I'm having trouble with a phone I bought last July.

It's covered under it's 2 year warranty so Vodafone is doing the right thing and fixing it. It has a dodgy headphone jack that won't work. However they sent it back saying they couldn't find anything wrong with the jack(The problem was better, but not fixed though) and within a week the same problem occurred again and it's gone back to be fixed again.

If they can't get this sorted, how many times does it have to be sent away before I can tell them I want a refund or a new phone? I'm getting really sick of the $29 phone I had to buy to use in the meantime.

The warranty isn't even worth the paper it's printed on, since the CGA over-rides it, unless you're using it for business purposes. If it's not fixed properly this time round, then you have every right to demand a replacement phone or refund.

Fit for the purpose it was built and intended for ... under "The Act" ...

Mechanical malfunctions/faults within the warranty period you have to give them the chance/option to repair it. If they can't/wont repair it ... ask for a refund or replacement ...

Maybe ask for an upgrade in phones ... (gotta ask eh .. )

As much as I like my HTC One, I regret not buying an Sony Xperia Z. I really wish I had a water proof and dust proof phone for when I'm out riding.
