View Full Version : Speed camera flashed at 182kph

So 2 weeks ago I received a letter informing me a stationery speed camera clocked me at 182 kph on a rural road there was no fine just right down the bottom of the page stating 'you may receive an additional letter with court dates etc'. I have emailed asking for a photo and also done some research on what I'm looking at including fines, loss of liceanse for 28 days, careless, dangerous or wreckless driving witch is a criminal offence . Anyone had or heard of similar cases and the outcomes? ,I need my liceanse for work I'm looking at pleading guilty and more than likely trying diversion... If or when I get a follow up letter.
Cheers.

Yep. Pretty screwed I'd imagine and yep ... if they charge with reckless or dangerous it'll be more than 28 days. I think the minimum for one of those two is 3 months ... not sure which though. Not sure if they can do that off a speed camera though?
Probably the best you can do is take what's coming showing proper remorse and apply for one of those 'Work Licences' that allows you to drive to and from work and in the course of your work. Not cheap though. A truck driver husband of a colleague of mine got one a few years back and I think it cost him $1200 all up.
Good luck.

Damn I didn't know stationary speed cameras could be used as evidence for dangerous driving etc, I thought they were only for speed fines. That sucks.
Ginge09

This will be elevated beyond infringement offence to criminal offence. Probably dangerous driving. Mandatory disqualification. Diversion less likely on traffic offences.
I'm guessing six months loss of licence, maybe nine.
About $2500 for the fine.
No work limited licence application until after 28 days, and another wad of cash for that filing fee (can't remember what it is).

somewhere i've got a set of photos of me on my RF900 at manfield. they had a speedo calibration day where you travelled each lap down the back straight at 100kmhs according to your speedo, they had a speed camera set up and they sent you your photo all for a donation to charity.
I tried once, then I think i maxed out at about 195km'h hour and it was too fast for the camera to be able to read the number plate, did four laps getting faster each time and all the others were ok
next time, crank it open a bit more and you'll be right

Riding a Yamaha R1? Personally, I think they should send you a letter thanking you for showing restraint (Hell, I've ridden faster on my CRF and that is an adventure bike rather than a sports bike).

3 potential charges.
Exceeding 100 kmh. Up to 50 kmh over, it's an infringement. More than 50 kmh over, it can be laid in the JPs court as exceeding 100 kmh.
Driving In a Dangerous Manner, or Driving At A Dangerous Speed. 6 months minimum disqualification, fine up to $4500, or both, and potential for 3 months prison.
Driving In A Reckless Manner. Basically, it can be laid, but it's unlikely. To prove reckless, they have to prove that it was intentionally dangerous. Mens rea.
Suck it up. That's a silly speed.

I don't want to come of as being all pious but those 'roads' where its a doddle to do 180kph are called 'racetracks'. Things happen too fast at those speeds on public roads. My lesson was hitting a lovely sweeper on an empty highway at about 140kph many years ago. Feeling great ... and then a black cat ran across the road in front of me halfway through the sweeper. Cranked over I couldn't really do bugger all to change my line safely so held the line and closed my eyes. I credit the cat with missing me. I had no chance of missing the cat. Could have been anything ... a sheep, cow, car, tractor etc. Fortunately for me it was an agile cat (unless I cut him in half and didn't feel it). I slowed down after that. I'm old and boring but I'm still alive.

Sorry to burst you bubble ... but ...
http://www.police.govt.nz/sites/default/files/publications/adult-diversion-factsheet.pdf
What are the offences for which diversion is
generally not considered?
• offending that is likely to carry a significant sentence
• traffic offences that carry a mandatory minimum
disqualification
• burglary (in most circumstances) or dishonesty
offences where there has been a breach of trust
• violence offences (in most circumstances)
• family violence offences (in most circumstances)
• sexual offences or offences with sexual overtones
• serious drug offences
• offences for breaching a Court order (e.g. protection
orders, restraining orders, name suppression)
• offences specified in the district as ‘a high prevalence
offence for which diversion is excluded for a specified
period’

Some on here will say you need to be able to look out for animals coming out from driveways etc as you ride along and riding schools can teach you how to do it.
Any form of situational awareness allows you to look for dangers and threats.
If you are not capable or aware of the need to be scanning for potential threats as you drive or ride you shouldn't have a licence.:msn-wink:

I would say you need to be able to look out for animals coming out of driveways, would save getting hit by a dog or two as has happened to some of the idiots around here. Didn't need to go to riding school to learn the bleedingly obvious either.

