Well according to the Herald (see quote below), bugulars are now getting set sentances of 10 years... and more if firearms are used...

Which I think is great... but how come most rapists get between 3 and 10 years? Thats just wrong...

I don't think they have made it law yet, but they look pretty serious about it

Higher sentences for home invasions backed

A meeting of politicians, the legal profession and justice reform campaigners has unanimously backed a proposal by home invasion victim Peter Bentley for longer prison sentences for the crime.

Mr Bentley, who was attacked in his home in Te Puke farm in 2004, proposed mandatory 10-year minimum sentences for all home invasions and additional time if firearms were used.

The meeting in Hastings last night, organised by the Sensible Sentencing Trust and attended by Corrections Minister Damien O'Connor, gave unanimous support to the idea.

New Zealand's track record for violent crime and reoffending and parole laws were heavily criticised.

Law Commissioner Warren Young said: "Our statistics in child abuse and deaths by comparison to many countries is poor and although crime rates have been going down, serious crime is going up.

"Imprisonment rates per capita are very high and it's a situation that's predicted to get much worse in the next five years unless we find a way to get off the treadmill."

The Law Commission wants a sentencing council to be established to set new guidelines and a reform of the parole system. It wants sentences imposed by the courts to properly reflected those served.

Mr O'Connor said New Zealand's incarceration rate was the second highest in the western world and, while crime rates were at their lowest since 1982, there were still instances where people expected greater punishment and retribution.

"We do have a responsibility to ensure we have a court system that is fair and a corrections system that adequately hands down sentences," he said.

National's law and order spokesman Simon Power said petty criminals were filling up New Zealand's jails while serious offenders were released early.

"When the claim is made that we are being tough on crime I don't think this is what people had in mind. Our prisons may have warm floors but they also have revolving doors," Mr Power said.

Home invasion and burglary are not quite the same thing.
Burglary it would seem is considered a trivial crime.
Let’s face it, the only way the police will be interested in a burglary is if the offender is speeding from the crime scene.

well home invasion = bugulary right?

I thought it meant the same thing... why else would you break into someones house? (other to deliberatley harm them)

But if your right that means my initial statement is wrong (as usual lol)

Or just demanding money, holding for ransom, or in conjunction with another crime like rape, kidnapping etc.

I wonder if I could get noticed would take place if I dumped the unconcious, bloody, would-be theif at a cop station. I would proberbly be charged with fucken assault. God damn PC bullshit!!!!

Either one of them is scum in my book. How the law reflects is it a matter of public attitude, politics of the day and probably funding.

How we should view them is the lowest of the low, pack of arseholes not worthy to see the light of day.

burglary = breaking in and taking shit.

home invasion = breaking in, and holding a gun to someones head while taking shit.

Burg = taking shit (nobody home).
Home invasion = people being home & taking shit + extras.

The sections of the crimes act relating to penalties for home invasion have since been repealed.

Burglary carries a maximum of 10 years imprisonment, aggravated burglary is 14 years.

I think what the herald article was saying is that Mr Bentley is asking for 10 years to become the mandatory minimum sentence that can be imposed.

Thats just wrong...The law is an ass Placid! There are plenty of things "wrong" with it, I agree with you if your facts are right in this case, sentencing should be much harsher.

Nah, we just left our doors open all the time.

There were no burglaries. The maoris never made it that far.

If the guy threatened me or my family, he is fair game. I dont care if he dies if his purpouse was to come into my house and steal and threaten my loved ones lives.

I am a very angry individual, but I think I deal with my problems in a much better fashion than thou oh great Atheist. I dont hide behind PMs and vast voting and I dont run away from a challenge if you are offering. I would rather not ruin this thread with our antics though.

If to wrongs dont make a right then the world as we know it today is a contradiction isnt it?

there is an article in the herald about the two indian chefs that raped a 17 year girl down in christchurch, they'll be getting 19 years in prison.

So they'll be out in five years. Two thirds remitted on aprole, plus allowance for time on remand waiting sentence.

The sentences would be Ok if the crims actually served anything remotely like what the judge hands down.

How come , if you get disqualified for 6 months, you walk for six months. Not two. But if you get sent inside for six years you only serve two.
