View Full Version : Speeding ticket - valid?

I got stopped on my commute to work this week - SH2 dead straight; bright and sunny - 100K zone. Just passed a car and spotted by a cop coming the other way in a line of traffic - saw his brake lights come-on and slowed to wait for the inevitable.
I wasn't offered the chance of inspecting the radar, or the certificates for the radar and speedo. he took my details but didn't issue a ticket - this arrived in the post a few days later - does this invalidate the ticket? I've been told I have to have the opportunity to inspect radar and certs and that a ticket has to be issued on the spot unless they can't catch you! Appreciate your thoughts.

Did you ask to see the readout and certs?
They don't have to show you, afaik, so I believe you'll find the ticket still stands. And no they can send you a ticket in the mail.

So you didn't ask to see it ... ??
No it doesn't ... and standard practice if the officer is busy on another job ... or decides to do it that way. (look up the word Discretion)
You were told WRONG ... slow down Rossi ..

Was the officer wearing his hat? If not that's grounds to have the ticket dismissed.

What colour underpants did he have on, and when he got out of his car did he place his left foot or right foot on the road first?
All of these points are also grounds to have a speeding ticket cancelled.

If he was there an you were there then you did have the opportunity to see the radar read out,you just didn't ask.
You can recieve a ticket in the mail up until 6 months after the fact, but if it doesn't arrive within that six months it will become invalid so long as you refuse to accept it.
Years ago I had an incident in Te Awamutu where I wasn't ticketed on the spot and shortly afterward I changed address an became pretty hard to track down for about 12 months as I moved from place to place.
When I did finally settle and take up a regular job a cop soon appeared at my place of work and explained he was issuing me with this ticket based on the incident in Te Awamutu.
I told him I wasn't accepting his ticket because I had an idea the paper work had to be in my hands within that six month period.
He wasn't to impressed about it but there wasn't much he could do about it either as I had half the work force of Nissan Datsun in Manurewa watching on so he couldn't pull some heavy bullshit on me an then charge me with assault which is the usual scam these cunts use when they can't get their own way.
Anyway,,your toast.

Did he say you were getting a ticket? Or did it just turn up out of the blue? I had a similar type incident the other day where I got a bit of a lecture for following a slow car in town a little close and then hitting the gas too fast when the speed and lanes opened up - got a lecture but didn't seem to write any details down and was a good sort with it, understood what was happening and just gave me a lecture But, should I be expecting some correspondence from them then?

Just passed a car and spotted by a cop coming the other way in a line of traffic - saw his brake lights come-on and slowed to wait for the inevitable.
Police radar can display both strongest target and fastest target. But it doesn't know which is which, and it can often be wrong due to technical limitations of doppler radar.
Where there are multiple vehicles in the beam the radar may be wrong, or misleading and readings taken in this manner cannot be relied on. There is a reasonable possibility they are wrong. Of course its most likely right, but the police have to prove beyond reasonable doubt that it is right.
I wasn't offered the chance of inspecting the radar, or the certificates for the radar and speedo.
They don't have to offer you the chance to view the radar.
But if you ask to see it and they will not show you, or can not show you, there are two precedents ( McHerron V police 2004) and one I can't remember but it was 1996 in which the court ruled that the in ability of unwillingness of the policed to show a user the locked on speed was sufficient to reach the standard of reasonable doubt, and both cases were dismissed.
These are district court decisions so they are not binding on higher courts, but are considered influential - that is to say the court is unlikely to rule otherwise without substantial extra evidence from the police.

Did you mean Discretion?
dis·cre·tion [dih-skresh-uh n]

1.
the power or right to decide or act according to one's own judgment; freedom of judgment or choice: It is entirely within my discretion whether I will go or stay.
2.

A little off track, but is it possible for a cop to get a reading on someone speeding, and leave it up on his radar to show the next person he suspects of speeding? Does a radar reading have a time stamp on it or on the machine somewhere?

Possible? Yes.
Does it ever happen? I can name at least one cop who does just that.
But most, and I do mean most, cops are honest and when they claim they have you at a certain speed, then that is what you are doing. My most recent ticket, in a car and not on the bike, I told the wife that we are about to get a ticket, even before the red and blues came on, and the speed quoted was exactly what I told my wife we were doing.

Just wondering as I did get a ticket about a year ago - my speedo indicated 70mph on a straight as a cop came towards me (I thought I was fine as i had checked with my GPS that an indicated speed of 66mph was equal to 100km/h, and later had the cop check and confirm this as well), and was ticketed for 128km/h. He offered to let me read the display or whatever, at the time I figured if he was going to offer that then he must have it up there, but maybe that explains how it got there!

Speedo error readings are not always consistently the same figure as you increase speed.
5 km's out at 100 km/hr (indicated) may turn into 10 km/hr out at 110 km/hr (indicated).
Borrow a hand held GPS unit to check your bikes/vehicles at various speeds.

No psychic powers needed. I had just sped up to overtake a large truck and was still at 117 km and slowing down as I rounded the bend, and there on the side of the road about 400 m ahead, was the Omarama cop. For that guy a ticket is gauranteed, and no excuse or reason will be accepted.
