Question to the rider (OP?) - why bother instigating it, were you expecting a different outcome?

After watching video, I did wonder why not just hand the video over to the police with an "information" and not engage with the driver. In the old days if you laid an "information" then it had to be investigated... does that still happen?
Bring on unmarked police bikes...

The guy is an embarrassment to motorbiking, classic example of why joe blogs should leave policing to the police. He's lucky that guy didn't bitch slap beat him, you really don't want to be in a fight with leathers and a full face helmet on...
Not to mention that he himself did two improper moves putting himself in danger. And operating a vehicle in noisey manner by unneeded angry engine rev, $600 fine...
I'm so sick of crap like this appearing in my news feeds from self appointed 'expert drivers'...
So the score is:
Van driver - using phone, 1 x undertaking, 1 x disorderly behaviour.
Biker - 2 x improper manoeuvre, 1 x noisey use of vehicle, 1 x obstructing traffic, 1 x disorderly behaviour instigating confrontation.
Not to mention riding/owning sports bike which in all likeliness means regular breaking of speed limits by large margins....

Exactly. Just because it's a law doesn't make it right.
This whole cell phone crap is yet another "answer" to a non-problem. Let's just blame it on the device and completely ignore the fact that a cell phone is just another tool of the distracted driver.
Lets concentrate on the mindset that allows the driver to be distracted in the first place instead of trying to find scapegoats.

From a legal standpoint you are correct.
And shit-heads with "Go-Pros" need to learn that they are not their "brother's" keeper.
Basically, we ALL need to just chill-out and not worry about things that are of no real consequence in the overall scheme of things. Something I've been working on my whole life and am only now starting to succeed at after 50 years.

So you have actually had a fight in them?
Theory is nice but doesn't change the fact you're trading mobility and thermal freedom for a small amount of protection.
Unless you have also been training in said gear it makes you slower and more clumsy.
Anything I'm a glove that protects your hand makes your punches less effective ( brass knuckles aka knuckle dusters press the load onto your thumb and palm, not your knuckles. ) and a helmet limits your movements and cuts your senses.
If you're not a brawler and you are in full leather and regular brawler is your opponent you need to be swift and decisive. He needs to hit the deck before he knows the fight is on or your fucked.

Theory is nice but doesn't change the fact you're trading mobility and thermal freedom for a small amount of protection.
I make it a point to avoid getting into a fight in the first place, however as a hypothetical:
I agree mobility would be an issue, but I compare motorcylce gear to a knights suit of armour - trading in Mobility for durability certainly can be advantegeous. As for Thermal Freedom - most street fights are over after 30 - 1 minute, its not like going 5 x 5 minute rounds.
I think though you underestimate the amount of protection wearing a full face and a set of leathers with chest protector gives you - I have done a lot of sparring (mainly Ju-Jitsu and recently MMA sparring) and small amounts of cloth padding (for practicing leg checks against kicks) make a huge amount of difference to the amount of punishment a limb can take. Since with a Full face you don't really need to worry about being punched in the head (it might knock you round abit but its more likely to break their knuckles) all you need to worry about is your ribs/body which means a lower guard and allows you to take risks that you shouldn't/wouldn't take without it.

How do you know the phone was the problem? I put it to you that they would've found something to distract them with or without the phone. Correlation does not mean causation.
Attack the driver for allowing themselves to be distracted, not the scapegoat that is the phone. That logic will lead to the banning of everything, including motorcycles.

All that proves is that the average driver doesn't treat driving with the respect it deserves. If they did a phone (talking only - hands free or not) would not be a distraction.
Texting, on the other hand. Must be treated differently as it takes the eyes of the driver off the road (unless the texter is able to text blind so that their eyes are on the road the whole time).

