always a good idea to have full cover insurance then you don't have this kind of hassle. :mobile:

See my post above yours saying they paid up after a long wait. I was uninsured
due to my bike being only worth $1,500 which they paid out in full on. I bought
the bike for $2000 16 yrs ago

I had the same - third party only. That's gonna change once I get this claim out of the way.

I am going through exactly the same thing at the moment. A truck pulled out in front of me, totaled the bike, I had no insurance. Its been nearly 6 weeks and I only heard late this afternoon my claim has been accepted. I was dealing directly with someone at the insurance company. When they required a form completed and sent back, I called them to make sure they got the form, I called them to ask if it was completed correctly, I called to see if he needed his ass wiped. Then whey the matter was sent to the loss adjusters I called the guy there. Basically I called every other day. Hey, its taken 6 weeks but I'm happy how it has all been handled.
