View Full Version : Got given a bike with no WOF and no reg as a courtesy bike

Checked the 'Busa into CycleSpot today for its service. No loan bikes available. "No worries - the boys in sales will sort you out with something."
Rock upstairs and the sales dude goes "Oh, got a brand new CBR300 you might like" sees me cry inside and goes "just kidding, let's choose you something fun."
Gives me an Aprilla Dessiduro 1200 - mean!
I head back into the city and promptly get pulled over by the cops on Queen Street.
"What have I done?"
"No WOF or Reg mate - it's been out for a year. Don't tell me you didn't know...."
"Shit seriously? It isn't my bike - I'm so sorry...
"Yeah, well responsibility is with the rider to ensure all is good - etc..."
I explained it was a courtesy bike, mine was having a service and he wasn't too convinced. He asked if worked for CycleSpot. I showed him my Facebook post "check out my courtesy bike for the day" and he said fair enough and said he'd let me off. He'd pretend we never met but couldn't make any guarantees if I chose to carry on riding.
Had it not been a courtesy bike though, or I'd been a knob, he would have stung me for No Reg ($200 an 20demerits), No WOF ($200), cut down number plate ($100 and 25 demerits) and probably pink stickered it too for being so far out of WOF (over a year).
Another day and the registration would lapse completely.
As it was he complemented me for exemplary riding!
CycleSpot weren't bothered. "Well done for talking your way out of it - nice job"....
Can't say I'm very impressed. I know I should check it out but the salesman game me the keys to a bike in his showroom. I assumed his paperwork was up to date...

Pretty shit service of them.
And I'm sure if you did get tickets, they wouldn't reimburse you in any way.
Plus you'd probably have for fork out cash for getting their loaner bike back to them after being stickered.
Or they might've paid it all and apologised profusely...who knows.
Moral of the story, Facebook saves the day.

The guy went "Oh it's fine - we'd be the ones that got fined".
Er nah, not how it works bro.
I told him as a courtesy that the bike would be deregistered at midnight if he didn't sort it and he tried arguing. I just went, look I really don't care - I'm just telling you what the cop said.
They're gonna have a fun time when they sell it and then have to stall some punter while it gets re-vinned and he wonders why the plate changes.

1. Aprilia Dorsoduro
2. Your responsibility to make sure the vehicle you're driving/riding is legal
3. You only get one set of demerits (the highest) from a set of infringements.
Loan bikes cost dealerships (or they hide that charge in the invoicing to you). You could have had the 300 couldn't you? I'm just happy to get a set of wheels to get away from the dealership and return (rather than messing with transporting the bike or sorting a lift). Occasionally you get lucky with something nicer...

Yeah, I know it is my responsibility - I'd still expect better from a reputable dealer.
And I wouldn't have moaned - he was just being nice finding something nice for the guy that dropped $16k on a bike a month earlier there. I'd have been happy on a GN - as long as it was faster than a bus!
I'd spin it round and say that loaning a bike is a great way to get the word out about different models. The experience aside, I found it to be an exceptionally fun bike to ride and my post here would be "had a go on a Dorsoduro - here is why I love it".
The guy at Cycletreads gave me the 2016 R1 for a couple of hours last time I was in. I told him I couldn't afford it and he said "I don't care, it is called advertising - I want you to tell your mates how awesome it is."

Is that a hard and fast rule or just up to the discretion of the cop writing the tickets?

I believe it's a hard and fast rule... but I'm foxed trying to find reference... I'm sure I came across it somewhere, ie, lets say you've been a bad boy, picking up multiple infringements (speeding, breach of licence conditions etc) at one stop and you get 20, 20, 30, 45 or something similar, you don't get all of them, just the highest set.

It rings a bell for me too, just not a very authoritative one. A quick google didn't clear it up for me either.
It would be rather handy if it were the case though. It would make riding with rego on hold a much smaller risk if the demerits from that infringement didn't apply when you've been pulled over for a speeding ticket, which is probably the only situation most people ever get stopped for.

