Are there any Lawyers in our little community that would be able to assist me in getting some money out of the little tin=top BAST%&*d who knocked me off my wife's bike. I am just getting the run around from them and really need some qualified help. Anyone out there???

I'm not a lawyer but if you are after money to compensate you for the smashed up bike and its not insured, I would just go to the Disputes Tribunal which you can do yourself for about $30.00.

If you are after money for injury to you, you're probably shit out of luck due to NZ's ACC laws, unless the driver is convicted in a criminal court and the judge orders he pays you some money.

I've been getting the run around for over 18 months after 'winning' in civil court.

Cost me $100 to initiate proceedings, so far I've received $90 and have had to drag the sorry mofo's arse back into court 3 times for non payment.

Now I hear I have to pay $185 to have him done for contempt if he continues to default on payments.

Great justice system eh ?

It seems I am being forced into either reverting to criminal activity in order to get my recompense, or give up.

If there has been no prosecution walk away and put this down to one of lifes experiances. If the court has awarded damages go back to the court see their ( dammed if I can think of the correct name) they are a section of the Justice Dept that deal with this specific problem. It's a slow and tortuous process. If the defendent has no assests chances are slim. Same goes if his car is owned by a hire purchase company.

Been there done that. Never again. Know how you feel. Court awards damages to 'the people' and the Justice system doesn't give a fuck. Try defaulting on fines and the system kicks arse 'big time.' All of which raises and interesting question.

Why should the people pay court costs when it is the peoples court?
