yz250 kickstarter

The pinch bolt came out of my kick starter on a trail, so it kept swinging out and hitting my boot, I ordered a new pinch bolt from Yamaha, put it on and it is still loose as, have to cable tie round the frame to keep it from flicking out, do I need a new kick starter or is there a way to fix this issue?

there should be a spring and ball bearing in there as well which locks it in place
