If they had any warning signs saying that there was road works or slippery surface etc then no, they won't pay up. However if there was nothing to indicate a hazard then you may have a case against them.

Whatever the outcome I hope that you and your bike are soon on two wheels again.

Tis a real bastard when that happens - bloody WCC just does wot it friggin likes. If they get too pissy about it - small claims should do it, and/or ring the paper :devil2: they don't like that too much.

I remember a mate clipped a raised manhole cover and fell off (while cornering at speed, tut tut) they finally coughed up, took a while.

At least with OSH these days it can make it easier to hold them accountable, especially when they are always taking shortcuts.

If you can, take 'em to the cleaners bro. Good luck.

Bad "luck" mate. Sand/gravel/loose shit is the bain of my life, I'm so paranoid about it, it slows me down on good roads!

If there were no signs, make them pay... Say, aren't you feeling a little psychologically traumatised? Hell, I would be :msn-wink:

Ummm....should you not be observing the road surface and riding to the conditions.......

They do that on the back road to Taupo, just before the Mangakino dam.

It's just enough to put you on edge, makes me ride a little slower.

jezus thats a cut of bad luck, I think they will definatly have to cough up if there was no signs - I seriously wonder if councils ever think of the 2 wheelers?...

Sorry about the rips, I know how much that sucks

There is a precedent, of Wellington City councilor taking action against the Tararua District council for “un-marked roadwork’s “ - which I think he won! So you should have a good chance.

Interesting - I have seen fine gravel being used as well - which I would put as akin to marbles on an oil slick on wet wood! But at least car drivers won't pick loose stones up in the wet tar and flick them at you - oh...hold on....yes they will?

Actually the ironic the thing is, you can. It is unlikely he slide, more of just a splat, if anything was in the way i.e his arm, clip on, bike etc. Then the full force of the fall and all the energy is discharged directly into that portion of the body. So a clip on directly into chest will hurt ALOT. Remember it would be a uncontrolled fall. Try this for a test stand on the pavement, spread your arms out to the side and fall foward onto the pavement. Tell me if it hurts. Now place a brick directly where you chest will land on the pavement and repeat procedure. Where as a high speed slide the energy is burnt off with the slide. ITs not the slide that hurts (in leathers) its the objects you hit on the way. Im sure someone will put this better than I have.

You're right, sliding doesn't actually hurt that much. I did something stupid down Breaker Bay Rd (many moons ago) and hit the deck at 100mph. The only damage I sustained while sliding was ripped jeans and a grazed knee. What really hurt was when I rolled over and my lower back met the kerb as I stopped sliding. that hurt

Moral of this story: always always always wear leathers

They used to put sand down on roads in my area when I was a teenager learning to ride - we thought it was fun and used to get real loose on the stuff....um...I guess kids these days have a different idea of fun eh.

Keep your eyes open, that's what you got them for...

They also do not sweep the road after laying down new tarmac.

I've noticed this around Miramar and over Mt Victoria. They lay the gravel
and then after a few days, remove the road work sighs and speed restrictions
and then just leave.

Loose gravel is still all over the place.

In actual fact its probably not WCC thats the problem, but the contractors
they hire to do the work.

Sorry to hear about your crash.

Make sure you follow this up with WCC they are getting way to slack
in maintaining the roads.

They will only change their attitude if they have to start paying out for
hurt riders and damaged bikes.
