View Full Version : James Deuce most unfortunate event!
James Deuce
29th January 2010, 11:25
This is Heather here just to let you all know that Jim had a fairly serious bike accident on Sunday and will be out of action for some time. He was riding along route 52 in Alfredton when a sheep jumped out of the grass on the side of the road and hit the side of the bike causing him to fall off on a grand scale. He was air lifted to Palmerston North Hospital with lots of broken ribs and a nasty head injury. He has just been discharged but won't be up to much for quite a while. If you want some more details you can ring or text me on 0272021741.

James, sorry to read this news. Sorry about you, and about the new bike.
We're all familiar with the concept that new leathers increase the pull of gravity. Similarly I'm still being reeeeeal careful 'cause I just fitted new CRG levers. A whole new bike though, that'd be downright scary...
Not many upsides to this, but at least you'll have time listen to some good music.

Arse. Normally I'd come up with a witty jibe, like why didn't Jim do this when he was test riding it, not after he'd bought the damn thing (bummer, cos I was hoping to blag a ride too).
Hope eveything goes well with Jim's recovery, although he will owe you a few months of housework after he's back on his feet.
Anything you need, call and I'll do my best to get it done. Even if I need to ride to Wellywood.

Heather, thanks for letting us know. I hope you and he receive all the support you need in the weeks to come. My man had a similar injury and it just takes time for a head to mend. He is such a clever witty guy that he will be missed around here, but it is much more important that he heals well than entertains us. I'll be thinking of you and wish jamesdeuce a speedy and full recovery.

Shows how bloody tough it is out there with objects, animals,on the road let alone other idiot people.Heading home last night came over the Oringi bridge and a bloody 5ltr petrol container flew off a truck, hit the ground and bounced along the road, car arriving towards it saw the container and grabbed it,otherwise would have been in the middle of the road on a curved bridge.

We visited Mr Deuce yesterday (Saturday). He's out of hospital and at Heather's folks place near Carterton. Jim's a bit sad and sore, to be expected with several bust ribs, and twisted ankle and other technicolor contusions. He's also taken a bang to the head. Broken ribs are a bit of a bugger as there's no escaping the discomfort until they're healed. His rehabilitation will take some time.
The status of the sheep-shagged Buell is not yet known. It's still awaiting an assessor's report.

