Something to keep in mind when posting here.What you post can be read by any member or just as many guests.
Posting your address on an open forum may not be a good idea.Especially if you own a desireable bit of bike or kit.

All humour aside, Frosty makes a valid point. Not just for security reasons either. Remember your posts can be read by your kids/parents/boss/people you like/people you dont like/someone who wants to get some dirt on you etc etc. And they can read a post you wrote last year too...they are all there.

I know of three situations where bikers on here have had nasty results based on what they and others have posted on here, and the posts were mostly innocent except to the "other party"

So keep laughing it up ya plonkers it was a suitable warning that was aimed at helping you out............................ plonkers:bash:

The thing that concerns me most is the lack of a personal liability disclaimer in the signup process or on the main screen. There should be some big disclaimer here that information shared is peoples personal opinions and shouldnt be taken for fact or something like that.

Technically as I understand it, if you tell someone (directly or indirectly in a discussion) to try something on their bike and they crash - you could be liable for the result. Since I am not a business with the appropriate indemnity insurance - its quite off-putting. I delete many posts simply because I'm not sure about liability.

I'm pretty sure that if you offer someone advice that leads to their injury, whether it be in person, by writing, or on the net, you can be held liable unless you get the people to sign a liability disclaimer.

I understand you need a 'disclaimer' and/or 'limitation of liability' disclaimer.


There are good examples on most mainstream websites.

Here is one from allergy NZ


Allergy New Zealand Inc. has made reasonable efforts to ensure that the health information contained herein is accurate and up to date. To the extent permitted by law, Allergy New Zealand Inc., their employees and agents accept no liability (even if negligent) for any injury, loss or damage caused by reliance on any part of this information

Here is the one from AUT, note the imdemnification clause and the limitation of liability.

Two Seven, you can't sue in NZ for injury, so those disclaimers are there purely for the International viewership.

ACC and it's associate Act of Parliament make NZ a no fault injury country.

I can't see anything on the internet being enforcable by law. I get pissed and fall down and hurt myself (so I've found out later) all the time and it's never my fault. Shall I wear a disclaimer so that I don't sue myself?

So then, can anyone explain why every single net site in NZ has a liability disclaimer on it - including the ones I've listed. I've yet to find a mainline site that doesnt.

Also, if you cant sue, how come you have to sign a waiver when you go racing at any track or participate in any sports event. Why are people suing other people for injury, negligence and liability.

Next you will be telling me you cant liable/slander someone on the net. Or that net based contracts are not legally binding.

Personally, until one of you knowlegable people can post a link to the NZ law site that contains a valid reason why a liability disclaimer is not required, I'll continue to keep mine on my sig :)

The reason why I made the comment is because i'd be rather upset if I said something, even if I was just spouting off, saying what tecnique I used when I rode a bike or something, and some poor bugger took it literally and hurt themselves trying it out. I'd feel like a right heel. However, its also a biking site and people - ie. me, want to natter with other people about how they do things so as I can learn new stuff.

So the reason why I mentioned the liability/disclaimer thing wasnt so much as to stir shit, but to raise the issue that perhaps people should have it explained to them that [in my opinion] that they shouldnt believe everything they read - no matter how authoritive it may sound, in much the same way that toy companies suggest you shouldnt try and emulate superman by jumping off house rooves with a cape on. To me its an ethical problem, I want to talk about the advanced nuances of riding bikes, but I also dont want to risk accidently causing harm to someone by saying something that would be better said by a trained instructor.

Not quite true these days. Have a read of this (http://www.fmlaw.co.nz/publications/insurance_articles/damages_personal_injury.htm) (I've posted this link before).

In particular you may be able to sue for punitive damages, the civil equivalent of a criminal fine. ACC only covers compensation and rehabilitation.

As for whether you can be sued for something you say on an internet forum (most likely of a libelous nature), well quite possibly (http://australianit.news.com.au/articles/0,7204,12688849%5E15306%5E%5Enbv%5E,00.html). It depends if you piss off somebody with deep enough pockets and the inclination to pursue you through the courts.

You do NOT wheelie your bike etc down the nearest stretch of motorway. You must find a stretch of motorway where a COP is watching, then do it.
