Can you cancel the insurance for 6 months, shed the beast and get it out again, all squeaky clean when your licence is too? You'll avoid the loss on the bike anyway....

Two years. Two years y' gotta wait. 'Tis a long time.

Interesting point. What would happen if you had some old points. Got a ticket, that took you over the hundred. But, before they claimed your licence (cos you can legally keep riding until they come and demand it), some of the old ones expired, so now you were on les than 100 ? Is that a get out of gaol free card ?

demerits don't get processed untill the fine is payed off

Wrong...demerit points are recorded from the date of the offence, they then last 2 years from that date per offence before expiring. If you exceed 100 points at any one time when holding a license you loose it for three months.

Why the fuck do you think you will get a summons for excess demerit points? All that happens is the filth come to your door one day and take your lisence, for three months from the day they take it.

It could also take a while, especially if you are not home a lot. It took them over 6 months after the date of the offence that put him over 100 to actually turn up and take a mates license.

If you have shitloads of unpaid fines you're going to really enjoy that when they finally catch up with you. You'll find they have probably tripled the amount you owe by now as well...

The_Dover

pervert

fuck, she's still paying off about 90 demerits worth at ten bucks a week!!

If she is actually paying them weekly then they won't have tripled, it is only when you don't pay them at all you find 2 or 3 years later you owe 3x as much.

A mate didn't pay like $5000 worth for years, then when they finally caught up with him when he went back to court he owed over $15000 apparently.

It can seriously take a long time for them to finally take the lisence, so you could just make yourself scarce until a time when you are best suited to a three month holiday from driving (if you choose not to drive DQ).

Just don't get used to 144kph (90mph) that is the tolerated norm on the open road in UK.

Get a grip you dipshit. I was directing that comment at the person who actually started this thread. She said she had to wait for a summons...not you.

You only made the stupid suggestion that demerit points aren't recorded until you pay the fine. If had ever received enough demerits you would have received a letter warning you're nearing 100, on this you can plainly see and read that demerits are recorded on the date of offence. I think it even says this on the back of a ticket/reminder.

Further evidence can be found when people loose their lisences on demerit points, when they haven't paid a single fine in their lives.

Get your shit sorted man, maybe it has changed in the last 2 years, because their used to be loopholes regarding this...but that's how it works now.

Good lord. Joints and shags all round, people. Peace and love have left the building.

I'm in the same boat at the moment. Ginga tosser (notice the pattern? my one had a goatee, by the way) nicked me on 16 in the cage on a passing lane, and the points put me over 100.

The ticket plainly states on the back that points are recorded when the fine is paid. My oldest points drop off in another couple of weeks, which is when I'll be paying the fine (along with the penalty it's now got due to sitting unpaid - I'm cool with that). No loss of licence.

If you want to contradict me, go for it, but do me a favour and place a quick phone call to LTNZ to confirm your facts first, OK? It's them, not the cops, that come to pick up your licence for three months when you go over 100 points.

Not most cops. Did you know that most cops look at the date of a rego, but not the make/model/cc rating of said registered vehicle. That's why people on learners or restricteds can sometimes get away with being on a bigger bike. Stupid piggies.

Demerit points are recorded from the date of offence. Ring the LTSA for yourself.

If not, then why do people loose their lisence for demerit points even though the fines have NEVER been paid.

I have a nice wee letter at home that arrived a few weeks ago stating I am nearing 100, which clearly outlines how demerits are recorded from the date of offence. I will quote it or even scan it when I get home tonight.

Last time I got ticketed the lady clearly let me know I was now on 90 points from that date...and she had only just given me the ticket.

speights_bud
15th November 2006, 11:37
The ticket plainly states on the back that points are recorded when the fine is paid.

Agreed, i think this works on the basis that if you be a good little citizen and don't argue the point writing the cops letters etc and just pay the fine straight away instead of waiting a month for the reminder notice then almost another month after that before paying it, then it's 2 less months you have to wait before the demerits go 'bye bye' after 2 years.

However i can understand how some people may interpret(sp?) the ticket as the demerits are only applied when paid, but they are entered as being gained on the date of the infringement.

Bugger about the demerits though vixter, i know after i got my second lot (now sitting on 40) it slowed me down enough on day to day riding. I could do with the gixxer if it wasn't for this damn restricted license thing...

The points are recorded WITH the DATE OF the Offence, not the date you paid.

So if you wait until older points disappear, you are liable to lose your license, but the computer that processes this may not look back to see if you where over at the date of the offence.