Vehicles registered to LMVD automatically go onto exemption status. The plate is not going to lapse.
Which the cop knew since he threatened with demerit points. Reg not current is just a fine, on hold incurs demerits.
Shouldn't this be common knowledge ?

Like I say, I totally realise that it is my responsibility.
Just as it is my responsibility to take 10 mins before I nip up to countdown to do all of the pre ride checks in the owners manual. Some things in life you just assume though.....
As an aside, they probably shouldn't be doing 82kph in a 50kph on a testride either but I'm on a 'Busa so I'm hardly going to be one to preach

The whole thing demonstrates a casual attitude towards the law & clients alike. It doesn't inspire confidence in the provider at any other level either.
Well maintained, legal & insured vehicles specifically for the purpose of loaning to clients is the life blood of a successful vehicle repair business.

Having a non current reg is not as simple as just a fine because you have to pay reg back as far as when it expired too hence why many put it on hold.
Failure to display current vehicle license. That charge is just a fine.
Use of a vehicle with licence exemption. Demerits and a fine.

Cop should have just issued a set of stationary vehicle infringements (200 no wof, 200 no rego). Parking tickets have no demerits or name to them.
And told you to hand the tickets to the bike shop when you return the loaner and they can sort it out...

I had a similar situation a few years ago with a trailer hire. Didn't get a ticket either and always check WOF's and regos on rentals and loaners now as a result.
Bit slack of the dealer but mistakes happen and at the end of the day it all ended well, so easy life lesson and all that..

Sorry not legal, see the rules below for the use of dealer plates, bet you they didn't give you any paperwork to go with the plate. Most shops get away with doing this as the rules are not well know.
In limited cases, you can use trade plates to drive a vehicle that is uncertified and unregistered.
Trade plates let you drive a vehicle to and from testing stations, specialist repairers and garages in order to bring it up to the appropriate standard. Vehicle repairers can also use trade plates on a registered but unlicensed vehicle that doesn't have a warrant of fitness or certificate of fitness, where the vehicle can't be licensed until the repairs are completed.
Staying within the law
You must have a valid trade plate fitted to the vehicle.
Also, you have to be driving the vehicle for one of these reasons, which must be within the purpose you were granted the trade plates:
•demonstration of the vehicle
•delivery of the vehicle
•completion of construction of the vehicle
•repair or modification of the vehicle
•road testing in connection with inspection and certification of the vehicle
•evaluation or testing of the vehicle.
Before you drive the vehicle you must also:
•complete a conditional permit and carry this with you when driving
•complete a safety checksheet and carry this with you when driving.
You can only drive the vehicle to or from one of the addresses listed on your conditional permit.
Conditional permits
You need to complete a conditional permit before driving vehicles not certified for use on the road. You complete the permit, sign it and date it yourself and then keep it with you to hand over if you're stopped by the NZ Police or one of our compliance officers.
The permit consists of:
•annex A (external link) – you list where you can drive the vehicle
•annex B (external link) – your promise that you've carried out the safety check and that you'll only drive the vehicle for the purpose you're allowed to drive.
You need to complete annex A and B if you're driving the vehicle no more than 50km from your business premises. If you want to drive a light vehicle further, you must tow or transport it or get it certified.
If you're planning to drive a heavy vehicle (over 3500kg gross laden weight) more than 50km from your business premises you need to visit one of our licensing agents. The agent will inspect the vehicle and issue an annex C form.
Safety checks
You must:
•carry out a safety check on the vehicle before it's driven anywhere – use the check sheets linked below
•transport or tow the vehicle everywhere if it doesn't pass
•sign the safety check form if the vehicle passes
•keep the safety check form in the vehicle.
Signing the safety check form makes you responsible for the vehicle's condition. If you don't have enough experience and skill to carry out the safety check, we strongly recommend you use someone who does.

