View Full Version : Complaint from Suzuki Corp about my SV site
SpankMe

Hello,
American Suzuki has an issue with the content of your site here. Even though I believe that most viewers of this site know that the American Suzuki Motor Corporation is not affiliated with this site, you do use our product logos and focus on our motorcycles. In that regard, we ask you to remove the inappropriate and offensive content that is on the homepage currently.
This type of pornography does nothing but damage the image of motorcyclists, and of Suzuki motorcycles. Please remove this vulgar content from your site's homepage immediately, and if you desire to continue showcasing pornography, place it in a well guarded and age-appropriate venue.

Isn't the USA the biggest producer and consumer of pornograpy in the world?
I read somewhere the US porn industry produces more hours of porn video than every other country put together. Maybe they include home movies in that.

Dear Glans,
My website is not hosted on a US server/I have moved my website to a non-US hosted server (delete as appropriate).
American Suzuki therefore has no juristiction. So why don't you go and get fucked? It might help you loosen up.

Maybe a little over the top, but in a small way they have a point.
I'm sure Spankme wouldn't mind KB being linked/logo displayed from a Bangkok underage brothel's webpage.
You can say it's the internet, and you can do anything you like, and if you put your picture on the internet it's far game etc ...... But the mature thing is be a little considerate. Having said that, Suzuki are way outa line on this one, it's not is if Spankme's peddling porn, it's just a little free speech.

I actually think they sort of have a point. It's someone in Suzuki's job to ensure their image (they spent a fortune on) is associated with things other than (say) an animated gif of a woman rubbing her tits in some guys face. Given the shit that rolls down from Apple's lawyers I think their response is quite restrained ... although it would have been better had they said "specifically the bit with the tits".

I may be obtuse, but what's the go with "American" Suzuki? Aren't they just an operating division of Suzuki Suzuki?
And what authority does Mr Hansen have anyway? Tell him you resent him calling himself after your favourite rock band, and his actions bring their legacy into disrepute, particularly when connected with the name "Glen" that implies carnal knowledge of a woman's nether regions. He must immediately desist.

1) Ask Mr Moral guidance for confirmation that he speaks for Suzuki globally. If not have him suggest a way limiting exposure to the images for those in the region(s) he does represent.
2) Make a condition of signing up/looging in that the user certifies they are over 18 blah blah blah...
3) Place a statement in there confirming the images contained herein are in no way endosed by Suzuki etc. Have him put it past his legal people and get back to you. The on that response, raise a few questions, alter a few words and send it back. The legal dept will love that - keep them busy for a while and all at Mr Moral's department's expense.
All in all - you have a shit show of actually winning this fight.
Edit - do you actually have contact details for this guy? I.e. can you validate the complaint actualy came from Suzuki US or is it spoofed. Might be a good thing to check.

19th January 2007, 08:52
hmmmm yeh would be interesting to see if this actually came from "suzuki america"
I don't suppose you could track the IP address the contact message came from??
Now as someone mentioned before, I don't quite understand what authority suziki america have if they are just a branch of the head office in japan??
Maybe send an email to the head office informing them of glenis's email and how it violates freedom of speech bla bla bla or something to that affect. And possibly get a whole lot of people to send emails to the head office. See just how long Glenis keeps his job.
Unfortunatly you'd need to find out if it's real or just a hoax first

We certainly did not ok this use of our logo for their shirts. :angry2: Small graphic ok, but not for shirt sale (http://www.socalsvriders.com/shop/). :angry2:
Looking for immediate legal advice on sending a cease and desist email to them :argh:
Interesting - this seems to be the same problem you had Spank - a while back, but with other using the KB logo in an inapproriate way. Surely this is just the same issue from the other side of the fence?
That being said...
Irrespective of which branch or jurisdiction etc - usage of intellectual property is a touchy subject to all. Suzuki have spent a lot of time and money associating their brand with a number of things - they don;t want it diluted with other things, and are legally obliged to act upon anything illegal (i.e. something that's theirs, associated with under 18 access to pron).
Picture this - it hits the US Court system, some kids been whacking off to the pics on the Suzuki site then goes nuts - gets his bike (a Suzuki) and commits the heinous crime of speeding only to be involved in a fatal accident.
Thge lawsuit starts and the prosecuting lawyer is paid on a percentage of damages. So they chase the money. Who can they blame?
THE INTERNET? No... the SV site - maybe but I doubt there's enough there to keep the partner at the law firm in Porches for more than a week.
SUZUKI CORPORATION. YOU BEAUTY.
Questions
1) Did Suzuki know this site existed (Yes)
2) Did they know their brand was peddling porn - that very porn than drove poor Jimmy into a cum depleted state of mental instability such that he went out and killed himself - on Suzuki's very product! (yes)
So Suzuki knowing allowed this situation to exist, resulting in the death of this child and now blah blah blah
Sue for $10m... give or take.

