Is it legal to ride in a bus lane when there are cars parked in the lane and the time is outside of the signposted bus lane hours?
Just had a cager turn into me btw, but that's a different story.

Yeah totally legal, when it's not a bus lane it's just a normal lane for traffic. Anyone can drive there when it's not within the designated hours.

Are you telling the whole story? You weren't perchance, driving in the bus lane and passing to the left of vehicles in the normal lane because that could change things.

Yeah totally legal, when it's not a bus lane it's just a normal lane for traffic. Anyone can drive there when it's not within the designated hours.
What she said. Could also be parking if allowed (again, outside designated hours)

Yup, It's perfectly legal. Outside of the signposted bus lane hours the lane is considered a normal lane (even if parked cars have left it too skinny for other cars to use).

If you were pasing on the left then you are fucked!
Don't worry about the above two quotes, passing on the left isn't an offence in New Zealand if there are two or more lanes and you are in a different lane to the vehicle you are passing.
All that being said, if you are riding in the skinny remnants of a bus-lane then you should be paying attention, because even if it is legal it is dangerous. Sounds to me like it was your fault you got hit, but legally (and for insurance purposes) you should be fine.
I hope you didn't get injured in the crash. Good luck if you need insurance, it sounds like the other party might want to fight liability, and this might mean it takes a while to get your money.

Yes this is what I'm thinking of - the bus lane in Adelaide road in Newtown, Wellington.

Thanks for all the replies guys, this should save me a few minutes every time I drive to work.
The accident I was involved in was on Adelaide road in the bus lane within its signposted hours. A car turned left across the bus lane trying to get into a side street and didn't see me. I only got a few scratches and bruises, the bike didn't fare so well. ATGATT!

On exactly the same road I took out a moron on a GS1150, doing exactly the same thing. I pulled into the BP and he went into a parked car. Who in the fuck looks in his left hand mirror when he is pulling over to the left.
IMHO the lane only exists during the designated hours.

Nah I agree with him. Someone under taking you on a normal road is going to get wiped out one day and it will be their own dumb fault. He never said if he was on a bike or a car but it makes no difference

It's not illegal actually, if we're both talking about both vehicles being in different lanes. I could find you a link to proof if you want?
If you're talking about one lane then yeah that's pretty damn dangerous.

People who consider the fact that there are cyclists and other road users who can sometimes be found on the left hand side of your vehicle when turning into a driveway. Please go to the nearest AA and hand in your licence for destruction, we need less idiotic road users thanks.

Yes, but on topic here - which is bus lanes.
Outside the bus lane times, it is just a regular lane. Which may or may not have parking available. If there are cars parked there, make sure there's sufficient room to be able to operate your vehicle safely. If it's a real tight mofo you could technically get done for riding in an unavailable lane.
From a car drivers perspective, if you turn left into a driveway without turning into the left lane first whether it happens to be buslane or not at the time, you are in the wrong. You cant just turn across a lane willy nilly. This is why you're allowed to drive in one for up to 50m to make a turn.

You also need to remember that cyclist have to obey the road rules too. If you're ahead of one and performing a left turn into a driveway fulfilling all the normal requirements (indicating etc) and they decide to pass you on the left while you're doing so, they're in the wrong. It's not magically ok to pass on the left because they're a cyclist.
