View Full Version : Checkpoint this morning. No rego fine & found out my licence has expired

Had the choice of paying $1000 for new teeth or get my rego payed.
.....got my new teeth yesterday & a $100 fine today.....but the police were very nice to deal with
In-fact they were soooo nice that when both of us found out that my licence was expired!!(haven't checked it for so long), instead of seizing the bike there and then (:crybaby:), they advised I turn around and just go home & put her in the shed until I go to the AA and get a new one issued-(doing it today! and getting a MR27 filled out till I can afford the full rego cost next pay).
The lovely officer said she recognized the bike and knew I wasn't an dangerous rider etc, and even tho they "shouldn't" allow me to take her home, my friendly attitude & fact they knew I wasn't a liability or idiot on the road was enough to prove to her I would take the necessary steps required to get legal again.
Over all, I thought they were very friendly & really nice to deal with as usual (even tho the poor buggers were freezing! in the morning frost) and I got off EXTREMELY lightly....all due to a good friendly attitude & regularly being seen riding safe.
So Thanks Chch police for being so understanding (showed her my new teeth lol) and lenient :2thumbsup:not:
.....So I am taking the day off work to get all of the above sorted and prove her good will wasn't wrongly given. :niceone:
Oh...and hows this for odd, there license check said I had learner car & Bike??? (I have L car & Full bike?...I don't drive cars) and when they checked again dispatch said it showed learner/full for bike? (They even sounded confused by it) - yet when I called NZTA helpdesk when i got home, they confirmed there system was showing L-Car F-Bike??? (anyone know why this would be?...Im hoping computer glitch etc)....hope this gets sorted today at the AA or this could get costly!$$
Any who...ride safe everyone and remember....your attitude determines the out come of most things.

If you renew immediately, write in and you may get the fine cancelled.
Long shot but costs nothing to try.

wahoo, stars must be in alignment this morning! I also got pulled over on the way to uni, unlike my recent encounters this officer was actually nice polite and went a way to restoring my faith! No fine as I was all up to date but good to meet a reasonable cop for a change!!

LOL cheeky bugger! Im not THAT old.(just had a wee accident that knocked my front teeth out...and ironically ACC refused to cover it )
Have to confess I knew about my Rego being out as I put on hold last year....2 days before the new pricing came in (as a "screw you ACC" act ).
But I have always said I would renew it when I was done the first time for no rego  (It did saved me $500 tho lol)
Really concerned about the license issue tho! (as I got my full years!! ago & have even done advanced rider training etc?)
Still, I'm very pleased how nice they were & the fact they didn't "throw the book at me" etc. (of which they had every right to so)
Any who- must dash off to the AA & post shop now $$$$$$...As I really don't want them :Police: to get the wrong idea about me & want to prove there lenience was justified...After all...I see them nearly everyday on the ride to work & back
Stay safe ducatilover, always nice to hear from ya on here :niceone:

I was very lucky in the fact that she didn't actually fine me for the expired drivers license, just gave me a "forbidden to drive" notice until I get it renewed today :woohoo:
bloody nice officers to deal with....could also have something to do with the fact a guy walked past (after being done himself!) and said I "should have done a runner! :chase: ...I think she heard me mutter "sigh...fucking Idiot! hope they do ya!"

Update:
Have sorted the rego out  (thanks MR27 form)
But as for the license......that's a different story!
After talking to NZTA and the AA it turns out many years ago when I sent in my old paper license with the $10 admin fee to have it upgraded to a full (as I had turned 25).
They screwed up the paper work and labeled my license as Learner/Full (did NOT pay admin fee) instead of processing it as paid Full upgrade.
I had no problem getting a new (plastic) Full license issued about 10years ago, but I was told at the time it was showing L/F...but they didn't know what that meant, and not to worry as they would correct that for me.
Turns out they couldn't correct that for me ...or notify me!.....and officially...after 30yrs riding....I now have a learner license again! :shit:
NZTA is still looking in to what can be done, but they have advised I just go back in and Resit my license due to the amount of time this process will take. (apparently everything from "back then" is on micro film...like the library's used to use....god I AM old!)
Soooo......now Im screwed for a while until I go through all my license's again, and I rely my 1100cc bike for everyday transport to & from work.(no bus route etc from home to work)
In all a true BUGGER of a situation to be in, gonna pop in and have a talk to the police and see what can be done in this unusual situation, and have already booked in for my restricted (next pay unfortunately)
So any KBers Out there with a license showing L/F...that's why!...and ya probly as screwed as me for options.
(Now Im really worried I may become the newest form of revenue collection for the local constabulary $$:Police:$$....best I go see them pronto ay)
Stay safe everyone:love:

