View Full Version : Crash - Dominion Road- Thanks to the Red Kawasaki Ninja chick!

I took off at the lights by KFC, in the bus lane. I relaised there was a Red Ninja beside me, was going to slow down and let them pass (seeing as they have such a nice bike vs my GN250). They were blocked from getting ahead though so I went on myself. A few hundred meters up the road, a red truck appears cutting across my front. I hit the brakes, SMASH! I fly about 5-7 metres into the Frank Allen sign- thanks for the sign, it would have hurt much more without it.
Then there are faces, telling me not to move. I lay there for a minute or two and try to determine if anything is broken. Every time I move, people freak out and tell me to stop. Eventually I think "Stuff this, I'm getting wet!" and stand up, checking myself out. All seems fine, it's going to hurt but it seems fine.
I just know the bike is going to be stuffed. I see the truck, it's got a bike ding centre front where I hit it and ricocheted into the sign.
Ninja girl is coming over to us, checking me and the bike out for injuries and offering to be a witness. Thanks so much, I completely forgot to get your details, but the towie passed them to the cops and everyone is thinking it's his fault for pulling in front of me, & his company will have public liability insurance, which will cover it. As a witness, you're probably the deciding factor as to whether I get my bike back and keep riding, or just write it off as a loss and stick to my car until 2050 when I can afford a bike again.
With ultimate luck, it'll be a complete write off and I can put the $ towards a sports bike!
But I'm damn lucky to be alive and walking, and even more damn lucky there was someone right behind me going the same speed who can vouch that I wasn't speeding. Someone in a parked car facing the other way said I was speeding, but how the hell would he know, with no gauge and not even watching me when it happened?

On a more serious note though, you're lucky to be in one piece, which is the main thing. Remember when dealing with other people's insurance to ring them EVERY day. Keep chasing them. :niceone:

A lot of crashes going on at the moment. Be careful out there ... especially those of you who ride in traffic, and those who are on open roads a little more which are prone to black ice.
I'm seeing/hearing about too many accidents on here.

Thanks guys, I forgot to mention (did I?) that the cops and ambulance came and checked it out, cops took statements.

Re Insurance - log every call you make and write down what you said and who you spoke to at what time. You need to chase them the whole time :girlfight:
Oh, and if you do get a nice pay out please please please don't get another gn. Man I hated that loan bike I had for a day. I still have a bad taste in my mouth from the bad brakes and horrible handling.:sick:

The Wif just bought a Yamaha Scorpio - although its old school and not the best build quality - I was impressed at how easy it was to ride, had enough poke, and enough brakes. Tyres could be better, but was cheerful and relatively cheap. Recommend it over the gn any day.
Any accident where you walk away in one piece is a good one.
Glad to hear you are more or less O.K. and that you can get something back for the bike.

Oooh yeah, I'm praying for a write-off/payout and ....Don't pray, mate.. go down to the towie company and ask if they have public liability, and if they do (they will) then tell them to start filling out the fucken forms pronto before you get the expensive lawyers involved, because then they can fucken pay for that too.
They get liability for millions for this sort of thing, so don't be afraid to go bang on someones desk.

Just spoke to the guy who I had the prang with, he seems to be pretty good about it now.
He's obviously concerned how it's going to come back on him career-wise, but it's not like he flew the wrong way down the road at twice the speed limit, it was just pulling out and not checking clearly and had a bigger consequence than anyone would have expected.
He's trying to get hold of a manager who will guide him through everything. Has to do incident reports and stuff.
He said he nearly had a heart attack when he saw me fly over the bonnet and miss a pole by a metre, "coz it wouldn't have been pretty afterwards if you hit it".
He thought only busses were allowed in the bus lane, didn't look for a small bike, only a big bus, and someone waved him through so he went and BANG! All over for the GN I reckon, take was busted, half the lights, wheel guard and probably the wheel and forks, and loads of other bits from the front and back wheels/sides.
Fuel was leaking. People were telling me to stay there but I could see the petrol leaking into the puddle I was in and I thought I could get up, so I did.
I cringed as I read your story. It brought back memories of when I was slapped on the road :pinch:

Despite your unfavourable circumstances, you WERE riding a GN250. Maybe a ménage à trois type outcome is more realistic.

