I've been arrested for dangerous driving, show up, find your duty solicitor, do what he tells you. You'll get a largish fine, loss of license for 6-12 and maybe a telling off (I was considered a repeat offender at the time heh so I got a bigger ear bashing than the guy punching his baby daughter in the face).
Court was easy, sitting in the cell listening to all the gangstas talk shit when I was actually arrested was worse (and the whole processing, felt pretty stink when they ask you to remove belt and shoes for some reason).

6 months disqualification minimum and a fine. 81 km/h over the speed limit is quite a lot, do you have any previous convictions for the same or similar offence?

Waits for the "Oh.. it was in a 50 kph zone outside a school.."
Haha just kidding, what were the circumstances? Open lonely stretch of road with nobody in sight? Perhaps explain that you weren't endangering anybody else and would never have done something like this if you felt that you would have been.
I dunno, probably wouldn't change anything anyway :P

Just don't let the duty solicitor talk too much. Some of them like the sound of their own voices and they can dig you a bigger hole than you are already in. Keep it short and sweet. I hope the man in the robes is in a good mood for you on Friday. No need to take your toothbrush. Good luck

If you keep pleading not guilty you might get the charge dropped. By the time you're due for the third court appearance, a lot of the time the cop who caught you can't be bothered going to court to give evidence so then they have no case. It has worked for several people I know.

on main highway north to puhoi , couple of K's before the tunnel , friday morning next to no one else on the road , ok i am not unknown to the boys in blue as have lost licence twice before but that was like well over 25 years ago , never drunk just a petrol head thirsting for faster faster faster . Got to say cop was a good bloke , well other than taking my piece of plastic , occassionally ya bump into a good one i suppose . oh yeh and i did get a little one 119kph 3 weeks ago too .... bummer , jeez i am a repeat offender .

is that what the actual offence was called?
last time i got done at a high speed (172) the offence was just 'exceeding 100kph', and resulted in the mandatory 28 day ban, followed by court where i got a $800 fine and that was it.
MaxB
14th September 2010, 23:18
The plusses are empty motorway, no oncoming traffic, riding for years etc. etc. but the cop has already decided on the dangerous charge. Counting against you is your previous record.
AFAIK dangerous speed carries a 6 month minimum ban plus fine. It may be good to start preparing for your day licence so you can keep your job.
Gremlin
14th September 2010, 23:24
Yep, mandatory loss of license, minimum is 6 months for dangerous, if that's what you are charged with. Fine etc.
You won't be able to get a work license for a minimum of 28 days if I remember correctly.

if you said not guilty, then had your lawyer plead it down, you might suffer less than you otherwise would. worth a shot.
problem is, if you admit right off the bat, they have a tendancy to nail you hard, because they have a full admission of guilt. Say nothing, see how they act, the pick your response from there, quite often you're better off by admitting nothing in the first instance, as you can offer to deal, and plead it down to a lesser charge.

we have pretty different legal systems, so i cannot tell you so much.
if common law has something to do with common sense ;) i'd try to be "honest" and accept the charge of speeding rejecting the one for "dangerous driving".
then you can argue that you've never drink and drive, you've never speeded up into cities (you didn't, right?), you've always been careful and aware about children areas and other people safety, that you always wear proper gear exactly because you keep in great consideration safety for your own and for the others, and bla bla bla...
pointing the difference between "speed" and "danger".
i think that if you appear responsible, despite your need for speed, you can anyway draw the image of a guy lookin for fun only and not a public enemy jeopardizing the whole country...

So you plead not guilty, and you go to court to defend it , then plead not guilty again? Or even better, you fail to appear, then after being arrested on warrant on a saturday night and sitting in the cells til monday morning, go to court and plead not guilty again? Wow - you should have been a lawyer!
I suggest you get some aerial photos of the area you were picked up in (Google Earth shots are acceptable) - point out side roads entering, discuss amount of traffic, when the cop is giving evidence he will have to give that evidence anyway. I don't think you're going to get away with the speed unless you have a really good technicalilty to hang your hat on, but you should be able to get it reduced to either Careless or just exceeding 100km/h.
I would seriously consider writing to the prosecution office 'without prejudice' and suggesting a guilty plea to a reduced charge may be an option.
Dangerous Speed - 6 months, a fine, and highly unlikely you won't get a work licence. Worst case then - you ride in the 6 months, get your bike impounded, get arrested, charged with riding/driving when disqualified, possibly spend some time in the grey bar hotel...

What no one here has mentioned is, a lot depends on the judge you get. For example, the last time I got done for a similar speed (171km/h) was about 4yrs ago. I had previous convictions for similar offenses (however luckily enough it had been 5yrs since my last dangerous) and the duty solicitor suggested they could confiscate my bike, worst case scenario.
In court the police tried to chuck the book at me, however the judge continually shut the prosecutor down by asking him about the road conditions at the time (straight open road with no intersections), weather conditions (perfect visibility), and other traffic (none except for the van I had passed 5 minutes earlier). The judge then asked what the minimum sentence was (6mths loss of license and $500 fine) and handed that down to, over the objections of the police.
I was lucky, I got a good judge. Best hope your judge doesn't know anyone personally who was killed by a speeder.