Don't think you are exempt from any of that on the racetrack. Many years ago a guy in a Leyland truck accessed a gate on the pukekohe club circuit & drove on to live track deliberately.
My wife was racing a sidecar at Manfield a couple of seasons ago & a family of ducks decided to cross the track in front of her. Anyone that has raced at Hampton downs has probably diced with the odd Pukeko at the entry to turn 6 too.
Don't get all pious about "the racetrack" I know plenty more people that have fucked themselves up on a track than a road.
And seriously, what the fuck is with closing your eyes during the point when you should be trying your absolute best to control your bike the best you ever have to avoid binning. No wonder our insurance premiums are so high with people doing dumb shit like that. Are you fuckin stupid?

There's a fair bit of "holier than thou" in evidence here. Many years ago, when I was a lot younger, I used to cruise at that sort of velocity sometimes. It's hard to even imagine R1 riders who would never do 180kph, they'd be about as common as unicorns.
If the letter comes then, as has been suggested, it's time to consult a lawyer. The judge should give you credit for the fact that you are playing the game of money-go-round that is our court system. A JP may not be so understanding.

Read it again Trev. Reads to me that the leniency with the fine was due to the imposition of the 6 month disqualification, which is mandatory with that charge.
Addo007
26th April 2018, 17:44
You won’t get diversion for a charge with a minimum specification for disqualification, all the dangerous driving charges including dangerous speed have a minimum 6 months disqualification.
The issue with speed cameras and particularly motorbike riders with helmets is proving identity. Unless they have an admission or conduct a search warrant to match clothing they will struggle. The best that can happen is they serve a notice on the registered owner demanding details of who was using the vehicle at the time of the offending.
That said, I agree with a lot of the comments that the speed was ridiculous and those that do the crime.....

funny story. back when i didn't know any better than to believe in licenses, (a juvenile) i had it taken off me, and was latterly stopped and breath tested. if i'd had the license i would have been over the reduced BAC and i'd've gone to bumrapeland.
because i didn't (because they took it off me), there was no other provision in the legislature, and since i was under the full license/adult BAC I walked out of the cop shop with some fucken sore looking cops shaking their heads.

Yes - they can - they have a picture of the bike, the date it was on the road, the number plate and they can match it to their records to show on the date you were photographed you were not registered.
But the camera only takes the pic if you were over the speed limit ..
PS - they can also check to see if it was warranted on that day.

A friend in Dorkland told me a story of his mate who was riding up round Whangarei - older guy (maybe around 70-years) - from North England - got caught south of Whangarei at something like 135 klicks.
The cop asked him if he knew what speed he was doing.
The old guy replied (in a thick accent) "Oh No officer - at that speed I'm way too frightened to look at speedo."
The cop laughed, told him to slow down and let him go ..

As an inexperienced biker aged about 22 it was a completely involuntary reaction I can assure you. I'm just thankful that my reaction did not include grabbing a big fistful of brakes. (Learnt that lesson right at the start on some wet grass when avoiding a power pole that someone placed in a grassy picnic area). "Do I brake to avoid the pole or do I try to change my line and go around it? I know ... I'll do both" resulting in my very first (and worst) off at all of 20kph I'd imagine
I've subsequently trained myself to ignore the cat/dog/bird that is heading at me, hold my line and watch the road.

We all have a blast, from time to time. Try and do it safely, where you are not a danger to others, and also do it where you know there are no cameras.
I used to have a 200kph blat on some mornings, on the way to work. I mentioned it to KB and the next morning, there was a cop with a laser pointer waiting for me.
Luckily, (I saw him before she saw me) it was all just a joke and I would never do such speeds on the public highway :msn-wink:

i know of someone in a WRX that passed a row of slow cars being held up by a old shitter towing a big yacht, they had sat behind them for ages and no one would pass, big long straight, no on coming cars, the driver passed the line doing north of 180, pulled in and began braking when a rozzer came round the corner, heavy braking ensued, resulted in being stopped miles down the road cos the cop couldnt get past the fucktard doing 70ks, was clocked at 111 was told to slow down , no ticket
Not one of your younger cops then

Corrections Department message: When it's not moving, it's spelt stationary. If you mean letters and envelopes, you use stationery. My advice is that you think e is for envelope when you want to use stationery.

