Legal Aid is administered under the Legal Services Act 2000 No 42 (as at 01 August 2008), and run by the Legal Services Agency.
Conditions on grant of legal aid
Legal aid, when it is granted, is done so as a loan [1], and hence repayment is required. The Legal Services Agency may take security for the loan in the form a charge being registered[2] or a caveat[3] being placed against a property, or any other substantial assets the applicant may own.
Legal Services Agency may at its discretion write a loan off, but this is usually not done unless the applicant has no means of repayment (such as being incarcerated).
