After my accident last year, my leg was still in cast and so i was unable to ride a bike, i decided that i would go and get an automatic car to get me from A-B. I didn't have much cash to waste on a car since i would be on ACC and off work for 5 months so i went to a shit hole called Discount Car King in Silverdale. I saw a car and took it out, as expected it was a shit heap but i decided to get it checked over and see how much of a shit heap it was before purchasing it. The guy asked for a deposit which was fully refundable if the pre purchase check came back describing the car as a lemon. surprise surfuckingprise the car was a bag full of lemons for the dogeyiest part of lemonfuckinville, so i said sweet no worriesm, gimmie back my 6hundy and i'll be seeing ya..... "er no, we fixed the car and now its fine, you either pay the rest or you lose the cash" so WTF? they do some doge as repairs and expect me to take a car which even after the repairs probably should be squashed and turned into office staples. I decide not to part with anymore cash and go through the process of getting my "fully refundable" deposit back. The guy decides that i should pay $200 for his repairs and he will give me $400 back, not too happy but $400 is better then -$600 so i say ok just gimmie my money back you spinless, worthless unic mother fucker.
long story to medium length, every time he says for me to drive back to Silverdale from auckland, he is either not there when i get there or miraculously waiting for some one to pay him that day.......
i must have gone back there 6 or 7 times and got the same bullshit.
I requested he pay or i go to baycorp, he doesn't pay so i offered him another chance before actually going to baycorp, still no cash, bastard. So i go to baycorp, they do sweet fuck all, "oh we called and he hung up" baycorp have had my account working on this guy since September and i have never once had a call to update me on the progress, i have to call them everytime to ask what the fuck is going on. they are fast enough to call you if you owe them money..... so they make a few filed visits, he aggrees to pay some money and guess what.... never does. So they say what they can do legally which is probably nothing. i call baycorp today, they tell me yes, he has aggreed to pay, yippie kai yay....... he has gone out of business and i am not the only one he owes money to so guess what, he is on the doll and can pay $20 a week............... its gonna take him 30 weeks to pay me back at that rate and $20 a week i won't even notice.

i thought about taking him to court but he probably won't even turn up.
i actually know some car dealers and they are pretty honest people (of course i haven;t bought a car off them) but its scum like this fuck tard who just make me lose trust in people. I wish i had a gun :2guns:

Yeah justice in the land of ours rock don't it? $20/week is the best you'll get and to do anything mroe will cost you money. Sorry chaop - that's the way it is.

Make sure he pays you EVERY week, and the first hint of him missing the payment should mean you go back to the courts and raise it. I don;t know what happens from there, but someone from debt collections must be in here to advise.

Also - find out what reasonable steps can be taken to ensure he doesn't do it again... bad Baycorp ratings etc.

Not good mate - not good.

i paid the desposit cos the pre purhcase check was the next day and he had interest in this car as it was the only half decent one on the lot and it was supposed to be refundable.

Cheers MDU, i have been to LMVD and all those people, and there all as usefull as a chocolate tea pot. not much i can do now, the guy is out of business, its pretty much just an expensive leason for me to learn and also another point that cars suck.
not looking for sympathy, just had to vent some anger....

Did you sign anything with the Dealer's signature that said the deposit was refundable and keep a copy of it?? Or is it your word versus his??

yeah it was signed as refundable, but yeah he has now shown that he has no funds, he's on the doll, which effectivly means that a small percentage of my taxes are going to him now.

oh yeah also, this has been going on since April 05 that i have been chasing my dollars

Postie I am sorry to hear about your situation. By the sounds of it I don't think that there is much more that you can do other than cut your losses. You could send a few people round to his house but the reality is that two wrongs don't make a right.

Only think thats sad is that I reckon in no time this guy will be back in business doing the same kind of shit to people. I'm sure you are not the first and I am sure that you won't be the last.

I don't know but for someone to sell cars as a dealer don't they need a licence? Is it possible that you could "inform" the right people so that it is known that this is the sorts of things that the guy does. Sounds as though he has definately breached the fair trading act and I'm wondering if that could some how have some affect on his licence. (If they need one and I'm pretty sure they do, someone please correct me if I'm wrong)

Would hate to see him get back into business one day.