:woohoo: wow the ChCh cops are great to deal with!
Called central and explained my situation and they have heard of this happening before (just not very often!)
They have given me a name of the traffic lady who may be able to help me out in my peculiar situation, and have advised I just pop in and meet with with her for a talk to discuss any options etc that may help......now THATS service.
Have also got a temp license (all be it a "learners" lol) to see me through till every thing is sorted out.
Can't say enough about the service, help and understanding from the police so far.
...It may be a hassle, but there is light at the end of the tunnel
Cheers Chch police :niceone::Police:...keep up the great work

RE LTNZ, if you cant get the result you want, go higher. The plebs at the counter know nothing. If i were you i'd be going for a full license, not pissing around with a learners again.
One other option to take, is get the learners then apply for an exemption.

I have been re-issued a learners in the mean time (As I was "Forbidden to drive/ride" until a non expired license was obtained), but just want to run every thing through the police on Monday to see if they can help or offer any kind of advice, or even an exemption to see me through till everything is sorted out
These things happen! (I work in IT so can understand how a data error can happen...frustrating yes, but gotta go through the right channels etc)
I am in the process of organizing sitting my restricted (might have found a little 250 I can borrow...should be fun lol), and I was already thinking of doing another "rider training" course anyway (as a "refresher", as there actually a really fun day out...and Im getting old!...so any help/tips etc are always welcome to ensure I can keep riding for another 30yrs)
Take care renegade, always great to hear from ya (and no!...I don't wanna root! :buggerd::killingme)

If she can't organize a full license I may just have to bite the bullet and re-sit my restricted & full licenses, I'm not wanting to cause a storm in a tea cup over a data error, I just want to get legal again so I can ride in peace....just a bugger it may cost me a fair bit $$$$

Hear what you are saying. BTW If you work in IT then you should know there is no such thing as a data error. People make mistakes, data just is data.
Somewhere at the root of your situation a real person did not do something correctly.
But hey it will be easier and quicker to jump back through whatever hoops to get compliant again.

If it was just the matter of resitting the tests I would agree with you but if you have to act as if you are currently on your learners not only will you have to resit the restricted , even though you are over 25 and sit a defensive driving type course you will be riding round for 6 months with a bike that is too big for your class and therefore risking yourself for more tickets and be unable to insure it

Update:
Called central police station on monday and spoke to the Head of traffic enforcement Chch.
She was absolutely wonderful to deal with!
She checked my license history and confirmed it appeared to be a error on VTNZ's behalf (She has seen this happen before...not very often...but she has seen it happen) and she was very helpful in advising me what to do, even tho she couldn't correct the problem herself, she gave me the email address to write into and even advised me what information I should submit and even allowed me to use her name as a Reference (for confirmation that I had gone through the proper channels in regards to this error).
I have since typed up an email explaining my situation and enquired if they could please investigate the matter and see if they can correct the error etc.
Unfortunately she did advise that if I was caught riding around on my "learners!" it would be a case of "at the officers discretion" if I was ticketed or not :crybaby:. She was actually really apologetic in this regard, as she could see I had very little options available to me in regards to the travel to & from work. (Bus route dosn't get even close to work!...taxi...not that rich! lol)
But she did advise that If I got my restricted "quick smart" the chances of rastacat or scummy beating me on the side of the road would be minimised :killingme (It would be limited to a savage kicking!)
will keep ya updated :niceone:
And thanks Chch Police, absolute GREAT service and advice.

Believe it or not youngling, some people are quite prepared (if not actually happy) to "go through the system" rather than finding every last loophole or shortcut they can find.
When I look at my license I find it amusing that the issue date for my car license (back in the days when you just sat the test and went straight onto a full) is the only issue date on it. Only had my bike full for 4 years, compared to 32 in the car, but no mention of that date on it at all. I suppose they consider a full license "full", regardless of earliest or latest date of issue??

Thanks, I learnt many years ago to work within the rules, the official systems & use the right channels.
The outcome may not be what you want, but the alternative "routes" can produce bad consequences and leave you far worse off
"Some" of the attitudes on this web site towards the police & the law truly discust me!
Especially as they do so much for us, and they are the first people we call when we need help....you just have to see what they did during the quake to know these guys & girls DESERVE our respect.
(I witnessed them 1st hand, scared shitless like the rest of us, but standing there ground on every street corner in central city amidst falling debrie, to ensure we all got out safely & home to our familys...I even had one run out and help steady my bike when the 2nd one hit...I will never! forget the personal sacrifice & great risk they put themselfs in...for us!)
So if I am required to resit my license's...then so be it!, as I have previously stated...it may be a bugger & cost me alot of $$$...but at least I know i have gone through the proper channels, tried my best, and can feel good about the way I have handled both myself & the situation.....self respect & pride walk hand in hand as they say:yes:

Be interesting to find out if there are demerits on licence expired !
Know there are 35 on wrong class of licence
35 on no registration
hmmm if there is 35 on licence expired and you had gone in with the wrong attitude a cop could have taken ya bike, and made you walk for 3 months lol
That would have sucked huh
Even if your gonna go through the channels, i'd see if i can get it in writing that it was an Ltsa fuck up, so you can show to any cop that may pull you in future (6 months) cop descretion yes but if it's in writing and not just your word would lean any cop in your favour !

Yes!...I was BLOODY LUCKY!, she could have thrown the book at me hard! & had every right to confiscate the bike under the "letter of the law".
She was very nice to deal with, and advised me that it was my attitude and the fact they have seen the bike around lots and knew I both was a safe rider and good road user that stopped her issuing ALOT of tickets and taking the bike.
-Hence I took the day off to organise rego and temp license to prove her generosity & understanding wasn't given wrongly.
I carry ALL the paper work with me (Temp license, new rego, copy of all emails etc) just in case!, but I have arranged to go in with the missus 2 days a week...and have to "risk it" the remaining 3 days (No bus service near work...bugger it! and can't find anyone in my area to car pool with...at least Ive tried!)
But Im biting the bullet and booking in for my Restricted next weekend (as I still havnt heard from NZTA regarding the issue...I just can't wait for them...to risky!)
At least with a restricted it dosn't look "quite" so bad, and once again proves I am being as proactive as possible towards this issue.
The Police, AA and NZTA-(helpdesk!) have been very understanding & absolutely great to deal with so far....very! impressed with the service and help they have provided me.

As far as cops go, they're paid to do a job. Some are nice and some aren't. You haven't obviously been really pleasant with one and still got a "discretionary" ticket when all factors were in your favour for just a warning.

Update:
Or actually "Set back"
Finally heard from NZTA.
Email follows
----------------------------------------------
Good afternoon ******,
Thank you for your email dated 19 September 2011.
The NZ Transport Agency (NZTA) has administered the Driver Licence Register since 3 May 1999. Prior to this date, all driver licences were managed by the Ministry of Transport. Prior to 1977 a paper based system was used to record driver licences issued by local councils. From 1977, these paper records were progressively transferred to microfiche until the introduction of a new computerised National Driver Licence Register in 1999.
If you can supply evidence that you have held these full classes, such as your booklet or paper licence, or copies of test results, your request can be reviewed.
One of the above forms of evidence can be sent, along with a letter from yourself for consideration to:
NZ Transport Agency
Distribution and Tracking Team
Private Bag 11777
Palmerston North 4442
If you are unable to provide evidence of having held these classes, you will need to obtain a full car and motorcycle licence by progressing through the Graduated Driver Licensing System. I have attached factsheet 45 and 28, for your information.
www.nzta.govt.nz/resources/factsheets/45/learning-to-drive.html
www.nzta.govt.nz/resources/factsheets/28/motorcycle-licences.html#two
I trust this information clarifies your query.

Alex

So what they require from me to progress, are the items that I have already stated I do not have, due to sending in my Paper license 13yrs ago (along with the $10 admin fee!) and losing my plastic Full license.
And it appears as tho they will just pass the buck to the previous data base operators/managers.
I have even found a work colleague who's father (52 yrs old!) went through the same damn issue....except he HAD his old paper license and clear proof of a full license.
The outcome for him......Sorry!, please resit your license's and pay again $$:motu:$$.
So it has become VERY clear to me that the NZTA is just out to make as much possible money out of THERE mistakes as possible, and as I have finally ran out of patience with NZTA, I will bite the bullet and move on.(God its frustrating! & Disruptive!)
I have arrange to borrow a little bike off a mate of mine (scorpion..nice wee bike) and will be booking in for my bike restricted license this saturday.-$108 (Had to wait for pay day...fortnightly...and I simply can't afford to do car restricted as well)
I will then have to do a defensive driving course to reduce the time to 3 months(Another $200 to add to the tally)
So in the mean time, due to my home & work location, I will be forced to "Break the letter of the law" and use "PhatGirl" 3 days* a week for transport, and risk a HUGE fine etc.(That we can't afford)
I have even stopped taking my weekend ride/medicine to stay as legal as possible(2 weekends now....god it HURTS!)
*I have managed to talked my partner into going into town to work for her mother (instead of working from home for 2 days) and now have to put my 1.5yr old son (Ryder) at risk in rush hour morning/afternoon traffic (And my bloody dog!)
-I have tried bus routes (need to catch 2x buses and will arrive nearly 2hrs! late for work...and I can't change hours without risking my job)
I have tried to arrange a car pool/ride (No-one! goes to my side of town at that hour...the one guy I DID find finished work 3 weeks ago to move back to england:facepalm:..still looking tho), and a Taxi is FAR!! to costly (I'd be working for free!)
So in short, NZTA's lack of organisation and "want of money" has screwed me, forced me to break to law, and put my entire family at risk 2 days a week, and stretched our single income family to the limit
But what other options do I have? (seriously...anyone got any tips or ideas, I would LOVE to hear from you...and selling my bike is NOT an option...EVER!!)
But on a good note, a BIG! thankyou must go out to the ChCh police :Police:, who have been nothing but helpful and an absolute pleasure to deal with during this whole process
So...anyone in CHCh got a highway capable scooter there not presently using ?