Actually thinking on this - I *555'd a driver a couple of weeks ago:
Was late at night, going up SHW1 to Silverdale - driver was all over the lane and I assumed they were pissed - I called *555, and was asked to follow them - fortunately they were going the same way I was.
They got pulled over at the Red Beach intersection by 2 cops - they asked for my statement - I gave it.
Turns out they were:
1: On a Learners (no supervisor in the car)
2: Texting on their cell phone (which explains why they couldn't stay in their lane)
3: to quote the officer 'she's in a bit of an emotional state, looks like she just had a fight with her partner'

Human nature is that you engage more if you hold the phone. You see it all the time in offices. People natter away about crap on speaker but pick up the phone to write details down.
I prefer a paperless office. So I use a headset and type the info I need to keep. Still need to fight the urge to pick up the handset when things get detailed.
It one of those things you just can't contract out of. You will always give more of your attention to what you are touching.
I have hands free for mobile in car and on the bike. Not because it's law but because the paying attention is easier. I also tell people I am driving / riding and to text me details.

Have someone threaten you with a gun while you're on the phone and see which you give more attention to.
It's the same in a car. The problem is the lack of respect for what can be a deadly weapon. Keep this in mind and you don't have a problem.
BTW: I have never felt the urge to pick up the phone when it's on speaker other than to keep things private. I'm regularly in meetings where someone has been dialed in on speaker phone and have never felt the need there either.

See above and forget the conversation. Don't feel pressure from the person on the other end that's left hanging to return to the conversation too early (this also applies to conversations with you passenger). Been there, done that - and not because I was on the phone.

It's not an advanced skill. Turning a steering wheel doesn't need to be a two-handed operation. I seldom have two hands on the wheel at any one time.

Yeah. Nah. Don't really spend enough time in a car to be worth it.
Much happier not answering the phone at all than trying to overcome instinct.
If this works for you then more power to ya. All I'm really saying is that because some people don't seem to be able to concentrate on their driving (with or without a phone) it doesn't mean that we're all like that. Treat driving with the respect it deserves and almost nothing will distract you from the task at hand.

I know. It's not for experienced expert drivers but I sometimes use a handy free service from Vodafone. Text drive on to 756.
Stops texts arriving. When you are ready to get texts again text drive off to the same number. Not sure but I think it forward calls to voicemail on first try ( advises users you are driving if it is urgent they can call back to be forwarded to you).

These days my only time in a car is when transporting my kids. Rest of the time is on the bike.
I have my phone sound turned off when driving. My advanced driving courses never mentioned driving while yaking on the cell phone.

Why would we need counseling? Because we don't like people not paying attention to the road where if they don't see us, or reach to pick up their dropped cellphone, and hit us we die? Or because I don't want to get into a physical confrontation with someone so I'll send the videos to the police and watch karma be served from a safe distance?
My view on our "Laws" and breaking them is that if I'm caught I know what the law of the land is and I broke it so I'll take whats given. If I don't like it I'll move to somewhere that doesn't have laws.
(Now I just hope I don't get caught, like everybody that does 110.5km overtaking a truck)

I would maybe break less rules though lol. But whenever I'm around other cars that I can't identify then I assume that there could be a cop sitting in 1 of them. I've gone past many a cop lane splitting, and even had a bike cop lane split behind me. But if they do me for something then I'll take it. Exactly! I like this country. I generally say that to other people, that if they don't like it they can move. Or take a stand and make an effort to change laws and systems they don't agree with. Sign petitions, public speaking at events, letters to MP's, joining MAG things like that.

No I don't really to increase my chances of getting caught. But I do want to increase others that endanger my lifes chances of getting caught. and I can't have it both ways. So for the greater good....
Generally most of my "illegal" activity hasn't endangered me (more than just being on a bike). Things like may or may not have used the cycle lanes and cycle spots at the front of traffic ques. And most of my numb nut moments on the open road have been taking corners at the legal road speed (not the corner suggested speed) things like I can't take a 35 at 80
And I fully agree that not all illegal things are wrong, and not all legal things are right either. e.g. not having to wear a helmet if you wear a turban. Or not wearing any gear at all on a scooter except for a tiny helmet.

