Not sure how far along they are but they've been shifting lanes all over the place out that way as part of the upgrade, pretty sure the finished arrangement will be four lanes with bus lane on the left.

Your post gives you the answer. You describe it as a hard shoulder and not a lane... so no, you can't legally use it.

I don't imagine you are 'allowed' to ride down it but unless it's a police bike then it's not like you can get pulled over for it if you're riding past the car park. I've not done it myself but I have seen a few people do it, my worry is if someone moves across the lane for some reason (avoiding another bike filtering for example) you have nowhere to go except the concrete wall. Also in places it narrows so I'm not sure how easy it is to cut back in.
I also know of a couple of people who use the bus only lane and have gone past the cops and not been pinged for it.
Personally i filter, the traffic is usually only Te Atatu - Great North Road so it's not exactly far and not too bad for cars lane changing.
Incidentally, over the last couple of days I've seen 3 people (2 cars/1 bike) pulled over by police on bikes. There are also a lot more speed checks out there. if you go further than Westgate (heading to Kumeu) there is a hiding place for the cop car just behind one of the overbridge pillars so you don't see the car until you are virtually on it ..... $170 later......
If you are heading from Westgate to the Nth shore, watch the onrams as the ecilops' have been parking on the onramps and lasering you in the arse. Also, the Greenhithe overbridge is where one chap reverses most of his commydore behind the (eastern) side of the bridge as you head east. Laser used again here.
