Now go to the police station and fill out all the forms and do her for failing to report the accident.

shes saying i must have run the red light at the pedestrian crossing 15-20 metres before she pulled out.... she says it was a red light on her side of it and cars were starting to stop at it going the other way that i was...which is bs because i know i went through a green....
and regardless she did still not give way to her right even if i had run the red light prior myself and others i have talked to say she still did not give way to her right.... yeah like i'm really gunna run a red with schoolkids everywhere over a pedestrian crossing....
i mean honestly thats just stupid i know i ddn't run a red and it's my word against hers.

Sounds like she's telling porkys to me. Though it is just possible I guess that the light might have been green when you went through and turned red by the time she turned in front of you.
However --- that is irrelevant. No matter where you came from she must not turn in front of you. You might have come out of a driveway between her and the light, for instance. If you were riding in a straight line 20 metre from the lights, and she turned in front of you, she is completely in the wrong .
Hang her out to dry.

I don't think one HAS TO report an accident unless somebody got injured. The fact that she stuck her noggin out the window and asked if you were allright will still not absolve her from getting a fine though.
The bitch is, we know how easy it is to get seriously hurt in an incident like this , they don't.
And even worse, the cops are really happy to let the tintop:angry: drivers get away with a $ 150 fine and accept the fucked up excuse of : "honest officer I did not see him"
It really stinks............, sucks............. and blows..........

Any person involved in an accident must:
1) If anyone is injured report the accident the police
2) If any property is damged (included vehicles involved) either:
a) provide details of name address etc to other parties involved or
b) report the accident to the police.
Since there was (at least) damage , she was obliged in alw to give Mark her name , address, rego etc OR report the accident to the police.
But, of course , the old rule applies. You 're a motorcyclist so you're automatically wrong.

i've just talked to her over the phone....she is saying i was at fault and said there were cars stopped going both ways.....and that i ran a red light and am at fault and she is going to get some quotes from panel beaters. and her insurance company will be in contact....and that i was most likely "showing off to the girls"......
she will not listen to anything i have to say insisting i ran the red light i said you failed to give way and there is no doubt in my mind that light was green.
she says you ran the light and i say i did not and you failed to give way.
at this point she is very shitty at me and says insurance company will be in contact.....
and that was that ....
i can't believe she thinks i'm at fault and wants me to pay for her car damage....

You don't need a lawyer, the Disputes Tribunal ajudicator won't care how learned you are. Just present the honest facts and you'll be fine.
/edit: They will take things like 'You hit her car, but she didn't stop and get your details. If she thought you were at fault and would pay for the repairs, why didn't she get your details...' into account.

go take some photos of the accident site ie: a photo of the direction you were coming from, were she was sitting prior to pulling out looking down the road to where you were coming from.
try to include all lights and signs in the photos.
draw a driagram of where the car and bike were at moment of impact. try to include where parked cars were also. you can never be to prepared when this goes to court.
if you need any legal advice just go to your local citizen advice bureau they have leagal aids there that will give you advice for free.
also contact her insurance company before she can.
they have a 24 hour 0800 number so call now.

She be in the wrong, did a u turn with out making sure all was clear, similar to reversing, them reversing are always in the wrong (except when 2 reversing people crash in to each other, then they both pay for theri own)
Report her to police, get a quote to repair, send it to her, 7 days to pay up, if she no pay file at the claims tribunal, simple, no sweat, get on with your day.
Do not ring her, no contact.
"You are allowed to make a U-turn as long as your path is clear in both directions and it is safe to do so. Make sure you have enough room to complete the turn and don't create a hazard for oncoming vehicles. " Road Code 2005 version.