Thankyou for this post too by the way. Its definately made me think again when it comes to putting deposits on cars/bikes or anything for that matter.

You could always write to Fair Go. Your chance of getting "justice" is probably remote and expensive. However, with a bit of imagination and a cunning plan, you should be able to stop this guy ripping off others. Revenge is a dish best served cold.

Yep Fair Go is great!

Even ring them up at TVNZ to begin with - I have spoken with them before to check out a situation.

I learned (through experience also) my number 1 rule of purchasing vehicles - no money of any amount changes hands until after independant inspection. Vehicle dealers have way too many tricks to play once they have your money. :2guns:

The deposit was/is fully refundable, the dealer had no right to proceed with repairs at the customers expense without his instruction. To do so the dealer choose to carry the repairs out at his own expense. The contract was conditional on the basis of the 'lemon' report, which the client rejected making the contract reversable. Not on repairs being carried out to the customers satisfaction. Unfortunately with him winding up the business there is very little you can do now.

yeah thats what i understood was the situation. Like i was saying before, this has been going on since last April and he went out of business last month. i guess i should have been more forcefull in the begining rather then trusting his word to give me the money back.

I had a sort of similar situation last September.... I saw a car I liked. test drove it and put a $500 fully refundable holding deposit down on it (made that very clear to the sales manager before I handed it over). I wanted to test drive another one before I made the decision so thats why I didn't purchase it straight away.

I ended up buying the other car and called the sales manager back and told him I did and that I would be in to pick up my $500 after work...... about and hour later the sales manager text me saying that his boss is not at all happy with fully refunding my deposit and that they missed out on selling the vehicle as I had a hold on it. He said he would only give me $200 back.

I rang him back and said "Mate I made my situation fully clear to you and you agreed to the terms I made when I gave you the cash. I know the law on this and I know I am entitled to all of my deposit back. I don't care that you missed out on selling the vehicle, how stupid are your sales guys if they didn't get that potential buyers number and let them know that I don't want it anymore?. I finally ended up up saying "Have my $500 ready by 5pm in $20notes and I will be in to pick it up".

I turned up at 5pm and the money was waiting with the receptionist....sales manager had conveniently gone home early for the day....spineless wanker. I can't believe the dickhead sent me a text instead of calling me...some people just have no fucken balls!.

I garuntee you that even if he is on the dole, he is still dealing. These cowboys have more than one company set-up so that when they go bust (somehow they know they're going to go under..) they have had most serious assets transferred so that the tax-man (who gets first cut) gets as little as possible. Then everyone else gets the shit that's let if any. It'd pay to watch his place for a bit a check out what he is doing (and he is doing some shiesty deal). Really the only way to get your mioney back is to pay someone to get it for you and that'l cost you as much as what you're owed. The other problem with that is the flip side of dealing with the people who'd do that 'job' for you is that they'd likely end up taxing you even more in the long term than you're owed.
Vent away Postie - then let it go and move on. If it was a couple of k I'd say do him, but in this case cut your losses.....

Hire the Head Hunters...sounds dodgy, but I had a mate do just that over a similar sized debt and he got his money back quick smart. No threats or anything eiother, just politely asked that "monies were owed to a client."

They take 50% of the debt as payment for services rendered, but the look on his face when some patched up bikers turn up politely asking for the money that he owes you, would be absolutely priceless...ask if you can be there when they do so with a camera!!!:2thumbsup

cheers guys, Colapop, your probably right about it not being enough money to hire someone to pick up the cash for me, but it would be fun. its not so much about the amount, rather then why does he think he has the right to keep my hard earned.
Not to mention that i went into the place still on crutches, so he obviously couldn't even pass by ripping off someone in that situation, he's scum.

head hunters are another good idea but i don't know if thats an avenue i would want to go just yet. but fuck yeah it would be sweet to see the fucker crap his daks right there on his lawn.

that might have to be an option, my piece of shit car blew the engine in Taupo at the track day and now its almost repaired...... (no body was rushing obviously) and its gonna cost well over a grand to get it back. that 6 hundy would come in handy about now.
oh well screw it, i'm off home for cold Carlsburg and then fit my new chain on my bike and burn the rest of the rubber off my back tyre.......
