I will start with the beginning we moved hear about 8 months ago BIG MISTAKE we have had a couple of partys at christmas time partys where finished around 10.30 11.00 but my f--king neighbours rang noise control with no action from them because nothing wrong with noise levels.We also beleive these are the people resonsiable for cutting cables on the busa. Well tuesday come home from work and dog ranger has left me a note say they have had complaints about yours can you ring me. look out front and someone has throwen fijoes over the fence at dogs and bee bee pallets on path what would that say.Any way went to work yesterday and left radio on for dogs this seems to make them think some one is home f--k me they rang noise control i got a phone to go home and turn radio down might i add the stereo was not that loud and when i ask at what level the noise was at which was at legal advice that i ask this question was told it was at his opion that it was to loud so i moved spreakers to door and went outside and painted the fence and left itgoing for a while so they came and took stereo i ask again for them to do a the national standard noise test again they said they don't have to SUCKS.So what i would like to know if anyone out there knows how i would go about having this test done privately and who i would ring because these bastards are just victimizing us and i have a guts full :argh: :brick: :2guns: :bash:

it's pretty subjective really. there may be a local body guideline - your council should have that.

Excessive noise
326. Meaning of ``excessive noise''—
(1)In this Act, the term ``excessive noise'' means any noise that is under human control and of such a nature as to unreasonably interfere with the peace, comfort, and convenience of any person (other than a person in or at the place from which the noise is being emitted), but does not include any noise emitted by any—
(a)Aircraft being operated during, or immediately before or after, flight; or
(b)Vehicle being driven on a road (within the meaning of section 2(1) of the [Land Transport Act 1998]); or
[(c)Train, other than when being tested (when stationary), maintained, loaded, or unloaded.]
[(2)Without limiting subsection (1), ``excessive noise''—
(a)includes noise that exceeds a standard for noise prescribed by [[a national environmental standard]]; and
(b)may include noise emitted by
(i)a musical instrument; or
(ii)an electrical appliance; or
(iii)a machine, however powered; or
(iv)a person or group of persons; or
(v)an explosion or vibration.]

You received a noise complaint and then pointed the speakers out the door?
That would be asking for trouble.
Wouldn't it have been better to have noise control come out and give you an opinion on the noise level?
In general, I get bloody sick of thumping stereos or band practice at our neighbours. It only lasts for an hour in early evening so I haven't complained, but it makes me feel like giving the bike an extended warm-up in the morning.

When we had this type of shit on site it was quite expensive. However because we faced damages for failing to complete on time we were able to threaten the council with recovery of the damages if we were prevented from completing on time. That ususally worked a treat, they would then start to apply the law instead of their ear.
North Shore City Council (at the time) had set out a test method. It required that they monitor the noise level at the boundary and that it should not exceed certain levels at certain times.
We obtained a sound power meter from Tech Rentals and kept this on site. Their whole argument fell over when they found that they could not take measurements until 2:00 am as abmient background noise did not drop below their standard until then.
As I say however it usually involved threat of damage and a letter from a lawyer.

Wait 'til they go away for a w/e.....go and turn off their mains switch. Find the drain head adjacent to their toilet, lift the grate & stuff a whole newspaper waaay down the pipe, replace grate.
Does the db level vary depending on where you live? Here it is 95db and noise control are not interested until 1hr at that level has passed. And I can set my lawnmower going on the fenceline at full noise and just keep topping up the fuel tank - that is not a problem. Go figure!

Hi thanks for that but my lawyer gave me that yesterday she also gave me this.
2 a includes noise that exceeds a standard of noise prescribed by a national enviromental standard that is why i ask for that test to be done because i don't beleive my radio was above that standard.

auckland council has already prescribed that with the level nominated at western springs (85db??)
a noise meter shouldn't be too hard to come by.

section 43 1(b) RMA outlines the ability to prescribe standards, but i can't find the standard - it should be held by the council that took your stereo, as they will/should be working to that standard.

Thanks CaN. For those that are wondering we are not in a appartment we have a stand alone home.I have also ask council to help re noise level to give me a indacation of level but the problem is that one officer can come out and say that is fine and then the next will say no its not and whamo take your stereo so nreally they have been no help what so ever i have also found out that the guy next door works for northshore city council I also asked them to orginize a meeting with these people so that it could be sorted out and they said no not there job.OK TO UPDATE noise control officer has rang century21 head office told them what is going on and told them that they should try to sort it out as it's not a very good image for them i have now been sent home to think about it.