I was in a similar situation on my 636, passed cars and slowed down, POPO clocked me at 186 (slowing down ) pulled me over cpl kms down road, gave me warning to slow down and let me go on my way :niceone:

I had some zitty faced cunt pull me over on the Desert Road years ago whilst I was doing 120kph in my XJR Jag. He started to give me a lecture in the dangers of doing those sort of speeds. He looked a lil shocked when I told him he could either give me the ticket, or the lecture, but fuck off if you think you can do both. Seeing as he was already writing out the ticket, I was in no mood for the wanky lecture from some wankstain that had prob been driving for less than a couple of years.

On my way home from work some years back, on a big trail bike I'd built. Did 50 kph through a tightish bit of up and down with a cop on my tail. Got pulled over and he started to read me the lecture before I'd got my helmet off....When he saw the white hair he shut up abruptly. He said I should know better - I said, don't judge a book by it's cover or a rider by the bike....I then asked if there was anything else he wanted to say ? No ? Bye then.

Said to the plod, 'your missus must be fuckin ugly if you'd rather be dishing out tickets at this time, than be at home in bed with her'
Ive usually gone the other route - bit of a grin, followed by a friendly 'aww, surely it wasnt that fast mate!'
escaped a ticket for 260km/hr on a R1 with that in 2011 heading south on the straights near Amberley.

One of my old mates got sprung for the exact same thing but didn't get an ear bashing & on your way though; the events stacked against him for the punishment but:
1st occasion he got sprung by a cop on one of the back streets in Redwood (ChCh) and took off with the cop in pursuit and had cleared out but gave himself a fright on a corner so pulled up, cop eventually found him and thru the book...straight to court and done for in excess of 160km/h in a 50 received a 2yr loss of licence & $900 fine.
Two & half years later, late for work one afternoon on bike and passed a bunch of cars in one hit on Johns Rd and merrily filtering his way thru traffic and a few kms down the road spots the discos in the mirror so pulls in with cop hard on his arse and proceeds to get another ear bashing with enlightenment to the fact the cop had been chasing him for kms....result off to court again...unfortunately he reckoned the judge was the same guy and was hit with another 2yr loss of licence & another $900 fine

My mates, cousin's, nan's, brother-in-laws', son was doing like this much speed going up and down a hill at the same time while doing a whoolie. Police helicopter following him, flipped the copper in the chopper the bird. They even gave him the GoPro footage of the chase and said don't do it again.

The mention of the vehicle was to point out it wasn't a clapped out HQ etc, but a car designed to be driven at high speeds. Now tell me you've never done 120kph.

I do have some sympathy with the OP. Everything about newer bikes, with all their advanced gismos, makes harder to judge your speed.
Even being careful, running in my new bike, I've got close to 170Kph, just passing a line of slow vehicles, before slowing back down to 100-ish. It is very easily done

Grassington driver who swore at speed cameras jailed
A driver caught swearing at speed cameras three times in less than a week has been jailed for eight months.
Timothy Hill, 67, was pictured making rude gestures as he drove along the A19 in North Yorkshire in December.
Police discovered he had a device fitted in his car to jam the cameras that he later tried to destroy when officers began investigating.
Hill, of Old Mill Lane, Grassington, near Skipton, admitted four counts of perverting the course of justice.
So did he go to jail (which is fucking bullshit btw) for the jamming device or for throwing a finger at a camera?
Either way, that's some bullshit

That dial thingy or (digital readout) right in front of you makes it very easy to judge your speed if you care to glance down at it. If you haven't got the time to look at it you are prolly going fast enough to get pinged by the pigs.

Really, it's true. My 2008 bike was the same model as my 2018 bike is. I ride and zip past cars, in the very same way. What was 120kph, is now 170kph.
AND BTW: Like most, I watch the rev counter and I rarely glance at the speedo, unless I come into a <100kph zone.

Not really. What it reveals is that "the establishment" do not like being the object of derision. There was a case many years ago where a Brit guy was convicted pf spying. He had also been using his trade craft to molest young girls. The sentences were totally disproporionate, three years for multiple sexual assaults of young girls, thirty five years for spying.*

Similar to there being no demerits for red light offences or seatbelt offences, but there being 15 demerits for operating a vehicle with the registration on hold.