So you plead not guilty, and you go to court to defend it , then plead not guilty again?
Exactly - a mate of mine assaulted a cop, not just a silly slap, but repeated punches lasting for several minutes and he got charged with assault on police. On his first court appearance over the matter, he pleaded not guilty and got given bail and another court date. The second court appearance turned out the same way. On the third court appearance, the cop was meant to show up to court to give evidence. The cop failed to do so, and the case was dropped.
I know several other people who have used that tactic to get their charges dropped entirely, or given the option of pleading guilty to a much lesser charge.
Often the cop just can't be bothered showing up to court to give evidence against the accused, and in that case they don't really have a case against you unless you plead guilty. If you're looking at a minimum 6 month licence disqualification then you might as well plead not guilty every step of the way.

It's a pretty clear cut case, he assaulted the cop, and he got let off without penalty.
The more court appearances one has to go through for the same offence, the higher the chance 'they' will make a mistake leading to a technicality. A mate of mine got charged with sustained loss of traction, and the summary of facts stated that he did a skid for about 20m. With his second court appearance, the cop changed his story and said the skid lasted for 25-30m. It's minor things like that which can have a big impact on the case.

If you plead not guilty and fight it every step ... and lose ... you're likely to get the maximum sentence - at the least you'll get 12 months disqualificiation and a big fine ...
If you plead guilty, look penitant and say sorry a good judge might give you 6 months disqualification and a smaller fine ..
The risk of fighting is high ... you might win big - as SmokeU says - you could also lose big ...

This will probably not even be mentioned. It hasn't been 'processed' through the system yet.
If, for some reason, it does come up, then there are two ways it could be looked at:
1. You are trying to mend your 'dangerous ways' by cutting back on the speed
2. You are still speeding despite being caught
Either way, you're not getting off with a warning on the 181 jobbie

If you're gonna speed do it properly. i.e. don't ride at the 111-199km/h band. Get to +200km/h as fast as possible and stay there. Do it far away from the city where the chances of you hitting and killing something are greatly reduced

well big day in court .... duty solicitor , wee chat , plead guilty . $450 fine and 6 months anoying my mates and family for lifts . The drunk driving dumb bitch before me who harrassed the cops and was not pleasant to deal with got the book thrown at her .... haha good job . ....doris . I got a bad rep as this is my third time losing it to the law .... and the judge mentioned that and the other ticket i have had recently .
My commiserations. I've just ended a three-month suspension - that was hard enough ... six months is a long time ... did that 20-odd years ago for wreckless driving ...

140 kph - you walk
look twice for boys in blue if ya gonna thang it
dont be a prat when busted as it can make a difference in court
dosnt matter how nice you are , no discretion means just that
groups of bikes .... safety in numbers - weak get picked off first
wifes wraft worse than disqualification , feel the heat from her eyes on the back of my neck when was in the dock

I used to be like that, but now I haven't exceeded the speed limit since . . . well, since I got home yesterday afternoon. Well, I currently have no demerits on my licence so obviously I have stopped . . . getting caught, so far at least.
My advice on not getting done for speeding: do what I've been doing for the last couple of years - be lucky!

Yes, but if you are referring to "the ultimate price", then according to the law then that is the same whether you are doing 105km/h or 205 km/h, or even 54 km/h in some places.
I abide by not riding faster than my guardian angel can fly, I also stick to the rules as much as possible, but occasionally find myself going a little over the red ringed number.

Lets not talk the ultimate price, that usually happens when dickheads run from the cops
Time and place.

You lose your licence if you are caught exceeding any posted speed limit by more than 40 km/hr ... This includes temporary speed limit areas such as roadworks zones. AND passing school buses that have stopped to pick up/drop off passengers (20 km/hr speed limit passing them) so in effect ... you can lose your licence (for speeding) by exceeding 60 km/hr on the open road in a 100 km/hr area ...
If ya gunna "thang it" look and KEEP looking ... and odds are ... you still wont see them untill the disco lights come on ... :gob:
By all means be a "prat" ... it gives them all the more reasons to look for "things" they didn't stop you for  ... :pinch:
Discretion is still up to the officer ... and depending on many factors relating to the offence you were stopped for ... may be applied .... just don't be a "prat" ... for the reason above ... :eek5:
Groups of bikes safe ... :killingme: Good luck with that. I have been on "group rides" when all riders were stopped, lectured ... and issued a ticket ... officers "descretion" applies ...
Wife's wrath ... don't worry .... you have six months to get used to it ... if she hangs around that long ...
Be nice to your kids .... they may come in handy in your old age ... if you live that long ...
Life is seldom "fair" ... get over it ... ;)

it happens though , doing a runner can cost dearly . i have done it myself , got away to tell the tale ,easy 100 in a 50 kph area , just luck he was on other side of road and there was a long bend between me and two turn offs so he was blind sided , heard him cane it down the road after me whilst i sat silent with fingers crossed down side street . get in big doodoo's if caught . knew area well , if not i would have just pulled over and taken the grief .

Is this a new thing? Because last time I read the road code it was an instant loss of license (walking for 28 days) if you exceeded the normal speed limit by 40kph or exceeded a temporary speed limit my 50kph.

discretion .
I know a certain lad that often frequents these forums who was well clocked at about 240 kph, but was booked for 139 because the cop was a biker too.
Twas on a KB ride of course.
Some choose to exercise discretion regardless of what the rules say
