View Full Version : Is it possible to get out of a speeding ticket with these errors:

got a speeding ticket saturday night...

but what they have /havn't done ...is they did not put my rego number in but my drivers license number my name and home address are on there and for make of vehicle all it says is kawasaki ....but no rego number has been put in!

and then there is the 2nd issue....in the box that says speed limit...they have written 84 kph

in the box for alledged speed they have written 50 kph....then limit exceeded by 34 kph

taking note this was infact in a 50 zone... the numbers are round the wrong way.... can i just write in a friendly letter to police infringement bereau? or do i have to take this to court.... and do i have a hope of getting let off this $300 fine and 40 demerits gulp i nearly fell over and died when i saw the fine

Normally I'd just laugh and read the next thread... but you might stand a chance... maybe just let it go to court and let the judge sort it out :lol:

I have seen fines for people with no rego entered in our court records. You were pulled over so you know it was you and they know that you know, they will laugh at you. BUt good luck if you try and dispute it...

LOL!! Must have been a bit tired! I'd write a rather laconic, pleading letter and hope for the best! You have to admit that 84k in 50k area is too fast, though and you deserved a ticket.:yes:

I agree with you Str8, if it was just the rego thing then bad luck, you are gonna have to pay the Helen man. :nono:
But as they have fucked up the speeds (doin 50 in an 84 zone) i think you may have a better than average chance of getting away with it, as they have written down that you have not really broken any law, unless they say you were going too slow. :yes:

noting i had to take a corner extremely late because of loose grevel....so had to power hard out of it...thus i was going like hell if i hadn't accelrated out i woulda been sliding down the road on my ass..

I survived with only 5 demerits left on my licence, so i dont know why you cant with 75 left... and it takes two years to clear... And it doesnt make much difference with bike insurance, i havnt been asked about it before...

I think that strictly speaking the mixup (putting the speeds in the wrong boxes) is no defence - infringment notices are not invalid for want of form. But, the police don't usually like to be seen making such silly mistakes. It's embarrassing. So there is perhaps a chance that if you write a nice polite letter pointing out the error, proffering some explanation , and promising to be a good lad in future, you just might pull it off. They don't have to though, so you need to polish up your grovel.

deal with it, truth is you were dumb enough to do 80+ in a 50k zone... the judege wont look at it any other way, except for that maybe the officer was new/tired... still doest change the fact that in essence you were 34kmh over the limit.

Pay the fine and get over it. Maybe when you lost your previous points you should have thought about it instead of being a dumb ass.

Hahaha... mark ya homo... I notice they've torn up the road down the bottom of the hill eh, fuckers didn't put any notice up either, so I nearly lost it last night on the way home from work.

Was it a mufty car or what? Apparently there's this guy with a green ZXR gets into triple figures coming up that road most times, bad luck you got caught.

Now pukker up and pay the fine.

Sigh! Young ones these days! As I said to my son recently when he got a $400 fine for no reg/wof after I'd ben telling him for weeks to get it sorted, "Can I say I told you so?" HE said, "No!" LOL!!! We'd just paid for his ticket to Aus and he was supposed to be paying us back for it! Think t's going to be a bit of a wait as he had to register and warrant his car then pay the fine... He's usually good on such things, but as he lives about 50m from his work, he hadn't bothered getting it done!:violin:

I do have a friend who got off a ticket because one letter of his rego on his ticket was wrong and the judge though the :Police: was a slack ass idiot.

But of course it will depend on what kind of judge you get....

Good luck and tell us how you get on. I could go on about how slack it is for them to be careless with ticket etc but since I know this place is filled with bacon loving bastards I'll keep it to myself.

Perzacktly! HE wuz walkin to work and so hadn't bothered to get it legal! Got pulled up at a checkpoint on his way around to our place. Now we just paid for his passport, too! Where would kids be without their parents these days! Okay, he's 30, but sumtimes ya gotta help out, eh? He'll pay us back, eventually...

The forms are there for a reason, and they're pretty bloody easy for any literate person to fill out. If the ticketing officer was so stupid he couldn't read the text in the boxes that said "speed limit", "alleged speed" and "registration", how can you be sure the myopic twit was reading the display on his speed radar properly?

Working for the MOJ I just have to shut up and pay up. Or lose my job, wish I had a "choice". I just dont get some people though if you were pulled over then you know you got a fine why not just pay it? I mean I know it pisses you off that you got caught but it annoys me when people get of tickets based on "technicalities" when I dont get a choice (for a pull over offence).

Yeah I reckon you've got a good chance of getting it dropped if you write the PIB a nice polite letter pointing out the errors. If they can't even get the particular's on the ticket right, then perhaps they'll decide the ticket's invalid. Fair's fair. It's not like you've got anything to lose if they tell you to stick it. Just don't let it get to court then start fighting it there cos you'll get shafted.

Heard on the radio the other day that some bloke got pulled over for speeding and his plate read.....NOPL8T.....which was written correctly in the approriate spot on the ticket, needless to say he did not receive a fine cos, how can a fine be sent out when a computer fails to think like a human..... brilliant................:blip: :yes: :first: :nya: :innocent:

Mark, thats not what you told us in the Chat Room.

Just accept it, you were doing a rediculous speed in a RESIDENTIAL NEIGHBOURHOOD with a clearly marked and well known MAXIMUM speed limit of 50 kmp/h. 60 - 65kmp/h is understandable but over 80 kmp/h ...

Just pay the ticket and learn your lesson.

I just think the officer might be in an alternate state of mind that shift and was incapable of operating equipment (radar / laser) and was demonstrated by their incapability to follow instructions on how to fill in a notice properly....

Its all about cause and effect. You did the crime and now you need to pay the consequences (the fine). Its time you just take it as a lession in life, change your lifestyle to improve yourself and move on. At least thats what I did when I was your age and got busted for doing a wheelie through town. I knew I did it, so I paid the fine and then used the back roads...

I have to agree with this. The ticket only has to "fairly inform" you of the offence. An "information" will be created should it get to court and from memory the rego is not an ingrediant of the offence - just the fact that you were using a motor vehicle at the time would be enough (correct me if I'm wrong spudchucka).

If the speed were less then you'd probably stand a pretty good chance, but it's getting pretty high. Do you know what branch the issuing officer was in - that too could have an effect. If it was traffic, they'll probably fight it all the way.

Good luck but at the end of the day, 84 is too quick around town (I'm quessing your speedo was showing close to 90).

The summary of facts would read, "The defendant was the driver of a motor vehicle on such & such street"......

Not:

"The defendant was the driver of a 1998 Pink Pajero, registration number '1WANK', on such & such street"......

So in that respect the rego of the vehicle is not relevant in terms of the ingredients of the offence. If it was raised in court it is highly likely that the cop has recorded those details in his notebook and he will simply read his notes as evidence.

Few things you can mention is the loose gravel and did the officer actually clock you and show it to you? If not you might be able to get away with it. Just dispute the 84k speed aye?

Well it's worth a try atleast, you might end up saving a few smack a roos ate $$ if not then I guess just pay up aye. And demerit point I was hanging on with 5 points left for two years so you should survive. All the best !

If the cop realises he has made those mistakes he can just write out a replacement ticket (filled out correctly) and tell you to throw the old one away.