22.Driver's duties where accident occurs—
(1)If an accident arising directly or indirectly from the operation of a vehicle occurs to a person or to a vehicle, the driver or rider of the vehicle must—
(a)Stop and ascertain whether a person has been injured; and
(b)Render all practicable assistance to any injured persons.
(2)The driver or rider of the vehicle must, if required by an enforcement officer or any other person involved in the accident, give the officer or other person—
(a)The driver's or rider's name and address; and
(b)The name and address of the owner of the vehicle; and
(c)If the vehicle concerned is a motor vehicle, the number or letters or other expression on the registration plates assigned to the vehicle.
(3)If the accident involves an injury to or the death of a person, the driver or rider must report the accident in person at the nearest police station or to an enforcement officer as soon as reasonably practicable, and in any case not later than 24 hours after the time of the accident, unless the driver or rider is incapable of doing so by reason of injuries sustained by him or her in the accident.
(4)If the accident involves damage to an unoccupied motor vehicle or to other property belonging to a person other than the driver or rider, the driver or rider must (unless he or she is incapable of doing so by reason of injuries sustained by him or her in the accident), not later than 48 hours after the time of the accident, report to the owner—

Probably not, you attempted to report it and needed more information.
Report it to police, then get a quote and send it to her registered mail or courier, signature required, with a note saying she got 7 days to cough up, no cough up, straight to tribunal.
She will be banking on the fact that you will not do anything about it...... surprise her.
Been there done that.... have always won.
The 50 also take a dim view of incidents around schools.

I had someone ram the rear end of my bike, whilst I was sitting on the bike at set of lights.
I rang the police there and then.
Was told by the operator on 111 to go to police station.
I went and filled in all the forms...
She was summened to court
For FAILING TO REPORT THE ACCIDENT.
Cost her $375 as she admitted guilty.
(This was only a couple of years ago)
This is why my number plate looks like it does... all mangled and bent out of shape and hanging the way it is...
Another senerio:
I did a U-Turn in my car on Ponsonby Rd at 11pm
The taxi did NOT have its lights on..
The taxi went into me.
Police told me didnt matter whether they had lights on or not.
I was at FAULT for doing the U-Turn and FAILING to see the other car coming at me.
My insurance company paid out. Cost to me - My Insurance no claims $300.
It never went to court as cops said sort it out between ourselves.

basically the cop reckons she was at fault was a funny phono convo to hear in the background as she tried to defend herself ....for example...cop says: at what point is it his fault when you u turn infront of him....silence.... he ends up asking her this about 5 times...and at the end says exactly.....he then goes on to say..... (and here goes, the most used motorcycle accident quote ever (this is brilliant)) ....the cop says: did you see him coming..... (she obviously said no from what he says next) ....so he says back.... so if you did not see him how do you know where he was in relation to the traffic lights how could you possibly know if he ran the light if you never saw him so you had no idea where he was on the road......dead silence.... that cop is the man.

Well done Mark. Good lord , is this a first? The bloody system WORKED. Biker one; idiot cager nil. As good a result as a crash can ever be.
I hope that it works out as well for the poor bugger who wrote off his Yamaha FZR summitoruvver in front of my horrified eyes tonight on the Mt Wellington Highway.
He'd ridden alongsideish me (me in left lane him in right, both moving up or falling back a bit as one lane went faster than the other), since the motorway. All very legal and responsible, no speeding , no lane splitting, just going with the traffic.
Came round the bend by Countdown where the two lanes become three, I moved to the (new) left lane, he was somewhere a length or two behind still in the right lane.
As I moved I saw a cage belting through the Countdown carpark toward the exit driveway. The old sixth sense started ringing the alarm bells, and I was on the brakes well before she shot out, without looking at all, heading directly across the road toward the side street on the other side, straight in front of me (and, as it turned out, also straight in front of the FZR.). I had plenty of time to go round behind her. The FZR wasn't so lucky.
Just as I was invoking the curse of Helmut the Horny Humper on her, I heard a swooocreccch-crump. Looked right and there was the poor Fizzer embedding itself in her driver's side door, and the rider falling to the road.
By the time I got Ratty stopped and parked, he had gotten up and staggered to the side of the road, where he was lying on the grass, moaning and clutching his nuts, which must have collected on the tank.
Cager did stop, didn't seem very concerned.
Rang ambo, ambo came ,zambucks put him in ambo, then after a while he staggered out again. Cops turned up eventually, I gave them a statement , they did plod stuff.
Yammy looked a write off. Fairing totaled, screen smashed, tank badly dented, forks bent, wheel bent I think.
Could have been worse I guess, for a few minutes I thought we might have been scraping him up. Stupid cow, just let her try arguing about it.

