So a few weeks back my step brother comes to NZ after his fathers funeral.
We decide to have a couple of drinks then get a ride to town and hit the bars/clubs. So we get dropped off by sober driver and go to first bar, I bought a round of drinks walked outside and saw an old friend and started a conversation.
Now we're at a bar where theres's an outside drinking area, my friend and I talking start walking whilst conversing. So anyways I rarely to out to town and not even thinking about it we walk down the street I'm still holding a drink.
I spot a squad car and I'm like oh crap I've got a drink on me so hold glass behind me(I know stupid right) cop glares at me and pulls over. Cop approaches me agressively and talking very fast ask questions for which I'm not sure what the answers are. So 'your being difficult I'm placing you under arrest' fine hop in car go to station get hands scanned and my first/only criminal conviction 'Breech of liquor ban'.
Anyways so I get a fine in the mail $630 - most expensive sip of whiskey I've had. And I'm thinking gee thats steep so I google things right.
Now another guy was down at the same place drinking beer from a box in his ute with a shotgun - fine $150 . Watch that police show drunk guy drives on motorway on steel rim gets DIC - fine $350.
So I'm thinking what did I do that was sooo wrong that I get $630
Ah yes because if your going to get caught drinking you should have a vehicle
and even better a firearms to reduce your fines.
So everyone thats the message from police, Breaking the Law? Do it properly

That's because you were unfortunate enough to be arrested by someone in a bad mood. Earlier that day his alcoholic wife left him for the next door neighbour, who had a shirt similar to the one you were wearing. So he saw you and took out his frustrations. Bad luck.

well yes I guess I stated wrong tho, the courts sets the fine I think.
The cop was an absolute prick to me and his conduct was inappropriate, nothing I can do about that.
Ya know I've always been cooperative and polite to police because I respect the job they have to do. I've lost faith in them now and I have met alot of people who feel the same.
It seems to be the import cops too making the fuss, don't like Kiwi's well f#@k off back to your own country.

Is it a set fine, or just made up by the court?
I thought the liquor ban was a council bylaw? And the punishments are set by the council.
I agree, however, that the punishment for drink-driving (particularly repeat drink-drivers), are woefully inadequate.

Maximum fine in Christchurch is $500. Usually though only $150 is handed out.

I don't think they can charge you "Court costs" unless you actually go to court.
You could always appeal, on the grounds that the sentence is manifestly excessive compared to blah blah blah. But that would probably cost you more in lawyer's fees.

Yeh it used to be only criminals and body count fans that hated them, now it's your middle class families who actually pay their salaries.
I'd like to have a legal organised fight with that cop, I'll show him who can be a bully when theres no 'Assulting a Police Officer' charge applicable.
He's about my size so would be a fair fight.

I was at a christmas in the park event on saturday night, and there was a throw-the-ball-at-the-target-and-dump-the-bucket-of-water-on-the-policeman type thing, that all the kiddies were lining up to have a go with.
I thought "ho hum" until I realised there were a handful of cops there who were shivering and soaking wet, but they had to go "yay yay clap hands" for the little kiddies. It was pretty clear the kiddies were having lots of fun, and the pigs were not, bringing new meaning to "boys in blue." They looked completely freezing and demoralised, which began to get noticed by some of the local youth, who began to take glee in the situation.
It wasn't long before there were a quite a few adults watching with great mirth as the pigs' corners of their mouths started to drop, and ours started to rise. It was fucking epic actually, with the occasional quiet "blow on the pie" from someone in the crowd followed by a healthy chortle.
All in all, a great evening out. ;)

I don't so much like paying fines but make sure I go pay in full with cash next day.
Once I got the "Imagine what you could have bought with this instead of paying fines" to which a confused looking reply I give "what do you mean, I wouldn't speed if I couldn't afford it"

Yeh I got diversion 10 years ago for parking on some grass in a carpark, that was the last time I broke the law apart from general traffic offences.
Oh no wait I did have liquor on me in a liquor ban area, outside the liquor shop down and then took it all the way to my house which I wasn't allowed to do because of the liquor ban. Stupid council, was even illegal to surf down mount without lifejacket at one stage.

You only get diversion once, pretty sure not absolute tho.
Didn't go to court just signed the paper so I didnt have to, figured they wouldn't fine me more tha a couple of hundy and a half day off work would cost me more anyhows.
I don't so much care about the $630 its the principal that I get stung more than someone else most likely because I'm a white NZ born Citizen how has a long track record of paying tax.

I was told by the cop at the accident i had that i have to pay the NZ police $50 to get the report of the crash i was in. That is Stealing! the NZ police is supposed to be a free service isnt it? why should we have to pay for things that our tax does.

my point is the pigs are cunts and they should have a better psychological test before they join the force.

Total agreement there, too many cops collecting revenue instead of catching real crims.
I think there are some good cops out the but the ones who r on the street, ie fresh import cops and their fresh outta academy partners are a disgrace.
I see they advertise for new cops but the people who would make good ones are not applying because they themselves had been let down by the justice system. They would not want to work with some hopped up loser who got bullied in school trying to take revenge on the world.

