    Number plate mounting, is this "legal"?

    My Dad is having a court case today, disputing a ticket he received.
    "Failed to display reg plate in prescribed manner"

    Will he win?
    Will he loose?
    Is it legal?

    see attached photo of Dad's bike on the left below and Mum's on the right

    Section 14 of the Transport (Vehicle and Driver Registration and Licensing) Act 1986


    14Form of registration plates and licences

    (1)The Minister may from time to time, by notice in the Gazette,—

    (a)Prescribe the form and colour of registration plates and licences, the size, shape, and character of the letters, numbers, or distinguishing marks to be shown on them, and the means to be adopted to make the plates and licences easily visible:

    (b)Prescribe the number of registration plates to be displayed and the position or positions in which registration plates and licences are to be displayed.

    Dad could quote the Dennis DeNudo arguement and precedent...by stating that the plate was displayed accordingly to the vibe of the law?

    Its mounted on a bracket on the left hand side of the swingarm inline with the axle. I've photoshopped all but one letter off it for his protection

    Thats the factory location on some older harleys. But the plate has to be horizontal, so dad loses.

    what about all the boy racer cars that have their numberplates hanging off on an angle?!?... I dont see them getting pulled up for it... also have seen quite a few mounted in the tailgate (sunk in) on utes etc... on an angle... almost vertical... whats the diff??... diff rules for cars & bikes?...


    Edit: I guess you can see it as it is still on the rear of the car tho... not the side

    To be honest the cop should have just said "Look sonny.....you need to make the plate legal from all rear angles".....and just told you to change and if you get caught again etc.

    Plus it looks silly on the side.....

    I think you may win on a technicality though because the piece that Imdying has brought up is a bit wishy washy.
