View Full Version : Consequences if caught riding on new road not open

We have one of the RONS almost finished near here. Its a lovely looking piece of 4 lane highway and its just begging for someone to go for a blast on it before its full of traffic.
Easy enough to get onto, the gates and fencing around it are token gestures.
I'm wondering what I can be charged with if caught.

Just say your GPS directed you onto it.

Plus anything is legal until you're caught isn't it?

You'll be charged with being a soft c*ck if you don't ...

If it is 'closed' it isn't a public road, so charges could possibly include trespass? However, that's a civil and not criminal offence (so long as you don't cause any damage).

You have to be warned that you are trespassing and given the opportunity to leave the premises before you can be done for it.

A mate went for a little pootle along the new NW motorway prior to opening to the public. He seemed to have enjoyed the opportunity...
Faulty speedo needle. It seemed to want to magnetize itself against the right hand side of the dial. Guess it must have been faulty.

I'm sure you'll be fine as long as you have your Sitesafe card. :2thumbsup

Don't do anything overly stupid and you won't have to worry about getting caught. If you do just act incredibly thick and say you got all foncused about where to go.

I've heard of a guy who knows a guy whos auntie used to repair shoe laces for the midwife of Pauls (he sells kettles made of plastic at the market, tough peddle) first son Masport, who is friends with the butcher that I buy meat off whenever I'm in Hong Kong that has been know to do such things frequently on SH1 road upgrades with no dire consequences ;)

He doesn't bloody post about it on the interweb though, and if he didn't it would be before the fact  :bleh:

You need do it before the new Workplace NZ laws are in effect. Dangerous act on a construction site could end up with $600,000 dollar fine.

well Im glad that I rode over the new Owen River bridge before it was any where near finished....before the new laws are in effect.
In my defence, I was under the influence . Of one thing OR the other thing....

When the toll road opened did the ride got the T-shirt. The cops watched bikes and cars at speeds that would have cost instant loss of licence and just laughed because the road wasn't a road until Monday.

Hmmm - no one gives a shit if you do that on new subdivisions - heck it is almost encouraged as you may end up purchasing a section.

NO pictures ... didn't happen.

The silly buggers that get caught ... just ruin it for everybody else.

It is only illegal if you don't pull at least one minging wheelie.

...I parked a Volkswagen on a newly formed bit of road near the ferry wharf in Lyttelton once...the concrete had only just been floated and was 8 inches deep...it's really amazing what those big wheels can drive through...it really fucked off the gang of harbour board chippies who had just poured it...I was a chippy in another gang...:Punk:

Yeah well, that's why I find the whole GoPro popularity so bizarre. Why anyone would want to record stuff that's either illegal or plain stupid :weird:...ready made evidence for court or laughing fodder for Youtube or such :killingme

I know the road you're talking about OP. My colleague at work cycles over it regularly with the Tauranga Cycling Club (or something). TCC recently sent a letter to the club saying that workers were "concerned" with the number of cyclists on the new road with equipment around etc. But no one seemed overly worried about it.

edit: Having said that, not sure why you'd want to bother. It's a long straight piece of highway, literally the most boring type of road out there.

Yes it is. I want to see what my bike tops out at and this seems a good piece of road to try it on.
Its way longer than any racetrack straight, should be smooth as, no other traffic and no cops to worry about.
It will be a one off and I wont be on it for long.
The new roundabout and entry/ exits at the Rotorua end are alot of fun tho.

Just check that there aren't any bits missing off it first eh....

Vietnam has just opted to replace all of its national highways .... in one go. ALL of the bikes head straight through the cones and dodge a myriad of construction vehicles to continue their journey (I can speak volumes for the awesome grip that wet bitumen offers).

I did once in the driving rain come within a few feet of not noticing that a bridge was yet to be constructed :/ Sadly, the GoPro wasn't running for that one.

Drove an unopened bit of SH1 by Taupo in the '80s. Wasn't sealed but was a formed road. Still have good memories of that night. Didn't get caught so can't comment on the legal implications.

The road from Rainbow Mountain on the Rotorua-Taupo road towards Murapara - 7km long straight. Best on a weekday, less aggravation

haha, the only time I've used that as a drag strip guess who/what I found coming towards me about half way along?
He didn't bother turning after me at least.

A bunch of us on Blackbirds and 'busas went down there on the way to East Cape a few years ago. Nothing on the road fortunately :innocent:

Doesn't count, it's all down hill going towards Murupara. The state highway out of Taupo going towards Rangitaiki on the Napier/Taupo road is good but highly Policed.

I did 200 km/hr on my ST1100 on a long straight through the canefields out of Mackay in tropical central Queensland. That was a oncer just to see how fast she'd go. I believe there were another 20 to 30 km/hr in her at that speed. When you say it's 125 mph it doesn't sound as fast.

nothing unless you do damage... you have to give your name etc if you get stopped (caught)... then they warn you that you're trespassing & don't do it again, get caught again you get a written warning & then if caught again done for trespassing... pretty sure that's how it goes, but then I could be wrong :corn:

The definition of a 'road' in the legislation (http://www.legislation.govt.nz/regulation/public/2004/0427/latest/DLM302197.html)includes 'A place to which the public have access, weather as of right or not'.
Which includes closed or yet-to-be-opened roads.

So in short you could still be ticketed / lose licence blah blah.
