View Full Version : photos being taken at roadworks

Keystone19
7th December 2005, 12:13
I rode through some roadworks with a stop/go person at each end today. I was at the front of the queue and as I exited the one way section the stop/go person at the other end was taking a photo of me.

Why?

I don't like having photos taken of me without my permission.

Anyone got any thoughts on why they would be taking pictures of traffic passing through roadworks?

Dunno... I had one taken of me the other day in St. Heliers, not sure what all that's about.

Nope, was the actual road workers... coloured shirts and all.

Believe me some people are just nutty and feel the need to take photos of anything and everything, there may be no valid explanation....

Bastards. Maybe they were just admiring the pretty bikes. You should have pulled a wheelie past them while yelling obsenities and giving them a brown eye.

I once saw dangerous do that.:killingme

Stop riding your bike in the city then - you get a camera pointed at you many times across the town.

That's in the future you know - cameras at point a and point b scan your numberplate as you drive past - and if the time equates to an average speed higher than the posted limit between the two.....in the mail.

The system has been running in NSW on the big rig trucks for 10 years.

Now Big Dave, settle down, I wasn't in the city - I was on the Riverhead - Coatesville Road.

And it was only the exit lady that was taking the photo, not the lady at the beginning so it couldn't be that.

I should have stopped and asked I suppose.

What are the rules surrounding this? Am I allowed to take pictures of people anywhere any time? What rights does the subject of the photo have (can they say no to the picture and demand the negative/copies be destroyed or handed over).

Big Dave?

I believe that if you are going to publish or sell the picture to make $$'s then you have to have the permission of the subject in writing. If it is for your own personal interst/perversion then that's OK:lol:

The rules/laws around this STINK! I am currently having an issue with the guy above me taking photos of me coming and going from my flat form his bedroom window, when I went to the police they said that legally he is doing nothing illegal. Basically if you are on your own private property you can take photos of anyone/anything on public or your own private property. If you are on public property you can take photos of anyone/anything on public land, and all this is entirely legal. Our "legal" system sucks arse.
Wouldn't have a clue about publishing the photos etc though

really? Cool... gimme details (like why is he taking them etc... I'd love to work out a revenge strategy.)

Let him know that you're annoyed about it, and every time he does it you'll find something to annoy him back.

Assuming it's not going to affect other neighbours (like in a block of flats) commence the regime of burning toast, starting and revving your bike EARLY, stereo up loud etc.

Only on the days he takes the pics.

Nah, believe me its NOT cool. Its scary, the guy in question has huge physchotic paranoid issues. He believes that the Courts/police and most Govt organisations are conspiring against him for some reason (god knows why). When I first moved into the flat I met him and told him I work for the Min Of Justice. When I caught him taking photos of me I talked to another cop who agreed that he was well known for taking photos of people and has attacked people in the past for confronting him about it. I am currently fighting my landlords to allow me to re-assign my lease and am awaiting the court date for a restraining order against him, which I applied for under the civil harrasement act... I havent been home for a week and dont plan on it either, so believe me it IS scary and at the least a huge annoyance!

aaaaaaaaa - ok completely different story. Contact the Tenancy Tribunal and have them tell you about the Landlord's responsibility to provide safe housing.

The right to privacy, safety and something else (I forget what) are the 3 basic tenets that MUST be afforded to a tennant. If you're not getting them, your landlord may be able to help (it might also push the neighbour into reacting, so it could simply be time to move on...?!?)

Good luck...

Yeah it IS scary especially when I caught him jumping away from the window when one day I decided to go slowly and stop to turn around to see if he was doing it... I dont know how long he's been doing it and what hes doing with the photos. Its even scarier that I live there by myself and the landlords don't "see" a problem.
I have been staying at my boyfriends for the last week and will be staying there until I can move out and find another flat. It just sux that im paying for a flat that I cant live in!

Honestly, we live in NZ, where, so far, there aren't quite as many weirdos as other places around the world, nor those weird cases of road rage etc - besides the hammer one I suppose.

Turn around, approach calmly, and ask "Out of interest" blah blah.

When people are approached calmly and politely, you'll get far more out of them, and if reasonable people, far more co-operation.

edit: woops, missed the second page, this is pointed at Keystone...

Given that I'm 6'4" and 120kgs have a black suit and 'bouncer' leather jacket (I could wear either). I could just pop down the road and sit outside your place with a camera watching him..... I don't give a sh*t if he has a go - I've been good for awhile now. Could be just enough to send him over the edge - get him committed for xmas.

I myself would love to have someone "sort him out" however I put my job at risk. Also this guy lives with a mental illness and is somewhat incapable of seeing that what he is doing is abnormal. He believes that what he is doing is right.
Really the biggest problem I have is the idiot landlord... oh yeah and the fact that I have no speedo or odometer atm, but I think I can fix that right now!

Hi there SJ
Seriously just move out, now. Do not wait, Do not pass go, just get out of Dodge, put your gear in storage and move in with the boyfriend. When you are finished with the landlord, get someplace else, lodge a complaint with the police, make something up if you have to, but get away from the nutjob. I am sure that there would be plenty of KBers who can help you move your stuff if you need it, just dont do it alone. Getting a photo of him would also be a good idea, if it can be done without making a fuss.
Keep talking to the police until someone takes notes and recognises he's a dangerous nutjob.