By having a camera you are increasing the number of cameras on the road and promoting their use for "observation" of other drivers. Therefore you are increasing your chances (and mine) of being caught on camera and reported.
But I do want to increase others that endanger my lifes chances of getting caught.
Personally I couldn't care less if they're caught or not. As far as I'm concerned the vast majority of "bad" drivers that do things that could be seen as "endangering my life" are of no consequence to me as I look out for them. If an incident happens and I come out still rubber side down then I'm better off to think that their actions are their problem, not mine.
and I can't have it both ways. So for the greater good....
True. The greater good is served best by removing N'th degree of scrutiny we have today. A world where I can look after myself (while doing harm to noone) without fear of being raked over the coals by someone that know's nothing about me or the way I ride is what I'm talking about.
In case you hadn't noticed I'm definitely an "ambulance at the bottom of the cliff" kind of person. I'd far rather that than a fence at the top that blocks the view.

This is why (insert any modern western country) drivers are shit. They should all be made to learn and drive the first couple of years in a manual so they have to be more in tune with the car and the events going on around them.

I'm a fence at the top and ambulance at the bottom kinda person. Because there will be some people (me and you) who will jump the fence and base jump to the bottom in total style and land safely. aaaaaand then there will be others that jump the fence trip and fall and drag someone down to their horrible and gruesome death.

Haha you already do. WOF, Rego, Licence, Laws....... mind you the fence is a bit broken in parts!
I once heard it would be better for learners to ride a motorcycle first in the interest of developing awareness. This was confirmed by a guy on here who said when his wife was learning to ride she found it was necessary to become far more aware than driving a car.
Yes I 100% agree. I became such a better driver after I started riding.

I got camera on bike! (not right now tho...damn thing broke mount...again!!)
I don't post online or share the footage with anyone*(and don't send in all the footage of carnage etc on ChCh roads to the popo)...its not what its for
Mines there in case I get knocked...hard!:pinch:, a few mates know its hidden on the bike and its purpose...to speak for me if I cannot!. (And I hope that day never comes)
I actualy used to have it in a visual place (shoulder strap on bag)...but when some people see a camera, and they have been acting up...YOU ARE SUDDENLY THERE NEXT TARGET OF RAGE!!
I had a rethink after some boy racers thought I was filming them being dicks (Was just trying to ride home)...but they saw a camera!, so they tried to forcably stop me for a wee "chat"...with there fucking car!!:eek5:
Twice now, the visable camera has caused me such grief with dickheads (It also works the other way sometimes, people pull there head in etc)...but I no longer risk it now:no:, hence the hidden camera for MY personal reasons, so if the worst ever happens, my friends can get the footage, and once "checked", my family can possibly have more answers than questions.
But I do like watching ride & track vids etc, so I encourage those use's etc...but I feel some on here need to be aware of the possible repercussions of being "armed" with a highly visable camera...don't play cop like the guy in the vid did...he was lucky that van driver was "reasonable"...ish, and not some insane kid on a high and acting out of rage or panic...and trying to "remove" the evidence.
Ride Safe Kbers:love:...we aint the popo!, were mean't to keep them employed ;) (There paid to deal with that shit...we aint!)

We made our son learn and get his license in a manual, and he still drives a manual 3 or so years later.
Also, when he first got his L plate, I took him out onto the driveway and had him sit in the driver's seat and keep an eye on me as I walked 1 metre away from the back and side of the car until he lost sight of me in the side mirrors. I told him to always look over his shoulder before changing lanes or pulling out as the motorbike rider's life he saved might be his fathers. We also did a defensive driving course together, and I'd take him out in the car and discuss things we had covered in the course with him.
I've been in the passenger's seat when he drives and he always checks over his shoulder. I'm quite comfortable being a passenger with him. I'm satisfied with the job I did, wish some other parents took as much interest in their children's driving safety.

What the police need to do is offer a percentage of the fine money to those who have camera evidence of an offence as after all they are doing their job for free. I agree with you the guy on the bike took a risk and I guess those that see themselves as wannabe police will continue to take the risk in the same way as those on the opposite side of the law do.
I thought that too. At first.
The trouble with video evidence is it only shows what the submitter wants you to see.
For all we know the van driver was trying to call the police to report a biker pulling stunts in traffic. It doesn't take much in the way of editing skills to lop your stoppie where you almost ran a little old lady over off.
It is bad enough listening to all the whinging around here when someone gets a ticket. "Oh, the cop hid under a bridge. Impossible not to speed there on such an awesome bike with my awesome skills." Wa fucken waaaa.
Now imagine a world where people want to make a little cash and can get it by submitting videos.
I am willing to bet most people reading this post can think of at least one person who would cause situations so they can edit their own actions out and submit for cash.

