Nice work from a mother protecting her baby. Calls 911 who inform that she can not shoot him until he enters the home, so when he does......

Police call it a justified shooting. Nice.

My grandma caught a black guy cooking eggs on her stove in the early hours of the morning after he broke into her house, so she held him at gun point and called the cops. Over the phone the cops said that she wasn't allowed to shoot him. This was apartheid era South Africa, too.

911 operator told the mother she could not tell her it was OK to shoot, but said that she should do whatever she needed to protect herself and her baby. Seems sensible enough to me, given the circumstances. When I lived in the states I never heard too much about home-invasions. I wonder why that is?

Good for her. As they say, when seconds matter, the police are only minutes away. (And in fact there is no legal obligation on the police to protect any of us... their legal obligations relate largely to investigating us, detaining us and charging us, a difficult concept to believe but it is enshrined in law).

It should concern policymakers greatly that the more efforts are made to institute restrictions on homeowners to defend themselves, the more emboldened and better armed criminals get. But perhaps the for the Nanny-Statists, that's a feature not a bug.

Bet there'd be waaaay less home invasions here if home owners were allowed to use lethal force to protect themselves. Pity that our law allows for anyone to break into our homes, do basically whatever they like, and then they are entitled to defence when they eventually get caught.
I did smile though when I heard that it was in Dallas - is that the same law in all states in the US?

Please pay attention. The reporter was in Dallas but the incident (the shooting) was located in Oklahoma, a State that is next to Texas.



EDIT: I note the accomplice has been charged!

Kinda feel like this whole story is just America having a fat wank over their gun ownership laws.

I would not have a single issue if the law here was the same. A man (or womans) house is her castle, where one should be able to raise ones family securely and in safety. If some clown wants to break in with intent to steal or harm (often goes hand in hand with home invasion burglaries...) ones loved ones, then the occupants should be allowed to protect themselves with deadly force if necessary. It's like walking into a bears lair, do so at your own peril. You can't blame the bear for protecting its home and cubs.
With the increase in violent home invasions, it will be interesting to see some cases such as this tried in NZ. I struggle to see a jury finding you guilty of murder when protecting themselves from intrusion and potential serious harm. The problem is that our self defence laws (section 48 of the =Crimes Act) are not exactly explicit in their wording...ie what is "reasonable" force??

Not quite. It is about the right to self defense with what ever means comes to hand.

Sure did...was a complete joke. Guy walks into GUN shop carrying a machete in an attempt to rob the shop. Shop owner shoots robber and gets arrested? Pathetic. Should have been given a "services to community" award.
