View Full Version : Bike camera footage any use for insurance or police?

Hiya,
What with all the mini little cameras people put on bikes and cars to record their daily commute, is the footage of use to an insurance company or police if you have an accident ?
So you are happily riding away, obeying all speed limits and signs and you get shunted off the road, would an insurance company accept the video from you if it showed your assailant ?
And what if you happen to record someone being a bit naughty in their car or on their bike, would the police accept the video if you complained?
Just curious is all, russian cars and bikes all seem fitted with cameras as standard for insurance ... according to Youtube :-)

short answer is yes.
any evidence is better than no evidence and most are too lazy to argue evidence out of court.
you're in a public place, so recording is legal.
insurance, would probably be more interested (though not guarantee)
bitching to the PO... well, bitching is for bitches (and KB).

The camera is obviously somewhat independent, not prone to remembering a different version of events than what actually occurred etc.
Just make sure you're not breaking the law

I make an effort to ensure that my bike has always got the HD camera equipped & running
...very usefull for insurance claims etc, but I find that its main use is that it keeps people honest!
Ive had car drivers notice the camera and pull there heads in after driving like tools around me, Ive had boy racers pull up beside me and heard the comments "nah bro...LOOK!, camera!!", and Ive even had Popo "try" to tell me where I have supposedly been, and what I have supposedly done, only to have them say "Has that been on the whole time?...and you can show me your ride footage now?...Thats Bloody Great!!", and its cleared up the facts immediately (right colour bike officer...but you HAVE stopped the wrong bike sorry)
VERY VERY useful tool, and the popo actually like them in regards to obtaining footage etc
....people lie!, HD video dosn't!, its that simple really.
...and in the absolute worst case scenario, your video footage may very well give friends and family the truth about what happened...when your not able to:(

AFAIK Your "riding" footage can also be used against you by the law.

If the police catch you doing something naughty and you have a camera can they take it and review the footage or do they need a warrant?

by recent candaian case law, if it isn't password protected, they can take it, "by cursory glance"
of course, if you ask them to seal their radar as evidence, it's a different case...

One of the biggest myths of the modern world is that the camera never lies. It may show a true and accurate representation - of what it sees. It can't show what it's not pointing and and, therefore, can be very misleading. There was at least one video posted on KB that led to a certain conclusion; only to have that conclusion blown out of the water when the footage from the other vehicle was viewed also.

I think that was more to do with items on a computer that was in for repairs.

Create a partition. Some creating software lets you put a password on for a partition. never tried for a sd card but it works fine for usb hard drive/flash/pen drives.

They can't recover a memory card that you've crushed with your teeth. (well ok maybe in the case of a serious crime they would at least try, potentially successfully, but they do not have the resources or dollars to do that with traffic offences) Pop that shit out and chomp chomp, if it comes to it.

it's not written as "law" either for or against, so some judge (big salary. BIG) made it up.
i thought so too, being that there would be no expectation of any other cunt having the phone unless i gave it to them. and forcefully taking shit off someone is usually known as "theft"

The court says it's okay for police to look through someone's cellphone under certain conditions. The court says it's okay for police to look through someone's cellphone under certain conditions. (CBC)
Ontario's highest court has signalled that the right of police officers to look through someone's phone depends on whether there's a password.
The Court of Appeal for Ontario says it's all right for police to have a cursory look through the phone upon arrest if it's not password protected, but if it is, investigators should get a search warrant.
The court's ruling comes in the case of a man who appealed his robbery conviction, arguing that police breached his charter rights by looking through his phone after his arrest.
Kevin Fearon was arrested in July 2009, after a jewelry stall at a flea market in Toronto was robbed, and police found pictures of a gun and cash as well as a text message about jewelry on his phone.
The Appeal Court denied his appeal, saying that police were allowed to look through Fearon's phone "in a cursory fashion" to see if there was evidence relevant to the crime, but after that they should have stopped to get a search warrant.
The court says if the phone had been password protected or otherwise locked to anyone other than its owner, "it would not have been appropriate" to look through the phone without a search warrant.
The Appeal Court judges referenced a decision in a murder case in which the judge did not allow evidence from a personal electronic device because it "functioned as a mini-computer," which has a high expectation of privacy. The contents of that device were only extracted by a police officer using specialized equipment in that case, the Appeal Court judges noted.
"There was no suggestion in this case that this particular cell phone functioned as a 'mini-computer' nor that its contents were not 'immediately visible to the eye,' the court said in its ruling, released Wednesday.
"Rather, because the phone was not password protected, the photos and the text message were readily available to other users."
The court, though, declined to create a specific new rule for all cellphone searches.
"It may be that some future case will produce a factual matrix that will lead the court to carve out a cellphone exception to the law," the ruling said. "To put it in the modern vernacular: 'If it ain't broke, don't fix it."'

Hey Ed, which camera make/model would give that sort of info? I have been thinking about buying one recently, ideally that shows top speed/avg speed etc, maybe even with a small 2-2.5 inch screen that is either attached/carried on your person (wireless?) Also what do people do for mounting them/waterproofing them?

Thanks, your guys also have to remember that is just the final moment and does not reflect what happed 10 sec before. Quite often you come up to a slower car and you just like to overtake. The scooter is just a 50cc so just open the throttle to fly past is not an option.

The funny thing is that the one and only time I drove in Italy this was how things worked. And I mean worked; traffic actually flowed very smoothly.
If you waited for a gap to change lanes into you would never get one. The convention was to just move over and the other drivers would make room for you (they didn't even use indicators). Because this was understood there was no angst and everybody got to where they wanted to go without getting uptight about it.
I think the thing in Auckland is that we're only just starting to get to the traffic density of the European cities. We've had it too good for too long.
You seem to hide behind cars on the roundabout then spring out in front of the cars.
You can see cars that are pulling out and seem to head for them.

It’s not a helmet cam, my camera is just on my straps of my backpack. So it might looks like I am not locking. Funny that your guys are only focus on my “bad” driving. However it’s seemed to be ok to run red lights, change lanes without indicating or doing u-turns in the middle of the road. Or like the last guy to drive on the wrong side of the road and run a red light at the same time.

I think the point people are trying to make, is that while yes, the driving displayed was pretty shit poor in places, there's nothing that can be done about them.
You can, however, increase your odds of not being hurt by riding more defensively and improving your road positioning and awareness. Some of the situations you found yourself in were somewhat of your own making and could have been avoided with a bit more foresight and awareness.