Yep, that's fair enough.
Another funny aspect I've discovered after years of research...is that if I drive/ride in a sensible and respectful manner, in general that's the response I get back. Indicating, safe following distances, keeping left, you know that basic shite? We're always gonna come across the exception, and that includes ambiguous policing from time to time.
Oh, and when someone makes a little mistake in front of me then I just take a deep breath and let it go. How much of the drama on our roads is storm in a teacup stuff?

This is the fine line though - at what point is it Just/Unjust? To many, the 5 Kph tolerance is Unjust, but from a Police PoV, they issued a valid ticket etc.
Further to this - the police can't be everywhere at once, and so we have a responsibility to work with them to crack down on illegal behaviour - sometimes that is *555 a driver, but that may not always be possible.

But is it really unjust to expect people to follow the rules?
I got a ticket yesterday. 12 over.
Fair enough. I was 12 over.
2 kms more than tolerance. But that is still 12 over the posted limit.
EOD: if I did not know I was speeding then I deserved a second ticket for not paying attention. As it was, I knew I was over the posted limit but was not aware I was over the tolerance.
It was justified. At 101 I would have wanted to see a calibration cert. hell at 103 I would have argued till I was blue in the face. But if the advertise tolerance was 105 and I got popped at 106. That's the rules.
Not my first ticket. In the past I have always been 1 km over the posted tolerance. But I don't argue them because I was speeding.
Over 8 years and a 150000 kms on a bike since last ticket.

The problem with your argument is that the police can not be everywhere at once and having public cameras keeping an eye on things as well can only be a good thing as long as the owner of the camera does not try and physically confront as well.
The problem with your argument is that you are not stating a new point of view or introducing new evidence. So not really an argument as much as restating your original position.
No, the police cannot be everywhere.
Would you really want them to be?
Have you looked at your own life and thought I am completely without sin in all aspects?
Do you always correctly indicate? Observe all speed limits? Do you recycle? Do you dispose of your oil in a responsible manner? Have you ever found something in the street without handing it in?
Have you ever executed a lane change to find that no your head check was not adequate?
Have you never broken the law without getting caught? Mass survailence might put an end to crime but at what cost?
For that matter do you know what all the applicable laws are at all times?

Aye, some laws and rules are unjust... and there are channels for seeking to ammend them.
Arguing with the police at the side of a busy motorway is neither constructive nor realistic.
My only observations that even come close to negative about that experience was that there was not the usual opportunitiy to explain my position and he never actually told me I was being fined.
License please, do you want to see the laser reading? Is this your vehicle and is it warranted registered etc.
I don't think it would have changed whether I got a ticket or not but it does make you feel more a part of the proccess and less like a victim if you get to state your side.
At first he appeared to be looking forward to getthing the big bad biker for everything he could.
By the time we were done:
He seemed a little disappointed I was friendly, legal and cooperative.
He seemed a little embarrased to be giving me a ticket... not that he actually told me just slipped it into my hand when returning my license with a sheepish look on his face.
Personally I think in the location I got stopped a speed limit including tolerance below 130 is asking for trouble. More than once I have had to up the anti speed wise against my will due to the poor driving skills of some of the people coming down that hill. But the rules are what they are, I made my choice that it was worth risking the fine and it is time to man up and pay the fine for my actions.

That all depends on how you go about it and the intentions of the officer at the time the camera comes out.
Pull out a camera and ask them if they mind if you record as is your right to do and I would hazard a guess that few would object.
Pull out a camera thrust it in their face and rant about how "I am recording this pig. It's going on facebook, my lawyers going to fuck you up" etc. and I doubt you will get a warm reception.
Any where in between will be met with resistance equal to the attitude you present them with.
