Well he went past the almighty katana rrr...rr swung a U turn, i pulled into carpark, he never put his lights on...
but anyway hopped off my bike and there he was...
blah blah long story short license breaches the risk i took blah blah blah
i know...
what i do question is...
he would not let me ride home, said i effectively had no license because the bike was over cc, well... i have a bike learners... yes i was breaching license conditions, but as far as i am aware he cannot forbid me to ride it home, ie if you get pulled over for after hours on a car restricted license they let you drive home...
but no he said i should have also been forbidden to ride home other times i have been pulled over for license breaches... so i had to get my mate to come pick me up and a whole lot of fucking around just to get the bike home...
nothing i can do about the ticket i knew what would happen if i got stopped blah blah...
but i don't see how he can say no i wont let you ride home because you are in breach of a license condition, he said it is effectively the same as having no license...
which is a crock of shit...
i think our coppers need to do there homework, credit though he seemed a genuinely nice guy just doing his job, but i still think he had no right to forbid me to take it home because i would be breaching a license condition, in the past i have been told if you get pulled up on way home show them this ticket etc etc.
he told me i either had to have a mate with a full show up within 15 minutes to ride it home, or he would take the key to central so i couldn't ride it and to pick the key up later, he told me to push the bike home...
obviously i laughed in his face and told him i'm not pushing a 250kg bike 5km's of mostly steep uphill home...
they over pay cops.
EDIT: i am not over my demerits, nor am i disqualified he told me i was on 50 demerits and this ticket is another 25 demerits, yet forbid me to ride the bike, said i can still drive car etc obviously

In other countries they can scan your rego from cameras above bridges.
At $750 a pop they may see a cost justiufication for doing the same here.

It's sort of self defeating - cos if cameras are checking regos cops won't bother (they don't really care all that much, assuming you're not being a dick). And the camera can't check that the rego matches the bike! Only knows the PLATE has a current rego.

Do you really see a problem in him not letting you ride home? Can you imagine if someone was driving drunk, got a ticket, then was able to continue driving home? Under the law that's very similar to what happened here, the theory is that you're not allowed a larger bike because it's dangerous until you've had 18 months or so experience on a smaller bike...

Ergo, you have no endorsement for that bike, you are not permitted to operate it.
Same principle as an unlicensed car driver being forbidden to drive until they have attained the appropriate license.

I'm not familiar with the law in this area (confiscation of keys), but from the cops perspective I can see it being a simple case - you didn't have a licence permitting you to ride that vehicle.
If a copy pulls over someone driving a 40T truck and trailer, and they only have a car licence, should the cop let them also go on their way?
Can anyone point to the legislation around confiscation of keys (or property in general)?
EDIT: Should the cop have kept pulling you over, giving you more demerit points, till you completely lost your licence? Seems the cop gave you the easier option.

I know its hard, I went mental over having to ride my GN for so long, but the rules are in place for a reason. (a) forbid the person to drive a motor vehicle until that person is able to comply with the conditions of that person's learner licence or restricted licence:

I take the "no" approach. If they fail my attitude test, I SHOW them (do not hand it to them) my license and then leave. They can sort the paperwork out, I am uninterested. There are plenty of cops who prepared to be fair and not take the fine-tooth-comb throw-the-book hold-you-up-for-twenty-minutes approach.
If they have taken something of yours, an easy test is to demand they return it immediately. If they must - then they will, unless they are very brave or very stupid.
Another thing you can do if they mention taking keys, is forbid them from touching your bike. "Do not touch my motorcyle" or "You are warned not to touch my motorcycle."

So, is the point of the thread for Mark to have a whine about the cop being wrong? He doesn't seem to be whinging about the ticket.

They can impound if:
you don't hold (or have never held) a driver licence or your licence has expired, and you have been forbidden to drive by a police officer until you have obtained or renewed your licence
You could argue that Mark doesn't hold the correct licence for that class of vehicle (I dunno if they do that though).
Of course, Mark could argue that he has a class 6 - just an "L" and he might win based on that argument. Of course, in the meantime, the cops could make him miserable for a while......
Meh.

Well he went past the almighty katana rrr...rr swung a U turn, i pulled into carpark, he never put his lights on...
but anyway hopped off my bike and there he was...
blah blah long story short license breaches the risk i took blah blah blah
i know...
what i do question is...
he would not let me ride home, said i effectively had no license because the bike was over cc, well... i have a bike learners... yes i was breaching license conditions, but as far as i am aware he cannot forbid me to ride it home, ie if you get pulled over for after hours on a car restricted license they let you drive home...
but no he said i should have also been forbidden to ride home other times i have been pulled over for license breaches... so i had to get my mate to come pick me up and a whole lot of fucking around just to get the bike home...
nothing i can do about the ticket i knew what would happen if i got stopped blah blah...
but i don't see how he can say no i wont let you ride home because you are in breach of a license condition, he said it is effectively the same as having no license...
which is a crock of shit...
i think our coppers need to do there homework, credit though he seemed a genuinely nice guy just doing his job, but i still think he had no right to forbid me to take it home because i would be breaching a license condition, in the past i have been told if you get pulled up on way home show them this ticket etc etc.
he told me i either had to have a mate with a full show up within 15 minutes to ride it home, or he would take the key to central so i couldn't ride it and to pick the key up later, he told me to push the bike home...
obviously i laughed in his face and told him i'm not pushing a 250kg bike 5km's of mostly steep uphill home...
they over pay cops.
EDIT: i am not over my demerits, nor am i disqualified he told me i was on 50 demerits and this ticket is another 25 demerits, yet forbid me to ride the bike, said i can still drive car etc obviously

No. He has a valid licence for the class of vehicle (Class 6, motorcycle).
The offence is breach of licence condition. Same as car drivers on 1R (or 1L) taking passengers. Or any L/R licence being out after 10pm. Or not displaying an L plate. Or a 6L exceeding 70kph.
Of course, noone here would ever have done any of those things ?

What can/should be done though...
He can be given a traffic offence notice for learner breaches... if he has 4 or more previous graduated licence breaches,
He can be fronted in court on the breach instead of getting an instant fine, and disqualification sought under Section 80 of the Land Transport Act.
The usual result then, is a fine and disqualification, as well as the 25 demerits added toward the next 100 mark when the licence is given back later.....

In other countries they can scan your rego from cameras above bridges.
At $750 a pop they may see a cost justiufication for doing the same here.
My brother lives in UK and there apparently, if you miss paying your rego on time, they just send you the fine home automatically. No need for camera or any other costly setups. Their explanation is that if you don't have the car on the road, you should exempt it. If it doesn't have an exemption, it is unlawfull to let the registration lapse so they automatically fine you when that happens (I think there is a grace period but it's not too long).
