ok, since we are on the subject of losing licenses and emerit points and what not, id like to ask if any of you would know what the story is with me...
i recently got my license back after losing it for a month. had a few demerits beforehand, so i thought sweet those will get wiped. however i even though i lost my license i didnt have to go to court. so ive been thinking..... does this count as a loss of license or just a ssupension of some sort, meaning that not only did my demerits not get cleared, but i got an extra 50 or so added on:bye: :bye:

3 months. The one month thing is a "suspension" not a "disqualification" Typical crooked government thing. Demerits are only cancelled by (a) expiring after two years (b) if you are disqualified for 3 months because of 100 demerit points, all points are cancelled (c) if you a re disqualified by the courts (usual minimum seems to be six months, not sure if lesser periods are possible) all demerits are cancelled.
So the 28 day suspension thing for 40kph over, doesn't cancel your demerits, and usually will give you a bunch more for a subsequent 3 month loss.
Bloody governments, how crooked is that ?

yep, exactly the brew i'm in....... i guess i'll have to put paying this one off for as long as i can, as the demerits go on once its paid off. and ride like a nana for the next year. pffffffttttttttt

howd you manage not to go to court??? im still waiting for my summons. demerits seriously need to be looked at. these mp's just dont live in the real world and dont realise riding a bike you can accumulate 100 demerits very easily for minor things and two years to have them wiped is an absurdly long time. isnt it enough us paying the huge fines???
i say demerits if you dont wanna pay a fine, no demerits if you do pay the fine!! hows that sound as an idea guys??

They go on at the date you admit guilt, pay the fine, or enter into an arrangement to pay (the latter two being effectively a guilty plea) [EDIT or are found guilty or have a guilty plea entered by default because you did not respond to the various rmeinders etc ] . Spinning out the payment period does not help.
The demerits date fromt he date of the offence.

Ya know... I don't know how you can say that you can accumulate 100 demerits very easily for minor things. Maybe if you're being totally irresponsible, but what you're saying is ridiculous. I know I don't ride a CBR250RRRRRRR, but (at least in the eyes of the law) my bike isn't hugely slower; hell yours is still a 250cc bike. It's not like you're riding a Hayabusa. If you ride like an irresponsible dick then sure you'll get a lot of speeding tickets and dangerous driving tickets, but I'm sorry, but if you act less like a tosspot and keep the `I'm a such a big man, even though I'm not long out of my teens' stuff to the trackdays, you might actually be able to keep your licence.
/rant off. Don't like Mondays, can you tell?

How da ya check ya demerits?
I'm getting close and need ta check before paying the one picked up yesterday. 116Kpm in a 100KPM zone on SH16. Didn't even get a blip out of my Escort. He reckoned that he flicked the radar on and off quickly as he came over the brow of a hill. Don't know how he manage to get a descent lock on my speed with just a flick without triggering my detector. Sounded a bit dodgy. He did offer me a look a the reading, but how would ya know if it was yours or someone else's? Didn't make an arse of myself with him, as New Year's Day is a bad enough day for them anyway.

Draco got done like this. I know the speed he logged was from one of my other mates in front of her (I was following her at the time) as it was a good 20k or so faster than we were going.....wanker.

if you know any cops just give him your licence and ask him to check you out via a QP, ( query Person).he will radio comms and have an answer with in a minute.

I find it easier to call up the (0800 822 422) number for the ltsa they tell you right there

also a handy hint. if you already have 100 demerits and you get more before the document server can get to you (because your not home for whatever reason each time). pay them off asap because they will get wiped off over your 3 month suspension

If you get over 100 demerits, a nice man will come and take your licence, you do not have to go to court. 3 months later you will get one in the mail with 0 demerits.
If you do 40k over the limit, you will be summoned to court, lose your licence for 3 months and get a whole lot more demerits, which will probabliy put you over the 100, in which case, when you get your licence back after 3 or 6 months (not sure how long it gets taken off you for speeding/careless/dangerous driving) a nice man will come and take your licence off you again for 3 months.
3 months, is much eaiser than waiting 2 years, a bit more expensive though. Just dont get caught for 3 months. - I got 2.5 months with out getting caught... :D

Thank for the No. Pyro. Have done the no licence for 3months thing before, but need ta check how close my points are before paying. Have some demerits due ta drop off March/April this year, so if I'm lucky, I will not need ta loose the licence.

I think the points get added on anyway after 3 months from date of offence anyway once it gets handed to the courts though. (someone needs to confirm that for me though)

Nope, turns out my arrest was unlawful, and was over turnerd. Took a fair few months for it to go through the system, but I was back on the road a few weeks after my arrest.

Its a new thing the snakes are doing .. i think it's called catch and release.. what they do is drive along with the radar in standby mode (so no signal to pick up) and then just slap it into active mode for a second and then off again .. it's enough to get your speed and by the time your detector goes off it's way to late.

Im told by my uncle (who is a cop) that if you are caught riding while suspended - you are not allowed to be arrested - can someone confirm this ?
I was under the impression you would be arrested and have your bike impounded
Or could this be the difference between being caught while your suspended
or being caught while your disqualified ??? I believe they are different things... ?

They are. But the effect is much the same.
Land Transport Act 1998
Vehicle seized and impounded for 28 days in certain circumstances
(1)An enforcement officer must seize and impound, or seize and authorise the impoundment of, a motor vehicle for 28 days if the officer believes on reasonable grounds that a person drove the vehicle on a road while—
(a)The person was disqualified from holding or obtaining a driver licence authorising the person to drive that vehicle; or
(b)The person's driver licence is for the time being suspended or was revoked; or
(AND)
S32(3)(a)
A person commits an offence if the person drives a motor vehicle on a road
While disqualified from holding or obtaining a driver licence; or
....
While his or her driver licence is suspended or revoked
The maximum penalty is imprisonment for a term not exceeding 3 months or a fine not exceeding $4,500; and

There were plenty of side roads for me to take and Wellsford was not that far away. As it is I thought I was in the clear and cruised down the road at road legal speeds. Next time I will be taking evasive act regardless.
Have checked my points, and unfortunately this ticket will put me on 100points as the first ticket does not go off my points until 15/3/07 (ticket paid 15/03/05). This is the first ticket since I have had the detector and I have not had one for a year&½. Too bad I did not get this ticket next month as I would have been sweet as long as I didn't pay until after 15/3/07.
Looks like "Roxanne" will be in the shed for a bit. I don't need any more trouble as I need to drive the van for my job as a farrier and a special work licence is not economically viable.
