I was heading home from coming into work today on lake road, like an idiot i was passing on the left when a car pulled to turn right, i t-boned it and now my bike is out of commision, and i just have myself to blame.

But mate, everyone knows you need at least 3 m clear on your left hand side at all times through a left-hand turn! Well, that's obviously what the drivers in Kilbirnie believe.

I witnessed the dumbest car move in the history of recodes..... My mate was heading down a road, me following about 30-50m behind. In front of my mate was a 4x4 with a horse float. He was a good 40m behind it. The silly fat B*&^ in the 4x4 indicates left then crosses over into incoming lane drastically and slams on picks, both us and oncoming cars completely confused, my mate goes into evasive action and heads left skidding sideways on wet road and ploughs into ditch, I follow but stay upright, guy behind me also stays upright but hits trailer. Oncoming car from other direction slams on picks and heads into bush on side of road, Dizzy bitch in 4x4 keeps swerving and pulls back into driveway on left.
Trailer got T boned and she pulls into drive.
Fat rotund horse lover gets out all abusive and lays into my mate who has a broken leg and seriously mangled foot, driver from other side restrains her and threatens to slap her for his troubles, everyone is nuts except my mate.
Long story short, mate got charged for dangerous driving fined and 6 months in hospital......... Popo were nasty and wouldn't listen to eye witness acounts. Fresh out of popo school and full of popo juice.

Sucks to hear about your crash mate. Lesson learned that you have walked away from. DO NOT undertake, regardless of what you think the vehicle in front is doing, do not trust an indicator either for that matter. Pleased you are alive to pass this lesson on to any that have not experienced it for themselves.

Thanks for the replies just got back from hospital with a clean bill, both statements have been taken and i gotta wait to hear what the situation is, fun part of this is the bike was new and i've yet to put insurance on it so yeah, fun times ahead.

That sucks. Did they not have an indicator on? Yes it's an assumption that they were going to turn right, but after they have made a decisive move to the right toward a valid side-road/street it is a fair to reasonable assumption that they will do that, even with no indicator, and probably one supported by law. That they change their direction suddenly and without warning and not use their indicators - thats reasonable grounds for the fuzz to book them for it - if it's not exactly illegal it is as least careless use.
It might be unwise to pass on the left, but if a reasonable person could be led to believe the car was turning right, then you might have a good case in the small claims court. Either way, it's one of those things that you try regardless when theres a fat wad of cash involved.

If you are going to get a fine, then you are, and thats doneburgers. Fight it if you like - you might get off it, but there is little point.
However, if the car driver is being fined also, this leaves you open to take her to small claims. Don't be afraid of it - lots on KB have been successful at this. It's a lot of money to lose if you don't.

So let me get this straight, you were passing on the left and someone turned right from the median (or the middle of the road), into a side street directly crossing your path, and you hit them? Post up a streetview link of where it happened.
Were the cars parked when you were passing on the left? (Where parked = stationary). If they were you are fully entitled to pass on the left.
It's a lot of money to lose if you don't.

From what I understand from the original post is that he was caught is some kind of space/time warp in which he was simultaneously travelling away from and towards work and hit a the side of a car which was not in his path because it had turned right whilst he overtook it on the left.
In all seriousness though, OP - you have my sympathies. I have done the same thing before but fortunately for me the car driver was more alert than I was. Sometimes you can just go into autopilot.

Though I'm very critical of the wallies who veer right for immediately before turning left (which is what I think we're talking about here) there's one place where I do it. Coming over the hill from Houghton Bay down Mt Albert Rd towards the hockey stadium, Volga St goes off to the left at 150 deg and there's not a lot of space in Volga St. I do this turn most days. On the bike I just hug the left hand kerb and do a very sharp turn, but in the car I move right out to the centre line of Mt Albert Rd before taking the left turn, at full lock, so as to avoid crossing the centre line in Volga St, which is obscured by a bus stop shelter. I indicate a long way before the turn, I slow down gradually, I avoid sudden movements, but there's often someone sitting close behind who doesn't see what's coming. I just try to make sure they don't run into me. I've never had anyone try to undertake me during this manouevre, but it certainly could happen and I keep an eye out for it.
There are times when you have to do this, especially when you're in a long vehicle or one with a trailer. Care throughout is essential and indicating well ahead helps. Undertaking anyone who might be doing this is a very bad idea.

I'm not 100% that this is even what happened (seems to be a bit of confusion) - But if it is, then OP can be done for failing to stop in the length of lane, blah blah. We'd need some clarification to be sure.
Plenty of dead people in the cemetry who could say they assumed or that they were right. Plenty of people been to hospital who were right too.
OP - ask for diversion. Sucks about no insurance, you may have to pay her repair bill too....

Happened there at the intersection to egremont, i was coming home from work (sorry for the typing i was a bit dazed after typing all this the first time), and it was 3:50 pm cars were completely backed up towards the center line and i decided to pass on the left, there was a woman who was turning into egremont from the other side of the road, therefore make a right hand turn into my path, because of all the backed up cars she didn't see me and i didn't see her and ended up colliding into her side, i did my best to try and stop but it just wasn't enough time, and yes cars were stationary.

Your mate needs to learn to ride with his brain engaged.
A 4x4 towing a horse float is very likely going to need to swing out to the right in order to negotiate a left turn.

That's better at explaining what's happened. By the look of your drawing, it's the turning car's fault. It didn't give way to you. There was a cyclist killed a few months ago where the car was turning into a driveway. I guess it's gonna be a test of whether or not it's OK to pass on the left of vehicles that are stationary.

Yer thats definitely your fault. If there's enough room for a car to pull through you should be looking or slowing down or both. Not just blindly riding through where you can't see what's coming at you.
More in response to steve_t's post than the op. If your going down the left where you can't see anything you shouldn't be going fast enough that you can't stop, That's just dumb.
