I am spewing :puke: bloody wanker bike shops. I was booked in to go for my full licence March 6th 12:45pm ($115.00 later:slap:), all set to borrow a bike from the local bike shop, dude at the shop said "give us a couple of days notice before your test so i can make sure the bike is ready", sweet, or so i thought. I rang a week before, then last Friday, and again Monday morning and confirmed i would be picking up the bike at 12:30. Well i get there at 12:35, giving myself 10mins to atach the L plate and get to know the bike, i stroll into the shop, dude says " Hey, hows it going, the bikes just down at the VTNZ getting a warrent, it'll be about half an hour" i said "thats great, my tests in five minutes" to which he replied " oh.....umm.... i thought it was 1:30pm" i said "FUCK!!!!" and asked to borrow the phone. To cut a long story short, i couldn't go for my licence as i didnt get the bike, and the testing officer wouldn't wait half an hour, i explained that i had been riding for 17 years and the licence was a formality, and that i had a ZX9R that was legal and if i could use that. Well she went and made a phone call and came back with a big fat NO. So i would just like to say hi :finger: to the motorcycle shop (you know who you are) and Fuck you very much!:bash:

Small claims court, you can recoup your costs from the shop :) (if you think you can prove it, and have a case)
/edit: Actually, proof isn't the big thing, essentially you only have to convince the adjudicator that you're telling the truth... asumming they dispute the whole 'I'll pick it up at 12:30' thing.

Im not disagreeing with you, but would he have to had paid the shop money for borrowing the bike before proceeding with small claims?... Its just that he didnt mention that he was or had paid the shop any $$? Cause if it was just a "lender" free of charge they may not be liable to pay for the costs of the licence....?

Yeah, i'd assumed that too, however all he said was that he'd got a lender, in which case if he wasnt paying the shop for getting the warrant etc then its really all his own fault....

Ten minutes would be heaps though... I'm certain that most riders here could take their test on any 250 with minimal seat time to aquaint themselves and pass no problems at all. Regardless, that he booking it, and then reconfirmed it, and still it wasn't ready isn't his fault. imho of course.

Time is NOT the issue here.
The bike was due to be at the shop, arrangements were made (and paid for) on that basis... not good.
See if they can make it up somehow. Get you some kit as cost... so you save as much as you lost... and get some good gear out of it - it's a win win...
Don't get aggro if you can avoid it.

Yeah, i'd assumed that too, however all he said was that he'd got a lender, in which case if he wasnt paying the shop for getting the warrant etc then its really all his own fault....Ahh, I've had a few friends need 250s to do licenses on, they've all have to more or less 'rent' a bike. Makes a difference if it was 'lent' though.

i disagree. time is the whole issue. i just don't think that 15 minutes is enough to sort out any little problems that may have eventuated. what if it did have a wof, but one of the bulbs was blown? 5 minutes dicking around would ensue.
no i don't own a bike shop, i just don't agree with the slagging off of the bike shop after they appear to have been doing what seems to have been a favour. if he had have rung them 30 minutes earlier just to triple check, if the occasion was so important, then this conversaion would be 'woohoo! got my restricted!!'

Just say that you didnt appreciate the poor organisation. Say that you would appreciate some sort of compensation, "you dont want a poor reputation from this". You know a LOT of bikers now.

The only thing is that i am a good customer, i buy all my parts through them and have gone on rides with them... i was just venting some anger, and very disapointed.

I see what you're saying marty, but I don't think it's unreasonable for him to hire a bike for the expressed purpose of his license test, to expect a warranted, and warrantable, bike to be waiting for him at the specified time. He had double checked, and was paying for the service.
I don't think it would be unreasonable for them to cough up the license test fee, less the hire of the bike, which they could supply free next time. Don't know how big the town is though, sometimes not worth burning your bridges.

The reason they don't reschedule is that it too lucrative not to. The testers, the company and the LTNZ get two fees for a missed test.

Too true! My mate was busted for wrong class of licence on his Hardley but was given 2 weeks grace. He booked in to sit his riding test....had the bike all ready but was 3 minutes late. The tester said he was too late and told him he'd have to book another time and pay again. The next time he could book in was after the date the cop had allowed him to get his licence so he had to pay the fine as well as two tests. :spudgrr:

We worked on 5 to 10 minutes grace depending on the test. But if someone missed their full test, we could book a restricted and get two fees for the one appointment slot. Restricted's took a lot less time.
I don't think that this can still be done now, but it was quite a good little earner for all concerned.

I nearly had the same thing happen (my own fault though). Was going to CBTA course in wellington. Borrowed my mates bandit 250 and rode it to wellington. It had a warrent sticker when I left palmerston north but not when I arrived. Andrew from roadsafe was good about it - but still only gave me ten minutes to get another one. I must have just about broken every road rule getting down to a testing station (fortunately they just printed off another cos it hadn't expired) and back just in time for the practical phase.

He is quite entitled to try for compensation if he is out of pocket due to someone elses inability to organise their business efficiently. Litigation is a fairly drasitic route, but one he's entitled to take. Your implication that the guy in the bike shop was busy isn't a fair comment, he could've stated that when the enquiries were first made, and our man would've been able to make other arrangements. Of couse he couldn't have known if he was to be busy on that particular day, but surely with his years of experience a little preplanning wouldn't be beyond him?