Reckon I'll just shut up now, anyway. If anyone particularly cares, call the cops, call LTNZ, get the straight dope. Everything you read on the interweb is probably wrong, anyway. Particularly if I wrote it.

just spoke to a cop outside the office.

he'll come and get it if the LTSA can't find you.

and if he can't find you then he'll have to call The A Team.

My understanding is that the demerits are lost on the day of the infringement, however are not taken off, put on your licence untill the day you pay for the infringement. The day you pay the demerits are backdated to the day of infringement.

Ya follow, shit I wrote and im not sure I do.

So how do all the ding-a-lings who cruise around with a car load of mates in a clapped out 323 Mazda get demerits if they never pay any of their $12,000 worth of fines? Each breach of their learners is 25 demerits and $400.

The_Dover

you mean they actually have a licence?

McJim
15th November 2006, 14:05
There's a point - in the UK they just jail you for not paying the fine for not having a drivers licence at all but there does seem to be a comparatively laisser faire attitude in New Zealand where they don't really seem to take traffic offences as being criminal offences - so if you ride your big block harley down the street without any licence at all...what happens? Just a fine since there's no where to record the demerits? Or do they store your demerits against the day where you might just get a drivers licence?

So much angst.

here is the law about demerit points:
From the Land transport Act 1998 Part 7 Sect 88

(4)Demerit points recorded under subsection (1) have effect on and from the date of the commission of the offence for which the points are recorded.

[[(5)For the purposes of subsections (1) and (4), if an infringement fee is paid to the enforcement authority at the address for payment specified in the infringement notice before or within 28 days after service of a reminder notice for that offence or within 5 days after the expiry of that 28-day period, the following provisions apply to an infringement offence:

(a)the date on which the infringement notice was issued is to be treated as the date on which the offence was committed; and

(b)a summary conviction for the offence is to be treated as having been entered against the offender on the date of the payment of the infringement fee.]

So, UNLESS YOU CONTEST THE INFRINGEMENT NOTICE (by writing and saying you are not guilty and you want a court hearing) ; and are found not guilty, then the demerit points will be entered with date effective from the day you were issued the infringment notice.

It's nothing to do with PAYING the fine. If you've been fined, then the points will be entered with a date of the ticket date.Even if you never pay one cent of the fine the points will be recorded.

If you really want to delay things a bit you can contest the ticket. But, when you are found guilty by the court the points will be added on and backdated to the date of the ticket.

the 90 de merits from previous are on my licence and the fine aint paid!!
but arranged payments were made through court.
they said once i pay this fine they will issue a summonds

i asked about doing an arrangment like i am doing already they told me they dont sort it thats through the courts and its up to them if they decide to summons you before or after payments

so will have to wait and see i guess!

issue a summons for what? you badly need to talk to someone who knows what they are talking about.

You were correct all along. Points are, indeed, logged against the date of the offense. What form of penance would you like me to undertake for so rashly presuming to disagree?

I'm in a good mood now, too, because I just double-checked with the LTNZ and found out that my oldest points rolled off five days before the date of issue of my latest infringement notice, so I can pay that fine without cringing.

Might have to pop by a Lotto shop on the way home...

Hahahaha, admitting that I was right is all I need...by the way...I like your profile picture Fish!!!

I've spent my whole driving career (only about 9 years mind you), sitting between 50-95 demerit points...I have never lost my license for some wierd reason. Everytime I get a ticket I seem to have dropped a few points a mere couple of weeks prior...its so fucking flukey.

Due to this I tend to keep a close on on when points are recorded etc, so next time I see those party lights come on behind me I know whether I can afford a few more points or not...

So to paraphrase....demerits are recorded against your licence from the date of infringement. But until you pay the fine (accept you are guilty) or contest in court and win, those demerits are only in a holding pattern. Pay (guilty) and they become firm. Contest (found guilty) they become firm plus you pay the original fine Plus you pay court costs of $130 PLUS you pay a lawyer $lots. OR contest (not guilty) points disappear, no fine, no court costs but you still pay the lawyer.

after 56 days the infingment automatically goes to a court hearing, and unless you turn up to contest it, you'll be convicted in abstentia, and the demerits will be loaded, you'll be fined, with court costs. if you start paying it off, no warrant will be issued, however if you fail to make good any payment, a fines warrant will subsequntly be issued, and you can be arrested (except on sundays) and taken straight to the fines counter for sorting out. if it's saturday afternoon, you could be held in the cells til monday
