View Full Version : Getting off a speeding ticket?

Does anyone know if you can get off a speeding ticket if your date of birth has been incorrectly filled in? If so, how do you go about it?
As we were driving back from Napier, my partner got stopped yesterday just south of Kihikihi and clocked at 119km.
We both know the ticket was warranted but if possible would like to save some money as we are not financial!!!
So thanks in advance to those that offer sensible replies!

Yes you will get off this one easy.
Just write in pointing out that it's obviously not your partner as the DOB is wrong and ask them to cancel the ticket.

Have you ever heard of PERSONAL RESPONSIBILITY????
You wont get off it, you (they) were pulled over FFS, you will be laughed out of court. There is no way out.

Aiyeeee!!
I spent a couple of years collecting fines for MoJ Contact Centre. People used to ring up all the time to plead ignorance, as soon as you saw that they were pulled over rather than snapped by a camera you knew the person was lying! The excuses used to come flying out, then the abuse then the tears!!

then the tears!!
Why for you laugh, tears have worked in the past for me. :D
New to Wellybums, I was driving through Cannons Creek at 80km in 50km zone, and with no rego. I had freshly applied liquid eyeliner and when I got pulled up, I had smudged the not-yet-dry-eyeliner when I put my face in my hands in utter horror of what was about to happen.
Officer got out of his car, asked me if I knew what speed I was going, what I did for a job. I told him I was unemployed and new to Welly. "Well you just take it easy young lady, I am letting you off with a warning"
I sat there like a stunned mullet...thinking wtf. Then looked in the rear view mirror and saw the state of my eyes and it all became clear.

The ticket issuer is just that, an issuer, it doesn't stop there.
I dont like your chances of getting off but I would give it a go.
I know someone who got off a speeding ticket because his first and second names were not in the right order.
I got off a 119kph/20 demerits this year by writing in...
Its worth trying.
At least you haven't come online and bitched about it like other soggy's do.
You have got 56 days (from date of issue) to pay so get writing.

By your own admission you answered your own question with three simple bits of your own message...
Do the crime do the time (= pay the fine)

If you read the post it wasn't my ticket it, was my partners. I was happily napping when we were pulled over. He (and me) have no problem accepting repsonsibility. The only reason we wondered about getting off the ticket is because it was filled out incorrectly and as we are not very financial wondered about how to go about disputing it. Isn't it the responsibility of the cop who issued the ticket to get the particulars correct?

Thanks Maha for your sensible reply. It wasn't my intention to come on and bitch - that won't get anywhere! Looks like the ticket you got off is the same as the one in question. Will write in and give it a go. The worst they can say is "no - pay up".

Here is the thread about my ticket....http://www.kiwibiker.co.nz/forums/showthread.php/121938-Attention-KB-Legal-Brain-Trust
First post shows the ticket and is one of the reasons why we wrote in about it. Couldn't read it.
Post #73 shows the reply from the ticket issuers' employer...
The second reason for the write in was his attitude.
They (his employer) saw things our way.

Maha,
No disrespect, however the infringement notice issued to you guys was completely illegible and matters were addressed appropriately.
Won't matter soon as trials are being carried out using smart technology. Portable smart phones (HTC Pro2) are being used to do QP's, QVR's to verify details then print an infringement notice on the spot ;) via a blue tooth printer in the car.

Hah, when I deployed htc as imates a few years ago, they weren't all that reliable, crashing, freezing etc. Lets hope they have got better, plus you're assuming the phone has data coverage? Could be amusing. Sorry sir, can't write you a ticket, I don't have coverage.

The core issue for the Court must be: is the accused the person who was apprehended by the officer? Can the officer identify your partner as the driver?
There is a lot more info on a ticket than just the date of birth. Is the name correct? Licence number? Time and place? If so then I don't like your chances.
Writing in is fine - just be aware you alert them to your defence.
The Courts are not interested in slips of the pen unless the mistake is such that there is a real question as to the identity of the accused.

Might not have much luck with that as my partner is fairly identifiable! 6ft+ and long beard! He tends to stand out in a crowd!

Where there is no coverage, the only impact is to the automated checks system. If this occurs normal radio checks with Comms will be done ;) and the data imputed into the respective field in the application and Notice issued ;)
HTC have improved dramatically. I am waiting on my Incredible to arrive ;) I find the HTC Pro2 slider design gets loose after a while.

One of two things could happen, they may decide to cancel the original ticket or they can reissue the ticket with the correct DOB.
If you are "not financial", maybe consider saving petrol and slowing down. Simple... no hassels and its cheaper.
