Some of you may remember the crap handed out to me by a Finance Company I was financing a couple of years ago? Had to do with a final settlement payment I asked for and got, I payed it and then they want a $3.5+ more about a month later?
Well they contacted me yesterday (and the day day before but I ignored them) so I rang then back.
It has something to do with my account (which no longer exsists) so off I went and started my whole story all over again with someone who knew nothing of it. I thought, fuck here we go again!
But no, seems I have overpaid them by a large sum of money and they want to pay it back!!!!
I just need proof of payment by way my bank statements of a few months in 08'.
They now have those statements.....
Shall wait and see.....:yes:

I had such a shit time with trying to get this all sorted two years ago...
The people involved then are (I think) no longer with the company.

They (at the time) denied knowledge of my request for a settlement figure. My phone records showed I had indeed called them when I said I did, but they had no records to match. Seems I never called them, ever!

This new person seems ligit and concerned abotu the whole thing and the amount is substantial, which Anne and I always suspected.

Like I said, I shall wait and see.

They managed to loose $10k that Mrs Mully had put in their bank - then sent abusive letters saying it was overdue.

She got a bank statement and took it to their office as proof - Rang the guy she had given it to an hour later and he denied ever seeing her. It took weeks for them to find the money ("Oh look, there it is. In our fucking bank account") and then they tried to charge her interest (for the time they'd lost it) and penalties (for it being overdue).

We refuse to use "A Certain Finance Company" (tm) now.

The settlement figure I asked for and was told and then paid into thier settlement account, was apparently not banked at all, and was simply put onto my account.

Two years down the track, new people at the helm and it seems there might have been some anomaly funds directing going on.

Seems as though the money I paid into my then account with this company was not logged against my account.
It was the money I got for my YZF600 back in 06'.
What that money could do for shoulders right about now!

We have the proof they asked for, the exact amount they want to pay is what was paid out to them in 06'.
The only thing that will hold up proceedings is how long they want to drag it our for?

More than likely, I swore that I would never have anything to do this company (and I wont) once I paid my account out in full two years ago or so.
They were very good to me when I first started dealing with them, but It got nasty when I wanted to settle my account.

Grande Fuckers me thinks.And when you've finished paying the loan,on time but they say you owe another 2 payments,wtf last I looked a 12 month contract was for 12 monthly payments,not 14,and demand you pay,then realise oooops we fucked up,no apology or explanation,they offer you access to finance should you want it.

Well blow my cone, I just got off the phone with the Finance Company after reading the email they sent through today.
They wanted my postal address!

Yes indeed, the cheque will be posted out in 2-3 weeks, hell I can wait that long.

I did some sums yesterday Tart. Um, they have effectively charged Maha interest for borrowing his own money back. SO, not only has he borrowed his own money back at usury rates, but he has not received one red cent in positive interest from this finance company for the use of his money.

SO, he needs to be re-imbursed for the interest they charged him to borrow his own money, then, they need to pay him for the interest they should have if he had invested with them. The refund is paltry by comparison. Lets just see the colour of the money forst. But there will be no threats, they simply will have to pay.

We attempted to get Fair Go on board over the settlement debacle. I talked to the finance company this time when they first came to us about it, she said to me, lets just get this one issue sorted out, then we can investigate the settlement. I am watching this space carefully, but put it this way, it is not over by a long shot.

The Money turned up today, a big fat $7,000 cheque will be banked this very afternoon.....:wari:

They demanded the amount I got for my Yamaha when I sold it, and I paid them $7,000 in May of 2006. That money was never credited against my borrowings.

It is now termed as an Over Payment.

What actually fires me up is the fact that effectively Mark was made to borrow his own money at 28.75%! Now I need to sit and do some maths here but, the next loan he had with them was two years in duration, so $7000 x 28.75% x 2years = ??????? OH, and of course had Mark actually invested that money with GE he would be entitled to whatever the going rate of interest was on an investment with them. Lets see $7000 x 7% x 4 years = ????????

I have a sneaky suspicion that they will listen to a reasonable request for compensation from Maha given the back ground that I suspect warrented the audit that picked this up. Lets just say I have a very suspicious mind and the woman from GE I spoke to about my suspicions told me to hold off going further with my concerns until this issue was resolved.

That plus the fact that FairGo were in the loop when Maha originally had issues with GE 2 years ago, they will be very interested in the fact that after demanding MORE money in settlement of his loan than the figure they had quoted and he had paid, they actually had $7K of his money for 4 years interest free while charging him more than market rate to borrow his own money.

What is it about revenge - best served cold :D

The initial loan was taken out in 04'...I kept wanting to upgrade my bikes and they wanted the money from each sale to go onto my loan, three bikes later and a settelment figure was metioned, I paid that...it gets complicated from here on suffice to say, im pretty happy with the outcome so far. And no, I need not borrow money any more from anyone.

Thats the spirit. Plus you are within the expanded disputes tribunal limits. So if they dont, trot off to the DT, get an order, when they dont comply, then you can conceivably wind up GE Finance. And not giving him interest on HIS money while they had it is appalling. Even the Judicature Act rate (from memory 9% currently: anyone know?) would be better than nothing.

Funny you should say that, I have a raft of copied emails and letters we wrote to GE 2 years ago, they dont go away really. Yeah, like I said I think they will be in a hurry to settle to stop us going to the media as I doubt we are the only ones afected by certain things at a certain branch. May pick your brains as we go along though if you are open to that of course.