You got stung because you broke the law, tried to hide said law breaking from the Police and then gave the cop attitude all of which resulted in something you and you alone could have easily prevented. After which you were to lazy to make a simple enquiry in which you would have discovered that you were eligible for diversion or at the least a discharge without conviction and not ended up paying a cent or at least a minimal fine/donation.

No its based on the fact that I made a mistake, yeh hiding the drink was dumb which I stated. But really everyone who break laws whether intentional or not try to hide from the cops.
I didnt give the cop attitude he was speaking in a manner that was hard to follow also a have a mild form of aspergers which make hearing what people are saying difficult and was trying to tell him this.
I politly said "I'm sorry I didn't quite catch that I've got trouble with hearing.'
I feel I've been discriminated against but try not to bring that into it. regardless his behaviour was inappropriate and it didn't stop on the side of the road.
Why should I waste my time on a bullshit charge trying to get off or save a few dollars, save the court time for people who need it or can't afford fines , fuck them its just shows now when it would come up how pathetic the system is in NZ.
So no attitude just bully cop and my fault for looking 18 when I'm actually 26.
I'm still ok with looking young as that suits me fine.
Back to the thread - I get charged more because?
I earn an alright salary - pakeha - young male - pay fair share of tax - because I choose not to waste court tim - because I'm not perfect - because I have kids to feed - ... the list goes on but I don't see any reason except I didnt have a car or a firearms....

Thats cause the law, as written by parliament, says if a person does not have the ability to pay the fine then the Judge can not give them another fine.
Once again, the ill informed advising the uninformed...it has nothing to do with the police.

This is true. BUt hammering the first timers often means you never see them back in frontof a judge again....
A real shame they don't hammer the recidivist offenders much more....... but the judges can't do that either. They have to wearn, warn again, give final warnings, then give supervision (be a good boy for a while and if you are, we will forget all about it...) community work, then give home D, then give prison time - but only after all previous options have been used recently.

You had your mate there to witness his behaviour. If he was indeed rude and inappropriate in his conduct you can - and should - file a formal complaint.
It'll most likely not affect the charge and fine - but still, you shouldn't just accept poor behaviour from a cop. Especially if you had a witness with you at the time.

Define "approaches aggressively...?"
You don't know what the answers are? To what?
"Tip it out, or get yourself locked up...?" is the usual question.....
When its not tipped out, or then consumed, is the normal "being difficult."
Apply for a re-hearing? Seek a discharge without conviction? Or a conviction and discharge...?
Have you been dealt with for a liquor ban breach previously, or not? Did it go to court (signed a guilty letter so you don't need to go in person), or not? You're kind of contradicting one thing then another....
If you have been previously convicted, then the second time is usually higher.
More to the story, me thinks......

I said I broke the law, nothing about getting caught, Its was stupid they road blocked our street and only our landlord had vehicle access because he didnt want to give us the access pass and they sent it to the person who pays the rates.
It was illegal for anyone to have alcohol in the carpark of the liquor shop and ajoining roads, even if it was in the boot of your car. it was the owner of the liquor shop who warned me that as soon as I walked out the door I'd be breaking the liquor ban.

I understand that immigrants may struggle with our language but they shouldn't get shitty at us when we are unfamiliar with their Idioms and phrases. I have friends that are from the UK who I sometimes ask what they have just said means and they happen to tell me.

I ask what message we as a country are sending, beyond your situation, when it is ok to have recidivst drink drivers on MY roads, putting me and mine at risk, and not a damn thing is done about it, not by parliament, and the judges who sit in hilltop highgated homes away from the rabble, who have a choice and chance to protect us from these fools, and dont.:bash:

Yep, cops get the hard rap for doing their job. most are trying to do good, sure there is some cunts, but that is definitely the exception rather than the rule.
If firemen started handing out fines for unsafe electrical appliances and un-watched cooking, they'd become cunts too. Same with pastors and reverends and barnardos help line, if they handed you fines for every morally ireprehensible thing you ever did, they would be the scum of the earth.

That's the part I don't get. How do you get it from the bottle store to home, unless one was cracked open? Thereis an exemption to the law relating to these liquor bans if it is clearly being taken from the area once purchased - such as a liqour shop - otherwise theliquor shop owner would have to be locked up too for aiding and abetting....?

LOL - know what you mean. Hard to follow sometimes, and I hate Coro St....... Force fed it as a little one by the ma..... Nothing wrong with asking to talk to the arresting cop and explaining your situation. As far as he is probably concerned, he still thinks you needed to be locked up. Might make him think about when he next speaks to someone else...? Might not help your cause, but might clear the air, for both...?

Its a temporary liquor ban, they checked my car when I came home from work on 2 occasions.
A part of me wishes there was alcohol in the car too I'd like to see that hold in court "yes your honour the defendant was trying to take some beer home in his car with intentions of drinking it, yes thats right he was going to consume the alcohol at home. We need to make an example of him as he has shown no remorse for his actions....this behavior is just unacceptable as he was also not drink driving or carrying firearms, a total half arse attempt at breaking the law, he deserves the maximum penalty"
Oh and thats after I had to walk home and get a letter with my name and address so they'd let me drive home through their road block.
May be permanent liquor ban there now but road blocks only during new years.