My 2c worth. In both your cases why not claim that taking your photo is trespassing on your culture, and the advice from your Iwi is that it can only be done in a culturally appropriate way. This involves the transfer of a substantial amount of cash or a complaint will be laid with the Human Rights Commission (Ngati Dadpole branch)

This is a good way to go as the Tenancy Tribunal normally sides with the tenant. What you could do with the PMC is offer to pay the re-advertising costs for new tenants and PMC comapny fees , it maybe a couple of hundred at the most. You can find out the owner / owners company by getting a title search done on the flat.
Normal you would have a contract with the PMC and the PMC will have another contract with the owner so it makes the contracts harder to break.
Perhaps let Mental Health know about the neighbours actions .

We had a tenant that had something similar , the boyfriend moved out shortly after they moved in , had signed up for a year. Shortly after that she thought that someone was stalking her / watching her ,called the police a few times etc. We thought it was better for her to move on than have her living like that. Hasn't been any trouble before / since she moved in/out which is good for us.

The guys with the signs are getting really tough on people going over 30 km/h or whatever the posted speed limit is.

There is the new advert campaign and they are sick of the danger of their job being hit by vehicles and flying stones and such.

When I was waiting in queue last weekend, I saw them drop the go sign in frount of a SUV trying to get it to slow down (probably doing about 80?) and it didn't so the sign took a huge amount of paintwork off the side...

Yeah, they're getting pissed about the unsafe drivers while they're working.

The future is now in the UK.

In my defence, I was not breaking the posted speed limit and I can completely understand these guys getting pissed at people speeding. It annoys me when I slow down for roadworks and a bunch of cars tailgate me all the way through because they want to go at 60 instead of 30.

The stop/go lady taking the photos appeared to be taking them as a matter of course regardless of who was coming around the corner. She had the camera out and ready before I got there. They were setting up again today when I went past so perhaps I will stop and ask them on my way home today. Will keep you posted.

There was a post (can't be bothered looking for it) in this thread about someone else being photographed, so it seems its a campaign thing. If it's just a normal digital camera it won't have the ability, the steadiness (being handheld), or the accuracy to be used as evidence for any supposed crime ie. speeding. Interested to see what they're up to though.

We've had a few 're-surfacing' around the Naki.. and each time I'm on them there have been the roadwork guys'n'gals in a ute watching the traffic.. Both really eyeballing everything.. I was wondering what was going on.. and I guess its in preparation for this new campaign. Good stuff in my opinion.. kinda sick of stone chips flying up at me... notice that most vechiles that tailgate me tend to suddenly fall back 20m's... twins just love throwing up stone chips at low speeds (and of course high!). =)

i would say that you were just lucky enough to be in the right place at the right time.
some of the more involved worksites will require many photos taken as a time progression to prove that work is being conducted correctly.

Well went this guy snapped me it was on a camera phone, which leads me to believe it was only a random piccy.

Although with regards to speed, I was running late for work, and the guy with the first stop/go board was trying to get me to pull a wheelie away from the line so obviously not that bothered about safety

Something like....
"Yeah those *Ninja's* (Fill your bike type here) are pretty fast alright. Can you pop a wheelie bro?"

Thanks for all the concern guy's. However scary and annoying the situation is, I am a Deputy Registrar for the MOJ and HAVE to do thing LEGALLY.

Hey SJ

Sorry to hear about the nut job. My advice is to just move out and stay away. Your case should be good with the tenancy tribunal. I had an asshole landlord a couple of years ago. They dont care as long as the moneys coming in.

P.S. whats up with the speedo/ odo? Whats gonna go wrong next?

Legally I cant just move out and stop paying rent.... THe good news is that the Tenancy Services are just as disgusted as whats going on with the landlord as I am so I have a court date on the 20th Dec so hopefully it'll all be sorted by Xmas!
As for now Im safe staying at my boyfriends....

As for the speedo the cable had fallen out so all I had to do was screw it back in, was a relieve to find it was minor!! Im hoping its plain sailing form now on!

Okey dokey

I stopped on my way home this afternoon and asked why my photo was being taken. Well, apparently she was just trying out the new camera that had just arrived in anticipation of the laser device that will be attached to it in the very near future to catch speeding motorists.

So, yes, if you are riding through toad works this summer, be careful, be verrry, verrry careful, big brother is watching you...

Is the camera going to be tripod mounted? I would serious concerns if it was hand held ie. accuracy. I can't profess to knowing much about speed cameras but I thought they needed to be mounted on a stable platform?

I saw two Highway Patrol cars taking pics of every car to go round a hastings roundabout today. Manual speedcamera?

I'm sure it's got something to do with the range (thus speed) finding/calculating bit thingy.

Yes, I find toad works a tad trying at times. They make a horrible popping sound when you run over them too...

Combine that with the loss of license at 30km /h over and we're fucked... the amount of times I've snuck up to 70ish early at roadworks to pass a truck that's been slow for ages... that's loss of license material that is.

They might have been trying to enforce or prove the confusion caused by the new LTSA round-about rules.
