View Full Version : Dodgy caryard WOF - Advice?

So, 6 months ago I bought a used van from a car yard. Got them to stick a new WOF on it for me and service it. Didn't get it a mechanical check on it - (my bad, hindsight and all that)
Have just taken it for a WOF check today and it has failed on a host of things - quote is for $1600+
One of those things is a badly rusted chassis - obviously this hasn't happened in the last 6 months.
My question is, do I have leg to stand on when I go back and talk to the car yard, and if so will it be them or will it be the mechanics they used to do the work that I should be having a go at?

yeah everyone says you have rights, but noone is willing to stick up for you. unless you have the cash to pay for a laywer, which will cost more than the 1600!.
dont waste your time with citizens advice, consumer protection groups etc.
you could try to sell it with no warrant, and take the 1600 loss. or pay to get it fixed and take joy knowing that with every km, your slowly killing the car, and run it to death over so many years.

Many are worth more in pieces.... So, then all you have to do is sell off all the bits to recoup your money.
Yes, it can take time, but better than chucking 1600 notes into something that will always give you grief...
Guessing though, if you got it from a yard, you paid a bit for it...

You do have rights under the CGA however it's difficult to say: go to your local citizens advice bureu and ask the lawyer.

If the car yard is LMVD then take it back - but after 6 months you could be pushing shit up hill.Same for the WoF,it's expired.It would have to be deemed that the rust was blatantly obvious 6 months ago...and remember,rust never sleeps,even sitting in your garage unused for 6 months it's still rusting.A slap of paint,WoF test on a wet day....and 6 months later in summer there it is plain as day.

It's a Mitsi Delica. Don't think I can be bothered going through that. Dunno if the neighbours would be that keen on an old wreck up on blocks on the front yard for 12 months....haha.

Yeah, just had a read of the CGA. It gives my exact senario as an example where the dealer would have to give a full refund. See how I get on today eh???

The guy doing the WOF may have genuinely missed the rust. Its a visual inspection only, he's not supposed to remove covers, attack the chassis with a screw driver etc etc. An authority to do WOFs (AVI) is a valuable bit of paper, and mechanics generally take it very seriously.

I bought a bike and the shop "slapped a new WOF on it" with a dangerously bent front disc - the brakes grabbed like a demon! It was some dodgy little hole in south auckland, probably more focussed on putting a dollar in his pocket than making sure anyone was safe on the road. I laughed at him and asked if he wanted his name on that disaster and if he trusted me to not ride it. The look on his face was priceless and he whipped the wof off in two seconds flat.
The moral of the story is, if you buy from shady outfits for cheap, then be prepared to use your own people for wof checks, or else do them yourself.
If I was in your position, I'd take it back to them and if necessary threaten to report it, but I don't like your chances of success. Better to learn the lesson and move on.

There is a specific part of the CGA for car sales.
Basically it says that the car should last as a "REASONABLE" person would expect (that whipes DB out huh).
But what that maens is it depends on how much you paid for the car - and what you should reasonably expect. If the car cost $500 it is UN reasonable to expect that it is in perfect condition and will last years.
If you spend $5k - it is REASONABLE that it should at least past a couple of WOFS for major structural issues - like Rust.
The 6 months means nothing. There are plenty of cases (they are listed on the net) where cars have been returned over 6 or even 12 months after purchase.
Note if you buy private or voa tender / auction then the CGA does not apply - thus the dodgy "tender canter" in Manak-aw

Been through this drama myself as a car dealer. At a yard I managed we sold a '96 Primera that had rust through the sills. We imported the car, it went through compliance fine, it passed it's warrant fine when we sold it. 6mths later it was back with a failed wof for rust in the sills. We had no choice but to exchange her into another vehicle. However, we took action against the complier.

I bought a van from an outfit called "Richards Good Cars" in Otahuhu years ago. Richard sent it accross the road for a WOF, of course it passed. This palce was out the back of some shops and looked as dodgy as. Was a bit concerned, but as it ticked all the boxes I went ahead with the deal. That was 7 years ago. The van is still in service and costs what you would expect something of its vintage to warrant each year.
I would go back and ask the questions. You have nothing to lose at this point.