Erm... Did they take a reading of the noise level before they took your stereo?
Surely if they can't prove that the stereo was over the subscribed council db limit then they have no 'right' to take the stereo.. thus its theft. Ring the police.. haha =)
I think your've been wronged by the council... and its pretty obvious that your neighbor is using there 'connections', have you talked with them to discuss the matter.. i.e. gone to them in person to discuss the matter?

pardon? what right did the council have to call cent21? how is it 1. C21's problem, 2. any of the council's business.
i'd be contacting the council GM and having a discussion IN PERSON, outlining my concern at the insinuation that the neighbour, through their council contacts is getting preferential treatment, and that someone has gone WAY outside their jurisdiction in calling century 21 and narking on you.

We had a similar problem last year when our tenants had dogs and the neighbours were up in arms about what to do, called in dog control etc.
We happily resolved it by working with the authorities... invite them over, talk to them. Let them know of the background issues etc. They'll probably want to talk to other neighbours (make sure it's a vendetta vs you actually being too noisy) and take it from there.
Another 5c poorer... and good luck!

I now have lawyer onto it she is pissed she said what gave him the wright to ring your employer she is going to ring ceo asking for bloody good reason for this and if there is no good reason legal proceding will begin.:tugger: this is for kevin cox:drinkup: and this is for me.Thanks for all the advice iv'e been getting but have spoken to lawyer regarding noise control there is nothing i can do it is a case of there word is law she told me to ring fair go and i think i will.

and a sound power meter is usually a RTA [real time analiyser]....you could probally borrow one of those from most decent car audio shops...or your local high school science department...

Yeah there are a few around. Dick Smith sell them, but as we had to demonstrate compliance with a NZS we needed something that had been calibrated, hence hiring from Tech Rentals.

I don't believe there would be any point in measuring the noise level as ultimately the decision of "excessive noise" is given to the Noise Control Officer. By the sounds of things you aren't going to find much sympathy from the Council as they appear to have a bias.
Standard Noise Control Complaints Process
When a complaint is received before 12am the caller must wait 30 minutes then call back again. This is to confirm that the noise is of an on going nature and warrants attention by a Noise Control Officer.
However, for properties that the council deems 'repeat offenders' they are added to a 'Hot List' which contains your name or address or both. If you are on this list, it means that when a complaint is received the 30 minute call back is no longer required and an NCO is dispatched immediately.
How to safely fuck off your neighbours
Weather you are on the hotlist or not, isn't really going to matter, the company which does noise control is located in Silverdale. Their resources are usually extremely stretched and the staff are real goons, most of the patrol men are on power trips with aspirations of joining the police force.
In other words, when a complaint is received, it will take them a solid 20 - 30 minutes to reach Gulf Harbour.
Position someone at the Round about just before Gulf Harbour. When the well marked security car arrives at that point, get them to singal you, who will have the stereo blasting away. At which point, you can reduce the noise, so that on their arrival, they can't do anything.
You should be able to do this serveral times before someone gets pissed off.
Another way to piss them off
From 7AM until 7PM you can use machinery, such as saws, hammers, nail guns, etc. without too much trouble. So, for example, if you wanted to build a stupid contraption with no real purpose, making as much noise as possible, then you could do so without problem.
If the NCO does issue an abatement noise, then he would be out of a job.
Even better, if you have a scanner, I can give you the frequencies that the NCO's use as well as the Council Dog control and Environmental Health departments.

I'm shocked that the Council contacted your work - that is a clear breach of the Privacy Act. You should complain to the Privacy Commissioner and you might even get a small payment from the Council as compensation.
However you'll have to satisfy the Commissioner that a Council officer contacted your employer which means you need to know who rang. It might have been anonymous just a voice saying they were from the Council.
Noise complaints are very difficult and often subjective problems. I recall a problem where an exterior heatpump motor drove the neighbour up the wall. Not particularly loud but incessant and at an annoying pitch.
In the end the homeowner removed the heatpump rather than have a war with the neighbour.

They obviously don’t like bikes, to keep them happy sell the Bus and get a nice, safe RX7 and a good wholesome hobby... like model aircraft.
That way they won’t have to listen to your bike but instead be pacified by the soothing sound of RARARARARAWWAAAAAAAAAAAAAAAAAAAAAA! or WWWWEEENNNNNNNNNNNNNNNNNNNNNNNNNNNNNN! Depending on the day’s vindictiveness level.
Failing that, get some ear plugs a really BIG amp and a bunch of Ramstine CD's.
