owell as some of you may already know last thursday the place that i live at got robbed!
well on these new grounds that it looks like i did it!! well as i found out from a mate that got the police file checked the police did not say anything about me, so go figure they just getting silly lill thoughts in there wee minds now.
about a month or two ago they wanted me to pay them a week in advance which i already did when i moved in....... oh and had already been living in the household for over 4-5months!
and they said they texted me in the weekend asking me to pay which if i didnt reply to it should mean that i did not get the message which i honestly didnt but hey, they should of waited to ask me in person!
so last night when i got home they gave me my letter saying i have two weeks to move out because they think i ripped off our house.
ffs my bike gear is worth more than all there stuff together so go figure.
so the letter goes on about the reason im getting kicked out is for not paying them more money so they can spend it on them selfs.
but when they gave me the letter all they could talk about was that they think from what the police said and what they think that i and or boss and work mate ripped the place of because the garage door was opened from the inside.
well funny that snice chris said that this one chick told him that she was going to rob the house a while back and she had our garage door remote for a few weeks, that sounds more fishy to me lol.
owell rant over and done, i typed out the complete letter and have not removed any details and is spelt and worded excaly the same as the letter was. have a read i dont care!

This letter is to notify you that you living arrangement is being
terminated. As at today (Monday the 23rd of November 09) You
have two weeks to remove yourself and your belongings, making
Monday the 7th of December 09 your last day at the property of

This is on the grounds of the safety of the tenants and failing to
meet your finacial agreements made by yourself and head
tenants. You have been asked to pay one weeks rent in advance
but during your time here you have made many excuses as to why

So their letter states you are a "tenant".

Must give you 3 weeks notice + 4 days. Must state the exact date it is to end.
His letter states "financial agreements". If it's not in writing ,then it's not valid.
His letter isn't valid so WRITE back to him and tell him that he should send a correct notice to end the tenancy (another letter). Mention that the phrase "safety of the tenants" is potentially libelous. Also include a note that if he discloses your details to the National Tenancy Database then you will take legal action. Include the legal implications if he evicts or threatens you without sticking to the letter of the law. You could also send him a retaliatory notice. Furthermore, you might mention in your letter that you're considering taking him to tribunal as he didn't make sure the locks and fastenings were adequate. Last but not least, ask him for his GST number :whistle:
Once they send the correct letter, ensure you reply giving them their 21 days notice.
Seriously though, just do the above to piss him off and buy yourself more time if you can't find a decent place in 2 weeks. You don't really want an asshole landlord like that. If you do find a nice place, then once your stuff is gone (and make sure you tell the leccy/phone/etc companies) then use the above as leverege to avoid paying a bit of rent.

In general a tenant must give a landlord at least three weeks’ (21 days’) written notice when they want to end the tenancy. A landlord may allow a tenant to give shorter notice. This is one classic exemption I have seen:

(n) Where the premises continue to be used, during the tenancy, principally as a place of residence by the landlord or by any member of the landlord's family:
This means if the landlord or any of their family lives at the same address the Residential Tenanices act does not apply.
You often see this catch because Kiwi's love to buy an investment property and get in flatmates to help pay it off. Well those flatmates have almost no rights, as they don't have the protection of the act.

An interesting thing I learned about contents insurance a few years ago.
I took out a contents policy as you do. When Maha came to live with me I for some reason thought I should contact the insurance company, sure enough his property was not covered under my policy. SO I added him as a member of my family and all was sweet. A few years later his eldest daughter came to live with us, sure enough her stuff was not covered either as she was not part of my family either.
All sorted now, but a good thing to remember all the same.
The other trap I found relates to the contents of our caravan. I assumed they would be covered under my existing contents policy, but not so. As they were permanently in the cravan they needed their own policy. We now leave the caravan empty and haul backwards and forwards the stuff we need when we stay in it.

Yeh I wouldn't be doing anything that may land you with criminal charges.
They seem to be money motivated, making their next few power bills expensive till they figure out whats goin on is a pretty safe way.
a nicely flowing hot water cylinder does the trick and you dont want to damage the house as it doesn't belong to them anyways.
pour sugar down the air vents on their cars is great, set fan on high and everything gets sticky when they turn the ignition on.
barley sugar in the shower head if ya can fit one, makes towel stick or maybe visit pet store and buy them a breeding pair of mice.
Think about any consequences before taking action as they're not worth getting into shit over.

If you've got somewhere to go, move out today.
Move all of your shit out before you tell them you're leaving.
If you have no agreement directly with the landlord, you are not a tenant and are not covered by the tenancy act.
If you have no written agreement with them then you have no rights, and also no obligations, so pay them nothing.
You could probably help yourself to a bottle of bourbon or whatever piss is in the fridge as you leave as a farewell present to yourself, how can they prove you didn't buy it.
They as tenants will be responsible for any damage that has been done to the property.
And make sure you let their insurance company know you suspect that they have jacked up the burglary themselves as a way to pinch your gear.

That's a nice idea, but to place an advertisement in the Adult Services section of a newspaper you generally have to provide proof of identity and pay by credit card.

Actually ... as I recall, 28 days is the legal minimum notice of eviction ...
My understanding is that if you rent a room and pay weekly the notice is 1 week and if you pay monthly it is 4 weeks etc.