The ambo came and asked how I feel, when I said I feel a little bruised but not broken and no neck issues, they said I should be fine, and I think I am. If I'd had any real concerns, I definitely would have gone to a doc/hospital. Wasn't trying to be a hero, but if I get taken to hospital and tie up a spot for a few bruises when someone is having their guts or brains held in by a tourniquet, I'd feel pretty stink about it.
I made it clear I want his company to sort it out, and fast, so I can get back to work, and wouldn't make a fuss if they do the right thing and get my bike paid for.
It's up to the police to do a ticket now. They seem to think it'll go my way without actually saying it. The insurance will really depend on their results.
Any idea how I follow up on their side of things? Do I need to wait for a call or postal letter?

Cops called this morning. The first time I thought it was my alarm so I hung up on them, haha! They laughed it off :)

They just wanted my reg (had written it upside down, W looked like an M, Z can go both ways, 6 looked like 9 and 8 can go both ways too).
They reckon that "unless the witnesses give radically different info" to what they've heard so far, the other guy gets a ticket. I'm 95% sure the bike is a write-off, so will probably get it back in cash.
The helmet's obviously stuffed, no longer safe, and my bike pants too. Have missed one day of work and probably Friday too, so while I don't want to be greedy, I do want compensation for everything it costs me.
I'm just so glad I was able to walk away from that.
I guess that'll teach me a lesson for signing up to health disability and life insurance 2-3 weeks ago :P
EDIT: I live at the bottom end of Dom Rd, so getting to Sandringham is a long way around when I want to get to the Wellington St (or other) onramp to the North Shore. I found the Dom Rd bus lanes to be the fastest route so far.

If you ride in the bus lane your sense of self preservation needs to be more in tune with the level of danger - the bus lane on Dom road is a known bike black spot and you should ride accordingly.
Yes you were in the right and his insurance should pay out BUT it sucks arse to be in the right and in pain with a broken bike (speaking from experience).

Thanks, I hadn't known it was a black spot but I don't doubt it. Since my first commute I thought "Faaaark there are some bad drivers out there!!!", but with the car busted I had no other transport. I guess it's good timing, the car should be fixed Friday. Was getting sick of that death strip.

Renegade, I've had more spills, dangerous jobs, and fights than most people I've met, and never broken a bone yet! I got thrown 6 metres through the air at 40-50kph into a sign, and still couldn't break anything! hahaha!

Ok guys, now I'm freaking out a bit.
The bike had been off the road for a long time due to a stuffed engine.
I got it repaired, and arranged the $ to get my car and bike both serviced/WOF'ed/Registered, was planning to drop the bike at Holeshot near my office, then shoot into work and pick it up later in the day, but obviously I didn't get that far.
I had assumed the warrant wouldn't come into it as it was obviously his fault, and it would all depend on the police ticket. I've been told by a few people prior to this and since as well that you can take a vehicle on the road to get it repaired, which is what I was doing. Now 2 days later everyone's saying different things.
Any ideas on how this could affect the outcome? Will call LTSA, but as far as insurance goes, will this come into it?

No. As long as the bike was in warrantable condition, and the lack of a warrant or any unwarrantable parts on your bike was not a causative factor, they are still liable for damages.
Don't take ANY flack from them.

yeah it might make it more difficult but as long as the fact it wasnt warranted didnt cause the accident. Ie, if you couldnt brake fast enough due to unwarrantable brakes, you will be fine.

kk, had a chat with a mate who used to work handling insurance claims, the fact that my bike's condition was unwarranted but not causative could mean they will try to fight it, but will not win.
It sounds like BS that I say I was taking it in to get done up the same day as the crash, but if I can get the transcripts from my bank call and meetings last week, the loan that went into my account several hours later was for car and bike repairs, so while it may not really make a difference, I do have evidence that I was taking the bike in for a warrant/service etc if they try to throw that at me.

Could be useful, but ultimately should not be necessary.
If they bring it up, just tell them straight that the lack of warrant was not a causative factor in the case, and that their client is still fully liable and that you still expect them to be paying out fully and promptly.
Tell them it straight away - no point letting them think they might be able to pull the wool over your eyes.
Also, call them EVERY day. "Hi there, this is Joe Blogs calling, claim number 1337, just checking on the status of my claim against your client? Oh yes? What's holding it up? Oh yes? How are you attempting to resolve this? How long do you expect this to take? And so forth.
Then call them again the next day. Same line of questioning.
Write down the name of the person you are talking to, the time, and the gist of the conversation.
Last time I claimed against a moron's insurance company I was paid out fully within two weeks - and apparently State are usually a pain in the arse to get to pay out.

UPDATE: Got the insurance quote, around what I was planning to sell it for so I'm happy. Will be sending quotes for the helmet as well, wont likely get anything for loss of earnings and not sure if I can claim it but I'll try.
