A wee while back Keystone started a thread about road workers taking photographs of road users, namely herself. In the thread I posted about my physchotic P freak neighbour who was taking photos of me as I came to and from my flat on my bike. I originally asked my landlord if I could advertise the flat I lived (alone) in and find a new tenant as I found it creepy that my 40+ yr old male neighbour was habitually taking photos..... anyway they refused to allow me to do so, saying that I had to "uphold" my tenancy until Sept 2006. Well I had my tenancy hearing today and I WON!! :kick:

Now my tenancy is terminated as of the 31st of Dec and I do not have to pay to find a replacement nor is any of my problem. Im moving all my stuff this Thurs! Im stoked, my landlords pissed hahahahaha. Sometimes the law does work in your favour....:eek5:

Been staying at my boyfriends. have had too wait for the hearing today before I could do anything.... Im going away on Fri so I was really lucky that the moving company I called had just had a cancellation on Thurs morning! Not giving the property management their keys until the 31d though, its the least I owe them lol.
Im just staying at my boyfriends place and storing my stuff here until I find a new flat. He is away till the end of January so its kinda weird staying here, but he's flatties awesome so its made it easier!
Im very tempted to go and visit the new tenant after they move in and tell them, but not to sure if its the right move?

What happened to the restraining order? What a dumbass landlord you had. Landlords need more business sense, sometimes you have to cut your losses and let someone out of a contract cos you're on a hiding to nothing. Guess he learned that the hard way.

Don't overexert yourself on Thursday... I hear it might not be raining and we wouldn't want to give you any more reason to not ride ;)

I was supposed to have the restraining order hearing tomorrow, however the neighbour refuses to answer the door. The deft must be served notice 10 days before the hearing.... anyway dont need to worry now! The property managers tried to tell the adjudicator (judge) that I told them I did not see a camera and so many lies it was actually kind of funny. I thin they call that Karma?!

Dont worry with the money that I dont have to pay anymore rent with im hiring some big, tough young men, most likely form Wainuiomata to do the moving for me so i'll be there with new tyres! :spudflip:

Oh and remove all your number plates so the slimeball can't record your rego plates on camera...

I was rather shocked at her display.. the adjudicator tried to get me to split the costs.. after trying to be civil and said yeah.. the landlord refused and wanted me to pay more.. so I said no way.. I refuse to be anymore reasonable and that I'll just abide by the abjudicator's ruling..... in my favour.. yay =)

Yeah, I was actually amazed at the lies the property manager told. The first one being that she told the judge that I told her that I had not seen my neighbour with a camera, like WTF?!! Secondly she said that I had yelled and screamed abuse at them. For most of the phone conversations we had I was at work, where the office is "open plan" like hell I was going to be letting all my colleagues know what was going on... The other converstion was had while I was with my boyfriend, I never yelled. Hung up the phone on them yes, but that was because I WAS going to yell.
But the adjudicator was awesome, she basically told the property manager to get stuffed. To be honest I was amazed that it all went my way, guess I was lucky or something.

From my experience in court the side who usually presents the most credible and professional display is the one who wins. Except when it's the cops you're up against, cos it seems they never lie in court.

In a family matter our side were the ones who presented as the educated civilised and professional bunch. The other side shot themselves in the foot by being nasty and vindictive, always trying to paint me as an arsehole, instead of concentrating on the issue at hand. We didn't even bother refuting their statements, we just stated the facts and left it at that. It worked.

hehe, dont worry mate the PS2's all packed away and ready to go!

MDU- not too sure if it was because I work for the MOJ and the guy has physcholigical issues with Govt depts and that is why he was doing it, or wether the guy is just a complete freak! It may not be worth stirring things up, if you know what I mean!

Congratulations on winning and hope you find another place soon. We have problems with our neighbour too - He doesn't like noise of any sort (Motorbikes, drums, music, talking etc etc) so we make as much noise as possible.

Please simply mention the circumstances of your leaving to the new tennant of the flat if it is another female. At least your concience will be clear then.

Just goes to show if people work together a solution can be found, now that landlord finds himself having to fit the bill for no rent and advertising hahaha. Stink that your neighbour was a freak!!