The bike shop dude admitted he made a mistake, thought the required time was 1:30 not 12:30. Nothing to do with being too busy.
Bike shop stuffed up and SHOULD make it right. BUT, in strict law there is a thing called "time being of the essence". And unless that is SPECIFICALLY spelled out, and the contracting party (bike shop) agrees to accept liability for consequential damage, the hirer may be shit out of luck.
In effect the bike shop can say "Well, you can still hire the bike, time just starts and finishes an hour later. Too bad that you needed it earlier, our deal was for X hours hire, you can still have that". To overcome that you have to have specific agreement by the parties.
Not very good planning by the shop though. What if the bike had failed its WoF ?
IMHO the shop has a moral, but not perhaps legal obligation to reimburse the hirer.
EDIT: IANAL, and my memory of contract law is dim, and I can't find my contract law textbook. But we have a couple at least of legal beagles here who may comment (from memory Mr Henry DorsetCase and Mr Phurball at least)

personally, i would have been in the shop the day before, making sure that it was ready - NOT just phoning them. oit's not like matamata is a big place that takes an hour to get across. if it neded a wof for MY purposes, then I would have taken it down - not have other people run round after me - there is little value or reward for someone when they are doing something as a favour for someone they are not family or good mates with, so expediting something (in this case the WOF) had nothing to do with the bike shop being busy, and everything to do with excerting the minimum required energy for the desired outcome. often, the busier the shop, the better organised it is, and the more work that gets done.
bottom line, IMHO, is that slapnuts fucked around and procrastinated for 17 years on his learners, probably got a ticket for breaching it, so is on a timeline to upgrade, but, after relying on people to run around and do things for him for 'favours' has been found wanting, and now wants to divert the blame.

Marty, your bottom line has an unusual conclusion. You still seem to think it was some favour being done. It was business, in this case, a rental. You keep mumbling about 17 years to book a test, but where's the relevance? The bike shop should only rent bikes in a timely matter to people who've had their learners for less than 2 years? 3 years? I don't understand why you think it makes a difference?
I've no idea what the legal standing would be, but the strict rule of law doesn't necessarily hold in the Disputes Tribunal (ne Small Claims). The adjudicator will make a ruling that they see as fair based upon the evidence. That may be a full or partial compensation, or no compensation at all. Before you can take that road though, they do require you to at least try and resolve the issue outside of the judiciary system.

Naw, just his terminology is different. I do see your point though, if he was merely borrowing it free of charge, then it isn't a business transaction, it's a favour. If that were the case, then they're bastards, but certainly not liable (imho).

Well fuck me. If this was they way of the world, I'd have a full time team of lawyers working for me. With very little exception, the quality of service in NZ is useless at the best of times. There are very few efficient businesses in NZ and it pays to have very low expectations.
The exception to my poor service comment is Mr Discount for KB'ers Girardin.

Hire bikes need a CoF,but a loaner doesn't...loop holes.I'm with Marty on this one...the shop cocked up and got the time wrong,but if it was me going for my licence on a loaner I'd be kinda excited and be there early,get a bit of time in on the bike.The original posters laid back ''the world's doing it all for me'' attitude back fired on him this time.He needs to be proactive in his quest for a licence,''she'll be right'' is for losers.

I heard about this today but this guy forgets to mention that he goes to this bike shop pretty much without even knowing them and asks to borrow a bike for his license and the bike shop tryin to do the right thing offers him the use of a bike (which was a lender..no charge involved) just tryin to help a local guy out.He turns up at the last minute without a thought that they have probaly been busy enough without running around putting wofs on bikes just for his benefit & at there exspense....Man try & do some guys a favour and get kicked in the teeth for it. Yep you have got it in one, I hope the dealer tracks this slagging lowlife down at his place of work and openly questions the quality of his work, LOUDLY. Unless informed about it, the dealer has no ( invited ) opportunity to present his side of the story. AND THE OTHER JERKOFFS THAT JUMPED IN TO UNQUESTIONALLY SUPPORT THIS LIBELOUS LITTLE PRICK HELD THEIR OWN IMPROMPTU KANGAROO COURT. THESE GUYS SHOULD BE THOROUGHLY ASHAMED OF THEMSELVES.

personally, i would have been in the shop the day before, making sure that it was ready - NOT just phoning them. oit's not like matamata is a big place that takes an hour to get across. if it neded a wof for MY purposes, then I would have taken it down - not have other people run round after me - there is little value or reward for someone when they are doing something as a favour for someone they are not family or good mates with, so expediting something (in this case the WOF) had nothing to do with the bike shop being busy, and everything to do with excerting the minimum required energy for the desired outcome. often, the busier the shop, the better organised it is, and the more work that gets done.
bottom line, IMHO, is that slapnuts fucked around and procrastinated for 17 years on his learners, probably got a ticket for breaching it, so is on a timeline to upgrade, but, after relying on people to run around and do things for him for 'favours' has been found wanting, and now wants to divert the blame.
SHJOULD HAVE JUST GONE TO THE BIKESHOP THE NIGHT BEFORE AND STOLENS IT BROOOOOOOOOOOOOOOO AHAH JOKES