Some options I can think of...
1. Go visit NZTA in person, 245 Blenheim Road, and try to get as far up the food chain as possible, the reply you got from the NZTA was probably from some level one drone reading from a script.
2. Contact your MP
3. Contact the Minister of Transport (Steven Joyce)
4. Contact the Office of the Ombudsman http://www.ombudsmen.parliament.nz/
5. Apply for an exemption (probably once you have got your restricted)

Thanks man, good advice
I will try for an excemption through the officer at central station as she has the full history of this issue and has been absolutely GREAT! to deal with so far (once I have the restricted of course)
But the work mates father tried to "shake them up" with going to the top etc and got no where!(seems clear they can see money to be made!)...hense I will just bite the bullet and get the licenses again

Ohh your absolutely right!...I should waste MORE of my time fighting a government dept, instead of sorting it out myself using the fastest "proven" method to becoming legal again.(so I can actually ride THIS summer)
Did you miss the part about about my work mates father?, he HAD all the evidence on hand, so he fought them...and he lost!, and he wasted so much time he ended up wishing he had just gone straight to the AA and booked in again by the end of it.
I do understand where your coming from bassmatt:yes:, but its become VERY clear to me that these bastards (like most govnt depts) just have dollar signs in their eyes.
I would love to keep fighting it, but if im gonna pick a fight...I'd like to at least win!

But you said you had booked your restricted didn't you??? So you still can't ride "THIS summer" you'll have 18 months to wait before you can ride, lest you have your hands on a 250 or less and don't forget the 2200 curfew

As I undersgtand it you have a believe that you hold full class of licence.
You may be able to apply what used to be the Colour of right defence. It's now called the 'Claim of Right" as per NZ Statute extract below:
Crimes Amendment Act 2003 No 39, Public Act
Interpretation
(1) Section 2(1) (http://www.legislation.govt.nz/act/public/2003/0039/latest/link.aspx?id=DLM327394#DLM327394) of the principal Act is amended by repealing the definition of colour of right, and substituting the following definition:
“<dfn class="def-term first" id="DLM199776" lang="en-NZ">claim of right</dfn>, in relation to any act, means a belief that the act is lawful, although that belief may be based on ignorance or mistake of fact or of any matter of law other than the enactment against which the offence is alleged to have been committed.”

Don't get me started with the booking in for restricted Scuba....even that has turned into a nightmare! (I jumped the gun on that one)
Since I have a temp license, the online booking system won't accept the temp license number, so I can't see what dates are available, and when I rang the AA & NZTA neither could provide any dates  (AA said I had to come in and fill the paper work out first & pay or wait for plastic to arrive in the mail to use the online system, and the NZTA only use the online system and couldnt provide any info either...GAHHH!!!)
And due to the earth quakes there are only 2! AA offices open in ChCh (sydnam & shirley)...and shirley dosn't do the ride tests!
So I have to go in on saturday, pay and fill in the paper work, THEN they can tell me what times are available for the ride test -(doing it in riccarton...closest to work, as I have to take a half day off work to do this...they don't do sat ride tests!...MORE lost money!)
And its only 6 months on restricted for over 25yr olds (Im old...and aging bloody RAPIDLY due to this shit!)
So with a defensive riding course I can have it all cleaned up in 3months!...if I can afford it!
...and No, I don't have 250 I can borrow to get me through the 3 months...but if I cover up the last 0 on the guzzi's 1100 sticker....ya reakon that could work?
(I pritty close to climbing a bell tower!...but clinging to my sanity....for now!)

Play on you being responsible, on how you have tried to do the 'right thing', on the economy of commuting on your bike blah blah.