19th January 2007, 09:56
Its only the trademarks they can complain about. So you can show a PICTURE of a suzuki, but not just the logo. So, ignore it until you get a letter - not an email, from someone who can actually do something about it. ie an NZ based trade mark lawyer. Then piss em around to ensure they get to pay lots in legal fees, then pull the trademarked stuff off.
Of course if you are VERY GOOD at HTML & PHP programming you may be able to use frames to display parts of THEIR site on yours. Just the logos of course...

Thank you and have a nice day, etc, etc.

You are not a member so fuck off.
Our complaints department rarely meet and couldn't give a toss about your whiney arse problems. If it is that big a deal, why didn't the "real" suzuki complain???
Who do we bill for the free advertising of your products?

A true corporate drone would have included meatspace contact details in the email.
Google tells me that Glenn Hansen is indeed 'Communications Manager for American Suzuki Motor Corporation', but then again, all that that proves is that the practical joker who wrote the email is just as good as me at driving Google.
I'd just ignore it.
If it really is the real Mr Hansen, and he's not just randomly trying to throw his weight around, you'll eventually get a lawyer's letter to the registered address for the domain, probably cc'd to your hosting company.
Dime to a dollar that never happens, though. Might do if the issue was abuse of IP vis-a-vis logos and shit, but if that's not in question, pfft. They can fuck off and die.
I like it when corporate drones fuck off and die.
It makes me feel warm and happy on the inside.

Point out how unsafe motorcycles are and enquire how, given their high morals they can knowingly sell these death traps to an unsuspecting innocent public.
Could go further and compare them to the tobacco companies whom also knowingly produce goods designed to kill and maim and ask him how does he sleep at nights.
Does anyone have a copy of the Herald article which was published late last year or very early this year pointing out how constructive freely available internet pornography is? In the article it pointed out that as the the availability of porn increased the incidence of rape decreased etc etc.
Include a copy of this article and point out that you on the other hand are constructively enhancing the quality of life in America whilst their death traps and having the opposite effect.

Thank You SpankMe for the restraint you have shown on KB allowing me to choose not to see the pornographic images people use on this site.
I ask why don't you extend the same courtesy to your SV site. Personally I think that the "censored avatar pic" is likely to entice such people to actually register on your site.
Personally I am not offended by your avatar but given the choice to see or not to see, I choose "no". I don't think my wife would be so happy if my daughter was sitting on my knee whilst I surf with that avatar demanding attention
Realistically in the end it is your choice what you do.

Sorry i could not help myself for replying..
dont have your daughter sitting on your knee whilst surfing the net, or watching tv, or reading a mag of any sort ,
because porn is everywhere-- like it or not,
my daughter does not go on the net for that reason, (the other reason is so i can keep all the porn to myself)
also, whats ya wife got to do with it,?? shouldnt she be in the kitchen with a ball gag on....

Tell them you're really sorry, but you don't know how the nuts and bolts of the site work. It was designed by your cousin Osama and his bud Saddam. Sadly Saddam's not around anymore, and Osama is living out of cellular coverage. But you're going to visit their chum Sheik soon and you'll get him to give you instructions on how to pull the images.
Being American I'm sure they'll be accommodating.

Spank, if it wasnt an email and they used your website reply/enquiry page, you must have the IP address logged.
Just do a Whois and check the ISP details. I bet you $100 it isnt from Suzuki. You would expect a manager from Suzuki to email you directly using his official Suzuki mailbox.
