I brought the bike into work this morning and parked it in the bike park outside since I was booked into get my warrant re-checked at lunchtime after getting all the work done in the weekend (it passed its warrant). Went to take the bike to get the warrant at lunchtime, and there was a fucking $200 ticket for not displaying a current wof on it.

Is this bullshit or what? I should be able to get off it shouldn't I?

Definately worth the 45c it csts for a write in. Try and get the garage to back you up that the bike was booked in.

Who issued it? Police or the local authority?

good luck getting off it, as long as you have evidence of getting/going for your warrent in the arvo they will let you off, I didn't have such reciept as it was just a mate doing some work on it so ended up having to pay

Generally you can avoid the ticket if you were on the way to get the warrant.

Well I don't have a copy of the warrant sheet, but I might send a photocopy of the new warrant tag in with it.

Good luck!!!...if it were the Police you would have gotten off easily but Council nazis are a little different. If your warrant is more than a few weeks overdue then you'll need more than luck.

If its recent then send in a copy of your passed WOF form and also any job sheet/receipts for the work done in the weekend. Don't forget an ass-kissing letter too! Thats the best you can do and even then its not a sure thing.

I had the same happen a few years ago in wellington. I got a copy of the job sheet from the shop which showed dates and times, plus I had a receipt from paying for the warrant with times on it.

I sent copies of all of those into the council and they let me go.

Date of failure and issue will be on the computer,but I doubt if they would go to the trouble of looking it up - no customer copy of checksheet? that's your responsability and I hope whoever did the check charged you $7 for failure to produce - it's in the VIRM.You are allowd to opperate at vehicle without a current WoF coming or going to a place of repair - means you're ok.

How long expired was the warrant? Over 1 month?

Yeah I failed the warrant last week and got the work done over the weekend to fix it up.

The warrant was expired by just over a month, but that's cos I was out of action for a couple of months with a broken leg.

The warrant was expired by just over a month, but that's cos I was out of action for a couple of months with a broken leg.
After failing a warrant you are entitled to a reasonable amount of time to get the repairs done - about one month is reasonable. If you still have the form from the failed inspection then you have proof of inspection from one week previous. This in its self should be enough to get you off the fine but keep a copy of the invoice and inspection sheet from the second trip to the garage, (where you obtained a warrant) because as I understand your post that is on the same day as you were issued the ticket. The two inspection sheets a week apart from one another show that you have taken reasonable steps to get your bike sorted out and I would be surprised if the ticket stands.

By the way the offence for having an expired warrant is actually "No evidence of inspection". The original inspection done is evidence of inspection even though your bike failed the inspection, it was nevertheless inspected.

Bottom line is don't pay the fine, you shouldn't have got it in the first place.

This highlights the problem with local councils writing tickets for warrants and regos because they have no interaction with the people involved and thats why in a previous thread about speed cameras I have said that councils should not be allowed to operate them. They should stick to parking tickets because thats as much as their intelects can handle and you can't apply the same thought processes, (or lack of them) to more complicated issues.

if you think you have enough grounds for not getting the ticket then just write in and wanting to go to court. The people in the courts are much more fair and not so nazi about things. Worse case is that you have to pay the fine + court fee.

I can say the court system has work wonders for my speeding fines thou

Nazi's alright, i had my cage parked outside my own house, no off street parking, okay WOF is a month over but bike & cage came up at the same time, bike takes piority over cage, bike cost shitload to get upto WOF, no $$ for cage, have slowly been fixing it up, pinged me for reg being on hold to, $400 in total, wrote in ranting away (nicely) na sorry mate you gotta pay.

I'm thinking bout de-regin the cage, grinding away the chassis number etc etc and driving it through the front of the council buildings.
I just gotta hope they don't ping me again i got nowhere else to park.

Yeah thats not cool huh. No parking on the road with a exempt rego.... That is vicious. I keep the BM warrant under the seat. It is easy to see, all you gotta do is lift up the seat (it is never locked) and you can always read the due date. Keep it in a plastic holder and within 3 months the ink has run and you have no idea when it is due apart from the punched month indicator. Never had any problems, but no doubt one day I'll run into some officious asshole with a point to prove.....

Well I just got a letter from the council saying they're not going to waive the $200 fine, so I spose I'm off to court.

Bruce, overseas exsperince shows the best way to do this is with an armour plated D8 bulldozer, Both wari and I (maybe others) have an extensive background in heavy earthmoving equipment, speaking for myself, I would be move than happy to give you a few lessons.. We could start with some phone boxes, work our way up to a house or two, then maybe a final practice on a small factory or warehouse before taking on a council building.

I am day shift today and tomorow, but could fit you in later in the week
