Right, going home from work tonight, at the lights on Nelson and West Victoria, going straight through, light has just gone green.
And then some prick goes into me from the right. He must of been running a red.
The fucker then drove of, and this time, someone helped me up (like the 1st time ever for me).
On the other hand I thought they were pulling in, but it just seems they just drove off.
Phoned the police when I got home, quite a few people had phoned in giving them details etc. Nice to see there is still a few decent people out there.
Damage to the bike? 4 crashes later and the fairings are still not cracked lol, just more scratches on them. From mud guard is bent like hell, bars bent, etc.
myself, I'm just pissed off mainly. Don't feel anything really sore as of yet, wait until the adrenaline goes down and I'll see, Good thing I had my full kit on.
Anyways, we'll see what happens, Going to the cop shop tomorrow to make a claim or ever you call it.

Good luck in filling out all those forms at the cop shop tomorrow.
Hope they find the runner and charge him.
He has either 24 or is it 48 hours to report the accident.....
There should also be some damage to the vehicle as well.. well at least some scratch marks on the vehicle.

They must of known who you were - write down the names of everyone you've pissed off in the last 3 weeks....write small and use both sides of the paper,get an extra pad of A4 just in case.That should keep you busy for the weekend.

Yep.....me too. Hope they find the wanker. I am sure if a person is involved the law is they have to stop and that 24 hours applies to non-injury IF both parties have stopped? I might be wrong.

You got it right there elle. When personal injury is involved, even if they go and report it within the next 24 hours they are still in the sh#t. They are required to stop and check, pass details and only leave the scene if there is no one injured.

Ok guys, sorry I havn't updated, I had been out and sleeping etc. At my mrs atm for her b-day party, well helping her get it set-up for tonight.
Anyways,
People had rung in, one person followed the car that hit me, got the rego, and a good description of the drivers clothing etc.
The cops got this car, but the driver had swapped places with a passenger. But that doesn't matter since they knew he was driving. So they breath tested him, he failed. Asked him to come for a blood test, refused.
So they arrested him, charged with:
-Failing to stop and check for injury.
-Dangerous driving.
-Driving drunk.
-Failing to comply with the cops.
Apparently this guy has a bit of a history with the police etc.
So went into the station to give a statement, got some pics taken of my bike etc.
Now the bitch is getting her fixed. I donno what's gonna happen insurance wise etc?
I have 3rd party, fire and thieft.
I donno if he was insured or not. And even if he is, I donno if they will pay out or not since he was pissed.
so do they pay me? then go after him for the money or it is a "tough shit mate" and I have to take him to court for money?

If he has insurance, they should pay for your damages but they will get the money from him as he is not covered.
It is likely that he will not have any insurance though if he has a history of DIC, so you might have to request a damages payment from the court or take a civil case to recover costs.

Check your policy. SOME policies give special provision for you to make a claim (Even though you only have 3rd party F & T) if the fool who damaged your vehicle does not have insurance.

well my insurance arn't doing shit. My mother rang them today and they said they had an 'innocent party' policy thing, but bikes arn't covered :P. (I only have 3rd party fire and theft)
So now I need to find out if he is insured.

Phone TVNZ and SkyCity to see if they caught it on their securty cameras. Give them the time and see if they will do a search for you. Tell them it'll make them feel like heroes if they find the fecker.

Deano's advice is best. Stay in contact with the cops (and prosecutor) and with their help get the Judge to award damages/reparations. Saves you the expense/hassle of going to small claims.
You could even talk directly to the offender (or his lawyer if he has one yet) about how advantagous it would be for him to voluntarily make reparations when it came time for sentencing. Showing remorse and all that bollocks.