Thank you EVERYONE for all the kind words. I'm allowed back on the computer for a short while.
Brand new bike. First decent weather in ages. Need to put 600 miles on it at comparatively dawdly speeds before the first service.
It's awesome. Better than what the label says. Dawdling around on it is no trouble and having fun will be no trouble either. Beautifully built, more P47M than Spit XIV, but if you know what you're doing then Spit XIV pile-it is never going to see which way you went.
All ended badly by a sheep.
Farmers in this country have 0 legal responsibilities if their stock cause an accident. On the stretch of road I was on I spotted 4 loose sheep and a large bull on the side of the road at different points. Naturally I took it easy. Coming back I'd noted the places where there were animals and was careful to watch out for them, especially the bull. Someone had put the bull away, but let out three sheep in the process. I rode past them and accelerated away, not neeooooow away, just gently. As I hit 100km/hr a sheep erupted from the grass to my immediate left. I braked, hard, immediately elevating the rear wheel 45 degrees in the air. I missed it. Phew. As the back wheel touched the ground the sheep darted back in front of me twice striking the left side of the front wheel, turning the bars to the right. I've lost about a quarter of my foward velocity by now, but the sheep has artificially induced a high side accident. I get thrown through the air and wake up in the ditch. I landed on my head and left elbow and my right foot got hooked up under the bike.
Bike is probably written off. My wife was really proud of it, liked how it looked, how she'd organised a dream bike for me and some lazy farmer has ended it all. I took years earning my wife's trust and that's gone now. I'd just been in discussions with some UK bike magazines for freelance work and talking to Cycle World in the US about something a bit more permanent. That's all gone now.
I can't sue the farmer and now have 5 broken ribs and ankle twice the size it should be and yet another head injury and possible career change wrecked and a bunch of scared, misbehaving kids to calm down and sort out.
I got lots of praise for the gear I was wearing from all and sundry, the cop who was first on scene was awesome and thanks to some procedural changes instituted by a friend of mine whose partner died due to call centre incompetence had a helicopter to me within 20 minutes of him getting there. He found a likely field and transmitted exact GPS coords to the Helicopter crew. They were thrilled to see me. They'd been having a boring day.
It's taken seven days to get my pain relief working right.
I'm not saying no more bikes, but I am saying no more road riding. No more cruising about with friends on the weekend for a coffee and an ice cream somewhere different. I'm going to build a race bike a year in my garage and do the NZ Hillclimb champs in the "250cc class" (i'm making that up, but you know what I mean) and I'm going to use the least likely machinery I can find for it.
When the insurance money comes through, I'm going to by a convertible for my work car/going away for the weekend with the wife car, and try to repay her trust by spending actual proper time with her.
I'm NOT an ATTGATT Nazi, but I wear gear I think relevant to the task. Quasi's leather gear saved my left arm and shoulder from being broken, without a doubt. I have no road rash, just armour/skin interface damage. My Oxtar TCS boots, especially the right one saved me a broken ankle. Seriously. It's sprained and swollen from toes to mid-calf. The worst injuries are the 5 broken ribs.
I'm not OK. I'm not happy to be saying any of this. It's an event that shouldn't have happened, but I am thrilled to see at least one person take note of the fact that sheep are an actual threat on the road.
I can't overstate how awesome the Ekatahuna cop is. You people treat him with respect, you hear? He turned up, checked my neuro-obs repeatedly and wasn't happy with my head injury and got the ambo crew to make me stat2 to get the helicopter justified. I don't think I could have lived through an ambo trip to Palmerston from the wops.
Kari is directly responsible for the new accident victim location procedures and making my life easier and I am tremendously grateful to her. The cop got his GPS locator out of the patrol car, found the best paddock for the helicopter and transmitted the exact coordinates. The locals who found me were incredibly helpful, but not all that good from the first aid perspective or describing where they were, but by golly I'm grateful for their time, that they took the time to help. The cop followed up with Heather, organised the CVIU to quickly establish cause and whether or not charges would be laid. He was professional and super-concerned at the same time and tried to keep Heather apprised of the situation and potential outcomes at all times. If he charged me for anything I'd accept the judgement and say thanks. I spent a lot of time at the site apologising for wasting people's time and the cop listened and determined to be helpful based on my attitude.
Thank you again for all the offers of help and support.
I can't spend much time at keyboards at present, and so probably won't get to you all. I'll be pretty out of it until the end of next week too so just remember that if you visit and expect sense from me.

The whole thing sucks on many levels, but it was the sheer randomnous that pissed me off. A lazy farmer leaves sheep on the road because there isn't any come back. If there'd been a vehicle coming the other way, or even following me I would have been a lot worse off. It took years to get Heather to trust that I was capable of both not getting tickets and not hurting myself and that trust is gone and I love her and the kids too much to put them through this for a long while at least. I already busted myself up once really good and this one has removed the joy, at least in the immediate instance. Take it easy and heal nice and slow there buddy. Natural reaction to want to throw it all in, and I have to admit it's probably sensible to cut right back on the riding for a while. You've done more damage to your body than most people do, and those kids are still young. Right now they need to know that Dad's going to get better and spend more time with them.
Don't throw away the writing though. It's not just the bike writing; I think your talent is useful for far wider things.

Re trust, I don't see how you broke it. Much the same as if I was taking public transport and the bus driver decides to go through a red and into a truck. Life is full of what ifs. It's not like you were pushing it or doing something consciously to break that trust. The emotions must be running all over the place. I don't know how old your kids are, but tell them that for a change Dad needs "you" for support. I did that to my 4 year old when I was injured and it was amazing how his focussed changed to one of concern and care for me. He forgot about being all "Mr. Independent". Well ok, all for about 5 minutes, but at least it took my mind off things and gave me something to smile at.