So if no WOF, possibly a insurance out - so if you'd dropped it and the insurance company declined cover you'd be in the clear as it was not insured thus document irrelevant :-)
The shits should have checked it first - not you!

They'd been behind me for about a minute when I ducked down a little side road looking for parking. It looked dodgy though as it was a dead end road so they ran my plate.

I test road 12 bikes when choosing this one, most on a dealer plate.
The only time I got given any dealer plate paperwork was for a new Daytona from Experience Motorcycles. He handed me back a copy of the "insurance form" which when I emptied my pocket later I found also had the dealer plate stuff.
The 50km was news to me. Took the R1 I rode 250km!

perfectly legal for test rides especial if they gave you the dealer plate paperwork, as it says in the rules can be used to demonstrate an unregistered vehicle. The 50km limit is as the crow flies from the dealership so a pretty big area.
The only proviso is that you cant fit it to a bike that is registered but has either a lapsed licence (rego sticker) or has the rego on hold, but this happens all the time as most people don't understand the rules around dealer plates.
as for being outside the 50km limit this is only a problem if you get pulled and the police officer knows where the shop is, I have only heard of one person getting pinged for this. The shop was in Napier and they where picked up just north of wellington, they picked up they new bike on Saturday morning after much pestering but in the days when you couldn't register things on the weekend only Monday to Friday. they where told the bike wouldn't be ready to be picked up till Monday but they couldn't wait so the dealer lent them the plate for the weekend so they could at least take their new toy home. They where told the rules and to bring the bike back Monday to be registered, decided to go for a little ride to run it in and got pinged for speeding. The cop also uplifted the plate which caused a few problems and a trailer bound retrieval of said new bike. The shop was not impressed come Monday morning as no dealer plate and they have to apply to get a new plate with a please explain letter as to why they should get it back.

Not quite right Bro. Even an MR2A has a limited lifespan. And fuck me...what a thread. The OP would be crying his eyes out if he wasn't given a bike, and is still doing so when he was. I've sent a bike out on a test ride and forgotten to attach a *D Plate*, the guy picked up a $400.00 ticket. I paid it, and by that, I mean personally. If I hadn't have, my boss would've. But it was my bad...I get to pay.

The dealer didn't "forget" to attach a D plate. He forgot to get his paperwork in order, and for a long time at that.
In any case, a D plate doesn't cover a courtesy bike. Sure, the guy might have said "just say you're on a test ride" if you get pulled over and I would have been "no worrie".
I wouldn't be "crying my eyes out not to get a bike" but I would be annoyed. I had booked the service 2 weeks in advance and also booked a loan bike as I needed to get to work. Come the service, "oh shit, we're out of loaners - no worries, sales will sort you out with something".
I freely accept it was my job to check WOF and REG. But then again, I'd not long ago bought a bike from, and therefore built a relationship with, the salesman who lent my the bike. I'm not gonna go "cheers for the bike, just give me 5mins to double check you haven't been a lazy knob and forgotten to do your paperwork?".

Glad to see you weren't penalised as a result of this.
I had a ticket (in the UK) for speeding in a hired van - I was travelling at 55mph in a 60mph zone. apparently, the size van I was driving is limited to 50mph in those areas... I had no idea. And given that minutes before I was being 'pushed', while at 55-56mph, by a 40+ ton articulated lorry, I'd not given it a second thought.
Sadly the officer who stopped me subscribed to the 'ignorance is no excuse' school of thought. Oh well. My bad. One of those suck-it-up and learn from it scenarios.
Does seem a little odd that a well-known dealer would let the bike off the forecourt without up to date paperwork, though. I nearly got caught in a similar situation after an accident, when I found a loan car had rego expiring the following day. The garage hadn't noticed, so this sort of thing m,ay well not be uncommon. It's up to us to check, of course.

