View Full Version : Ouch ouch my first accident

So today as I was happily crusing down dominion rd I had a wonderful courier van turn in front of me just in time for me to briefly lock my brakes and slam into the side of him.

Unfortunately my wonderful wee street magic took some frontal damage (hubs, brake disc, forks etc etc).

Just thought I would up a post so others can sympathise with me and to say if you are travelling on the insode of stopped traffic please be aware of silly people who turn on you. I was lucky, the next person might not be....

Also sorry to Tony and Steve (Kiwifruits mate and Qkchk) as these people were selling me a bike and buying off me my sm. We'll see what insurance has to say on Monday.

Bit of a shock hitting a nice big piece of steel at 40km/h....

At least you survived, so well done.

Any liklihood of a charge against the driver?

Bugger mate. Not much fun getting cut off. I'm guessing the guy didn't do a runner like mine did. Hopefully your bikes not too bad

Make sure you report the incident to the Police as this will greatly assist in your claim. I learnt this the hard way coz the police fobbed me off and wouldn't take the details from me when I got knocked off my bike.

Don't let them fob you off - if they do ask for their name in order that you can quote them in your formal complaint.

Driving dangerously is a crime - don't let the fuckers get away with it.

Any bin you walk away from is a good one.

Bikes can be resurrected, people can't.

Nuff of the cliches. Glad to hear your ok. If you got any bruising get some arnica gel on it. MrsLemur gave me some after after my superman impersonation. Worked wonders. Went from walking like John Wayne on a bad day practically as good as new overnight. Just a bit of that healing ache left.

What a way to screw up Friday and the weekend aye? Stinkin cagers.

Bad luck about the accident. It’s good to hear you’re fine(ish?) though. One of my greatest fears is a car pulling out like that and going into the side.

It must have been quite a shock – did you get hurt at all?

Hope your insurance gets everything fixed nice and fast.

Dominion Road bus lane?

A friend of mine got knocked off her pushbike this way on Upper Queen Street and no charges were laid because she was riding up the inside - for a short while it looked like she mightve been blamed for the whole incident :gob:

My bad.
No mention of a bus-lane type incident.

If a bus lane and that happens, give the bastard some panel damage and a mirrorectomy!

Just to add some juice to this thread. I ride my bike as often as I am able so I do quite abit of riding.
Thursday afternoon I was in the Landcruiser stopped in the turn right lane to pull into the Bridge Marina in Tauranga. The traffic coming toward me was was travelling at about 15-20kph. Another 4x4 coming towards me slowed and flashed his lights to indicate he was letting me cross in front of him.

As I started to pull across a scooter came through on his left hand side. I missed him but a combination of looking into a low sun and acknowleging the kindness of the other driver I failed to see the scooter.

The lesson? When undertaking on the bike as many of us do we must be doubly aware and alert. He was oblivious to his impending demise.

It's easy to criticise but it can happen to any of us. A sobering experience.

Thanks for your concern guys, luckily i came away with only scrapes and bruises. I had a good look at the road rules and it states you may pass on the left if the vehicle you are passing:

has stopped or
is signalling right turn or
is turning right.

And hence I should be fine as all the traffic was dead stopped. Unfortunately it happen just before the bus lane as I was moving into it (coming up to the dom rd, mt albert rd intersection). If anyone disagrees with this PLEASE let me know as I would like to know what arguments might come up.

Has definately taught me a good lesson :)

So hopefully insurance dosent screw me, being a student it could be a long time before Im riding again if they do :(

As a note the guy was really good about it, he apologised profusely and took me and my poor bike home in his van.

Thanks again for your concern

No money and any financial setback seems to be be a big bugger - lets hope the insurance comes to the fore and you're back to riding ASAP!

Hate to kill the party mate, but if you were "undertaking" stopped traffic & not in a bus lane
(single lane?) then mr courier shuold have every right to pull over to the left. Sure he should have checked his mirrors, but I would have to say that you were in the wrong.... Just my take on it. Dont get me wrong, we have all done it (undertaken stopped traffic that is) but I wouldnt expect any sympathy from the law. If it went to court its pretty easy for the van driver to lie and say he checked and didnt see you because you were too small/cutting in and out of traffic/going too fast etc etc.

But he was turning right across my path.. surely that means he is responsible for checking if the way is clear?

As a courier driver you would think he would have enough experience to always look regardless of perhaps being in the right. Its the old horror of opening your lefthand side door at lights and collecting push bikers. And they ,the couriers,do move very fast. Glad you are OK and it is important that you remember all the facts clearly. Were you on the bus lane or moving into it? I presume your bike is quite small. Did you have your headlight on? That use to be a factor once in insurance payouts though I think those days are long gone. Main thing is you are OK .

I have been rding for 35 years now and theres only one safe way in traffic at lights.... stay in the middle of the lane with at least 2 metres away from the MV in front of you. Make it 3 metres if its a bus as they can roll back some distance on any slope. I constantly see scooter riders in Wellington proforming the undertaking option and at speed. Every time I sit on the bus, (at my age the bones ache in the cold ), I cringe and just wait for that sickening thud to happen. Sounds like you may have made an error in judgement but you lived and you will learn from this. 'Ride to survive' is posted on this forum many many times and even very experienced riders are remarking on how dangerous the roads are now so be very careful.

Oh... you may want to read some of the threads on lanesplitting.

I didn't simply because I no longer do. Not trying to be all rightous but I value my aging body and don't like to think about having an accident through doing silly things. Its not worth it just to be king of the lane.

Meh, after 40 years riding I don't ride to sit in the queue with the cages. If I wanted to do that I'd commute in a cage. Just watch for gaps in the line of traffic, if there's a gap, you can bet someone will zip through it in front of you

Well the good news is the Police have told me I am 100% in the right and they may want to press charges of dangerous driving cauing injury.

I claim this one for the two wheelers over the cages! I think his insurance company is still denying liability even though he admitted liability and the police have siad he was at fault. Dickhead insurance companies....

It's makes things a little easier to if they admit Liability to. Sounds like you'll have no problem getting your bike fixed, great news.:scooter:

Glad to hear your good and no major injuries. Taxis, buses and couriers don't actually use their mirrors (urban myth). They drive under the assumption that they have an invisible shield to protect them.
I claim this one for the two wheelers over the cages! I think his insurance company is still denying liability even though he admitted liability and the police have siad he was at fault. Dickhead insurance companies....Hopefully, hes not with QBE Insurance. Those barstids lie through their teeth. I got fokked over in Disputes because they lied to the chair. Didnt help that my IC was a no show. I looked like sour grapes, with my tats, number 1 hairjob and biker garb, when I said both QBE and the complainant were blatantly lying about what had happened. Wankers. If the Courier co is with them, make sure you note *everything* down so you'll have it with you if it gets nasty. (bleat over)

Contacting the coppers is a definite "must do" even in a minor crash. Even if the other party says "don't worry about it, no damage", get your A down to the copshop and register the incident.

Once bitten, twice shy....

I am very happy to have walked away from this accident and I know that I will be a LOT more careful in future because I want to spend at least 20% of my life on a motorbike and I have a lot of catching up to do :)