I have one more option available to me, a lovely KB member has contacted me, and may be supplying me with a contact that assisted them in getting a license issue sorted.:woohoo:
But as for Picking a fight with a Govn't Dept:eek5:......Im obviously not as..."keen" as you lot :brick:..:oi-grr:. (especially after hearing about my work mates father...the shit he went through...just to lose!)
As I said in one of my previous posts "Im going to stick to the proper channels, everyone has been really helpful and understanding, worse case, I have to re-sit the license's...it may cost a sweet penny and take time, but at least I still have options "
I am going to stick to said proper channels & refrain from getting into a mesy shit slinging match with NZTA etc.
At the end of the day, I! was the one who knew I had a discrepency with my license-(learner/Full showing in system), and I was the one who ignored this factor for years, so in reality, the responcibilty and possible repercussions must fall squarely on me!
But I would like to thank all you KB members for the support, advice (good, bad or otherwise ) and the genuine understanding of a fellow rider/members predicament.....this is why I love this site and have chosen to share this issue with all of you, Thank you All

Another update.
Finally got in to re-sit the restricted license....after missing the first appointment due to all the Testers being sick on the friday:sick:
-They called me the night before and advised the test would be on sat arvo....(when I was due for a lunch with the mother inlaw )
Still, got the little borrowed 225 scorpion out on friday (great wee bike!) and gave it a good clean/bubble bath/polish, and went to AA to fill in the paper work and get the test time etc in writing...due to not trusting the bastards anymore (Yay rangiora office is now open!...no trip into town for me:shifty:)
Got up sat morning to check the bike and gear over....and found the scorpion had a flat rear tyre:facepalm:...jesus this shit dosn't end!
Pumped the cheap shitty IRC tyre back up (over inflated it then reset pressure)...just as I thought....the wash had released the tyre off the bead.
Once all pumped up and tested...no more leak for the day.
Headed into town and met the instructor...who then laughed at my heavy leathers boots etc and said "I don't think thats your usual bike".
Had a good yak with him and he shared his unfiltered view of NZTA with me in regards to sorting out issue's like mine (his advise was golden!...just keep emailing twice a week till they get sick of ya...best way to get action lol)
The BIG TEST!
....was all of 10mins
Then I got told "this is a waste of our time!...I could be eating lunch right now and you could be doing better things... you clearly pass"
....well....that was easy!
So thats one license down!, car restricted is next...sigh (more money!)
and hunting for a rider training course that dosn't take 5 bloody days to complete!
...no shit!...the new driver ed course is spread out over 5days and cost's $200( plus loss of income over that period....hmmm...costly!)
(surely theres a day course?...anyone care to share their knowledge regarding this...want to get my full back ASAP....not in six months!)
Getting there...slowly...and going grey in the process!!
Just thought I would share the update with ya's.....in between emailing NZTA <_<

5 full days? that's nuts! My Class 2 only took 2 days and that was from learners to full as well!
Hay Bogan
I "believe" it is spread across 5 days (not full days tho) , hence Im after any info regarding a day course that will give me the 3month allowance.
(I couldn't believe the 5 day thing either!)
But heres the kicka..
I have already done my advanced rider training...and race rider training...and got shouted my advanced race rider traing as well (Did these many many years ago at manfeild...was bloody great!)
I turned my house upside down looking for my old rider training certs, found them all and sent them in, only to be told by NZTA that, as I sat them over ten yrs ago, this means they are out dated and will not be recognised....???
....How the hell do three lots of rider training at advanced levels not count?
I then emailed in my old race license from manfield and my palmy speedway license, just to rub in to their boring!, fat!, ignorant! desk sitting faces! (Im gonna keep hounding these bastards for YEARS if need be...emails...I can do emails!)
Its become blatently apparent to me that NZTA are just money grabbing TWOTS! who wouldn't know the pointy end of a bike from their own arse unless I forcibly parked one there! (....wouldnt ya just loved to!)
There own approved AA "Ride test" (restricted) was a joke! compared to the training I have previously been through, and the whole experiance has left me with an understanding of why some people prefer to just break the law instead of going through the legal processes.(But im soft and can't do the illegal thing...damn these morals!)
I now just see the NZTA as a major part of the problem in NZ regarding motorcycle safety & poor attitudes...hope they like my emails!...cos Im gonna bug the shit out of them everyweek!
Still....must stay focused and sort this shit out....or Im gonna missout on ALL of summer  (Im not using the bike except for 3days a week for travel too work...just in case...but its bloody killing me!....ride on sunday?..NO!..polish bike and sob quietly in the shed :weep:)
