Well i needed some bits to make the zxr mint again, a shop called adrenalin motorcycles in mt maunganui was partig one out, on trademe as remnants mc...
so i bought the pieced that goes between left fairing ad frame, and a rear undertail mudguard...
they arrived today i pull them out of the box and here it is...
I have sent the guy an email saying this is the kind of stuff you point out, i have only just emailed so will be interesting to see the reply...
pretty pissed to pay $30 for this item when it's more fucked than what i already had...
do i have a leg to stand on? i asked if he had the items, he said yes and gave me the price the set up a seperate auction...
the auction stated the bike was being parted due to a blown engine...
but i think the damage and half arsed repair shown should have been mentioned...
pic 1 - damaged one that was already on bike
pic 2 - one i got sent from guy on trademe...

Only problem about second-hand online stuff - Its buyer beware.
Was it damaged before it was sent or was it damaged during shipping?

Looks like you've been tucked up SM. You do have a come back on him moan to Trademe goods arrived NOT as described. You probably won't get anywhere but at least you have the satisfaction of having had a go at him. Through the channels. It's no good giving him a red face as he will give you one back. Trademe don't give a fuck, they have been paid a loading fee by the vendor and a success fee as well. I'm afraid you are on your own.
Cheers

That's fuk all mate I waited 8-1/2 months for my 07 Triumph 1050 Tiger to get an engine job fixed up by Anza under warranty. It had 5 months of warranty to go when I took it over to them to fix. I had nothing left when I got it back. Although TNZ told me that they would extend the warranty by six months. When I asked them for the offer in writing I haven't heard back from them in 4.1/2 months. I sold the piece of shit anyway. Went back to the good old reliable Jappa Uki GSX1400 special edition. Great bike reliable as!!

Make sure you place negative feedback. Only way to identify these arseholes.

Now they've agreed a compromise Negative Feedback isn't really appropriate.
Personally IMO, this trader really shouldn't be sending out unsaleable crap and I would imagine his feedback is already not too clever.

Bush lawyer alert!
There are laws that have to be stuck to or you can take em to small claims. If he described it as a certain condition then it arrives in another then Mark has a case.

Well that sucks. Same thing happened to me. Except it was for a radiator for my car and not a part for my bike. Go for a ride together when its nicer weather aye? Can invite Julius too if hes up to it.

Skiddy you don't have to give the mongrela red face but you can give him the tardme scowl! not so bad but it still identifies them as not kosher.
Pity bout the part, next time ask the question b 4 hitting the button.

That's balls man, and yea red faces don't do shit, I reckon they just make for good reading! haha people are all "OMG he didn't send staright away".... seriously... chill out at least you got it!!!
If they wanted it straight away they shoulda bought it from a shop,
but back to your sitcheeation, If you can't work out a good deal and can prove that a blown engine didn't cause that then you'll have a case
but beware, disputes tribunal judges (can't J.P's be judges in the D/T???) can be total fuckwits that don't know shit...That can work for you though.

Burn them!
Well i'm having to fork out 50 bucks to another guy parting one on trademe for the same damn part... but such is life...
ive requested he put up pictures of it for me etc, but this guy is all good from past dealings as a mate bought the motor from the same bike and it was a real gem tidy condition no being fucked around etc...
i'm just going to pay the money get the nice part on there, if i put this shit one on there i would just always know and feel i hadn't done the best i could to get my bike as tidy as i want it.

got a couple of bad parts out of eBay but vastly outnumbered by good ones
GOLDEN RULE: ask if any damage (and for description of it) before bidding