Wow and you do or did sell motor vehicles with this very 'understanding of different opinions' attitude....:crazy:I bet your kept your opinions to yourself when it came to a sale.
Yeah. I sold bikes (and continue to do so) with a 100% straight up, no lies, no bullshit attitude. Been doing it for a very long time. But don't take my word for it. Ask anyone that's bought a bike from me. But I'm not here to sell bikes. I'm here (like you), to have my own opinion on various things. You can do it without any recourse, so can the OP. I'll live by mine.
On the flip side...this here, is a site for people to put the knife into hard working people, that more often than not, don't even realize, that a so called *good/reg* customer, is doing so.
Work that out.

Take the time, to work out, how many *jobs* a particular bike shop may be doing in any given day.
.
But they booked the guy a loaner. Therefore it was there job and responsibility to make sure there was a properly prepared and road legal one available as promised. If they can't handle all the many *jobs* they take on in a day maybe they should hire more or better organized staff.
If they were any fucking good they sure as shit wouldn't have let a bike with no WOF or rego out the door. Pete I bet you would have done things a bit differently....

Yep, have mentioned if they booked (well, were meant to have booked) him one, then they should've had one for sure. But we all make mistakes, and at least they still gave him one. Yeah, not having it wof'ed etc is a balls up. But seriously...is it worth slagging the poor cunts off here? I certainly don't think so. It's certainly not something I'd ever do. And when I drop my ute off for work, I always arrange my own way home/back to work/ back to pick it up. Maybe I'm just a weird cunt.

I do wonder if all involved in the "courtesy / loan" vehicle business are to blame... both givers-of-vehicle and takers-of-vehicle?
Used to drop car off and get someone to pick you up, or drop car off at garage near work and walk [if you were lucky they might drop you there], or drop car off and catch public transport. Then someone decided that they'd offer a courtesy vehicle and now every man and his dog expects a loaner even when they just drop the vehicle in to have the presets on the radio done!
Nowadays, everyone expects this... and when it doesn't work then... [you can insert whatever phrase you like to finish that statement!]. It seems to have moved from "that was nice of them to do that" to "why haven't I got one too?"
Perhaps once it might have given a dealer / garage an advantage, but with everyone doing it do you get sufficient advantage to warrant the expense - in all ways - of providing a courtesy / loan vehicle?
Just a few thoughts...

The one and only time I had a loaner was last century. I had bought an XR500 from (coincidently) Cycle Spot. It blew up within a week so they took it into the workshop to check it out and loaned me an old beat up GS or CB 350 (or summat like that, can't remember the exact model) until the next day. I was heading west along Krd and did a right onto (I think) Albert st when some cunt in an
on coming car did a right turn across my path. I t boned him just in front of his front wheel and ended up on his bonnet looking right at him. I called him a cunt and a few other things, he said he was sorry, I told him to get fucked. Cops said it was his fault. Broke my scaphoid and it still hurts today.
Cycle Spot weren't too happy about it but I think they got over it....

My Mum dropped her car in at the panel-beaters a while back (someone had assumed that she wasn't going to stop at a stop sign and gone into the back of her).
The next day, she finished work and went back to the courtesy car to find it parked 20m further up Great North Road! Turned out someone had "fallen asleep" while drunk and high and driven into 5 cars.
Never stopped getting shit from the panel beaters for 2 rear ends in a week.

Can't say I'm very impressed. I know I should check it out but the salesman game me the keys to a bike in his showroom. I assumed his paperwork was up to date...
".
Pity you didn't mention in your original post you'd *booked* a loaner I guess. Kinda like you've added that in after the fact sort of thing eh? As some customers tend to do, because they're all so straight up and honest with bike shop staff 100% of the time eh?

Well I must say I'm pleased I found this thread because I've always assumed that when I've been given the use of a loaner that all the legalities are sorted before I ride away. I think the OP was a little unlucky if he was "targeted" because he looked dodgy slipping down a no-exit road.
Since I've only had loan bikes from Haldanes (originally) and then Colemans I'd like to think that they have a reputation to uphold and wouldn't put a rider in the position of being on a, technically, un-roadworthy bike.
