You should probably consider that:

That's ok. MM got DQed from the race for the same thing two years back.

Michelin took an extra extra soft rain tyre to PI in case of cold temperaturess. This tyre could never be a race length tyre and some thought that in that case it shouldn't even be there.
That tyre though is there for exactly the kind of weather that has happened yesterday and today. Due to concerns as to how long the tyre would last a conservative limit was set; maximum 10 laps IIRC? Rossi was enjoying himself, or whatever, and exceeded the 10 laps so all of his times were discarded.
I hope it's dry for the race though, the only thing we know for certain is that they won't be using that tyre.