FZR rider was OK according to the zambucks, just in a lot of pain (delicate bits involved and all that).
I was on Ratty, caused a bit of confusion, I was pulling the mangled FZR off the road onto the footpath on the other side of the road , still had my helmet on etc and the ambo pulled up beside me and tried to start treating me! "No mate, the guy that's hurt is over on the other side of the road!".
Then the plod kept trying assuming that we knew each other ("Hey, you're both riding motorbikes,, you must know each other")
If I'd been in the Pajero I would have introduced her to Mr BullBar .

No, she did stop, a bit of a way down the side street. When I left the plod were interviewing her. But I'd already got her rego.
EDIT Not Folcan, he was on here at 8:35 this evening. Similar looking bike, but I think it looked too big for a 250. Had the YPERVO (or whaddever it is) decals on it.

Let the police deal with it, plus your insurance company.

yes insurance campany i'm sure my bike was a 03 zx6rr before hand.....

accident happened on the 2nd i wentin on long weekend local cop shop was all closed up...went there on tuesday and the said we can't do anything without her rego....come back if you get it...
i got her rego went back reported it and they are sorting it out for me....
and gamgee....this has woken me up i need insurance.....

*Dont stretch the truth to see if you can get a better result
*Dont stoop to her level and ring her at home cause that can put a mark against your name.
*Dont try alter you bike to make the damage look worse
*If she phones, hang up, all can be dealt with in court cause this may well teach her a lesson. Next time it might be someone else who isnt so lucky
*Look for advice when you can and dont be afraid to say you dont know if you are not sure. Better saying that than making something up and forgetting what you said.

If you require insurance advise, im a qualified insurance broker and Grahameeboy is an underwriter.. Sometimes it helps to have someone in the industry who knows how to negociate (yell) at insurers effectively, plus its likely that i already deal with the insurer involved if she has one..

will get back to you on that.....the cops have got to do an investigation into it...which i'm told by the officer whp helped my out at central last night it could take a while....
went and got a quote for the plastic welding required today....they will plastic weld all that needs doing......and prep and primer it for painting for $200 and to get the paint touched up where it has been welded( not the whole fairings just blending into the existing paintwork....)
add another $400 grand total $600+ gst ....then there is the fork straightening.....$112 including gst.....gotta find out price of new left h /bar....and windscreen........ and how much to get the dents knocked out of the tank.....
i hope this lady has a good insurer cus i aint gunna leave my bike to get fixed by some shitty insurance co work panelbeaters who will make my bike look worse when it comes out than when it goes in....so i got the above quote from a decent company and i aint going for any less quality because there were no cracks all over it before and i want it returned to same standard....
we will see what happens i guess

It will take a very long while and you don't have any guarantee of sucess given its going to be your word against hers. The fact she's denying any wrong doing even when spoken to by a cop isn't a good sign.
If she continues to deny it and it goes to court, its going to go before JP's. Unfortunately with no independent witnesses its going to be a rich middle aged woman with an expensive lawyer vs a young guy on a bike with only a overworked and underpaid police prosecutor on his side.
I would suggest you do as much groundwork as you can, photos of your bike, photos of her car, photos of the intersection and any skid marks. Any evidence you can think of, record.

It had a broken left side fairing and a broken mirrior.

Why? The requirement to report within 60 hours just applies a duty to the parties. Even if the time limit is exceeded that does not preclude the police from taking action (providing the statute of limitations period has not expired, but that is years) ; nor does it prevent Mark taking civil action against the other party.

At least he did go and report it... And how are both sides plausible??? He hit the rear right hand side quater panel... Other than hitting the car due to changing lanes without looking (and you would see the car if it was that far infront of you, the other 3/4's of it) the only other way to do that is if she did a u-turn or pulled out of a side street/driveway. This means she was not giving way to her left and is at fault.
What Mark has to learn is to anticipate situations like this when riding on the road. He has done well by reporting it to the police, but now he has to analyse the crash to see how he could have avoided it (be it looking further infront, taking avoidence action or emergency braking)...