Re trust, I don't see how you broke it. Much the same as if I was taking public transport and the bus driver decides to go through a red and into a truck. ..
It's not like that. Mr Duece's problem is that although what happened was not his fault, the trust that his wife previously had, that he would , somehow, avoid the fate that her fears assured her befell all motorcyclists, is now destroyed. Nothing can restore it, because nothing can sweep away the reality of the crash.
In her eyes, the pretence that "My husband is different , it won't happen to him" is no longer tenable. So if he were to go out again on a bike she would be terrified. A condition which Mr Deuce does not feel he can impose upon her.
It is one reason why I know I must NEVER crash. Mrs Ixion thinks exactly the same way. If I did crash, I might be willing to go back out there. But I could not ask her to accept the waiting at home, wondering, thinking "it happened before ".
A very difficult situation. I do not usually comment in Rider Down threads as a matter of policy but I must say that I am pleased and relieved that you are in one piece, and probably no more grumpy contrary and pig headed than before.
Perhaps you could start a business where people pay to ride trail bikes chasing sheep round and round paddocks scaring the devil out of them. Couldn't happen to better animals.

I am surprised there is no comeback on the farmer, Had a g/f horse escape and collide with a car, she was held liable for the injuries it caused. The insurance company sure pursued her for the damages and she paid every last cent to them.
having livestock I assumed i would be held responsible if they escaped and caused accidents .. (when did all that change? )

1st February 2010, 21:02
I thought the no blame to farmers regarding stock in motor vehicle accidents was repealed back in the 1990's.....or did they just fudge it? I think my wife has a misplaced confidence of my safety on a motorcycle....I just hope she is never wrong....you never want to tell a woman she is wrong, right?
Like Ixion I don't join the hand wringing in rider down threads as policy - but it sucks to prang your new bike, and I'm really happy you can feel so much pain. You do whatever you need to do - but don't give up the writing...you hear?!!

I have a very very vague notion that horses come under different rules to livestock. Livestock is things like sheep and cows and camels that can be sent to the works. Horses class as, well, sort as big slow very very very stupid vehicles. Cos back in the day, horses WERE vehicles. So the rules on wandering livestock wouldn't cover horses - have a crash on a horse and it's treated same as a crash on a bicycle or motorbike.
I remember when I got my licence, the cops used to ask you 5 random verbal questions , which they made up on the spot. Mine asked me about the rules for horsedrawn vehicles. Dude, I'm sitting a motorbike test not a horse and cart test !

Frankly what happened to you is a lesson in that the "bad stuff" can happen to any of us at any time. A rider with mega experience can have something happen that they just can't avoid getting hurt from. It's a sobering thought.
If you feel you've used up all your "lives" or "chances", that's cool. If Heather+3 are top of your priority list, that's even cooler.

Wonder what would have happened if you'd just rammed through the sheep.
If anyone thinks to test that theory, my mate did so 3 weeks ago, north of Alfredton (they must breed suicidal sheep there). Hit it dead on side & sadly went flying with trip to hospital, concussion, & wrecked new to him bike.
The very dead sheep 'disappeared' in the time it took for the ambulance and Police getting there. One of the helpful locals on the farm quad was obviously the farmer & wanted the evidence gone while everyone was fussing over an ill looking gurgling bloke.
Really if I was the local Police I'd be publicising that there had been 2 potentially life threatening accidents involving wandering livestock & a warning that if any of these had been fatilities that would be treated as manslaughter through negligence.
Which is probably why I'm not in charge of the rural Police, or at least wouldn't be for long if I was. But may get people thinking maybe I should fix the dodgy fencing in that area.
When I'm in charge of the world - Then there will be changes!

You'd rather hit a cow than a sheep?? Good luck..... :D
I'm from a farming background so I don't have the usual grumpiness about manure on the road or the odd wandering sheep. We are only able to live in this beautiful country because of farming. However it's damned serious when a bloke is nearly killed by a mouton. The law is as follows:
The Animals Law Reform Act 1989 sets out factors for determining whether an animal owner is negligent in allowing an animal to stray on to the road with regard to fencing. The relevant considerations under the legislation are:
the common practice in the area with regard to fencing and other measures taken to stop animals straying onto the road (such as cattle stops), and
any measures taken to warn users of that road of the likely presence of animals on the road.
There was a case in 2002(?) where a milk tanker hit a steer on the road. The farmer was held liable = $80,000 + interest and costs.

Maybe we see trust differently. I see trust as "I promise not to be reckless and show off". "I promise to minimise the risk of injury in an accident by wearing good gear".
If by offering my trust meant I was promising I would never crash, then that is a trust I could never sensibly offer anyway riding a motorcycle.

I'm glad to hear you are mending Jim and understand your position, however now is not the time to throw away your journalistic skills...think on it first.
Get into racing or off road Jim, it's far safer!

Hi JD,
So sorry to hear about your accident! I heard about it from AJ, and was just stunned that you emerged with such relatively minor injuries...I say 'relatively minor' cos as he was relating the story to me I was expecting an entirely different outcome. PHEW! Breathed a huge sigh of relief that you are alive.
Damn shame about the bike :weep: The 2 CRs riding together would have been fun...
The whole wandering stock business scares me and reminds me of a time I was riding to Wanganui from National park...came around a corner to see a bloody great big bull standing on the side of the road. We eyeballed each other but fortunately for me he just stayed where he was...
As motorcyclist most of us love to get off the main highways and ride the 'back roads' so stock hazards are something that could happen to any of us. With that in mind I can fully understand your comment regarding losing your wifes trust and why you are now going to concentrate on non-road riding... good luck with whatever you decide to do in the future!
I am wishing you a speedy recovery and sending positive vibes your way:sunny: And also wanna send some love to your family because this must be so incredibly awful for them... Bless.

Jim, I've been thinking about your post (great to see you post too matey) 6 weeks before Leon was killed, we had a car randomly u-turn in front of us, and it would've been a major, except for defensive riding skills.
My point is; of course I wish I had put my foot down (kinda did, but really wasn't stroppy enough, oh the irony!!) And well.. you know the rest.
I understand your wife's feeling on this, and all I can say is 'if only..' there's alot of maybe's attached to our scenario, but if I'd been firm - maybe I'd still be a living my safe, old life.
Anyway, sorry to ramble! :D
Good luck in building a trackbike Jim, and please relax and heal before thinking about throwing your writing away, talent like yours is really too good to waste. Cheers :)
EDIT: well done to Kari too. :)

Cant say the wife is keen on my riding with two little kids too. You ride with two little kids! .........where do they fit - do you strap them on?
My wife worries about me riding, particularly in the evening, as well.....and I worry about about her riding, sometimes (she crashed last). Guess it's just a natural reaction, but it shouldn't stop your life.....

Ah yer great lumpkin.... I go away for a few weeks and look what happens... Not only that - Ya had to kill the Buell before I got a ride on it... sigh!!! Honestly...
Don't stress old chap and forget the MX5... Heal up and come out for a paddle with me one day and I'll show you some fun without wheels thats family friendly to boot. Vicki and I have had 2 weeks and 3,000km driving, paddling, fishing aboot the south island and we had a ball...
Dr Pauls Perscription, get an numpty old classic bike (they cut sheep in half not the other way about) for a pittance... A couple of kayaks (3 seater sit on tops are on the market) or a dinged up old alloy dinghy, some surf casters and assorted rods plus camping kit.... A Kayak at sea is 99.999% sure of NOT hitting a sheep..
I'll give ya bell later and check on you and yours but sadly off again on monday for another stint in the salt mines so can't drop in for a visit (yes, I can tell you is sad about me not teasing you in person)... Chin up... Sing out if ya need anything

What section? The 'Help I've falled and can't get back up" section? (My fave)
Just wait till I get back to wellie and I'll drag him out kayaking, that will get him back on a bike double quick!

Got a txt from the banged up aging git not long ago - he is nearly ready for work.... (which means he will go back 3 days too early and suffer a complication but thats Jim...)
I'll try and get into town when I'm back in the civilised world and visit him or convince him to visit me.

Popped 'round to visit him today.
He's pretty good, really, all things considered. He walks!
The stories were all interesting, but also various combinations of sad, happy, painfull, and more.
It's not my place to relate his stories on his behalf, but having heard them, based on my opinion these are for Santas' naughty and nice list:
Good:
Heather.
Cop where the accident occured.
Wellington Motorcycles.
Bad:
Farmers who don't control their stock.
Doctors who can't control their mouths.
