View Full Version : Me vs Car - Me still ok

Do I get my grown up bikers' badge now? I had my second ever accident on the way home tonight. The guy in the car I was approaching moved to the centreline of the road, just before a right hand tee intersection. I assumed (makes an ASS out of U and ME) and moved to the left of the lane to underpass him. It was at this point that he indicated to turn left and turned into his driveway - straight in front of me. So as the experienced and worldly biker that I am, I jumped on the back brake and locked up the wheel. Thought "No no don't do that" got off the back and more onto the front with alot more vigour before gently side slamming into the side of the car. I think I sort of bounced off a bit then dropped the bike. I immediately picked up again and turned the key off. He'd got out and was surveying his car. In quick succession the neighbors appeared and he started to tell them how I was at fault! One of the neighbors asked if I was ok...
The Police turned up about 5-10 minutes later (fuck that was quick!) But it was good because the driver was starting to really piss me off - I was stalking up and down the street side trying to remain calm. The cop got me to sit in the car and took my statement. Nothing else to that I suppose - I'll just wait and see what happens now...?
And now for the damage report;
Front right hand fairing - mounting brackets and fittings busted off.
Headlight fairing - broken around the headlight.
Headlight moulding - cracked may need replacing. (Headlight is in good nick)
Forward mounting bracket - bent to one side needs straightening maybe a bit cut off and replaced.
Radiator - Top pipe busted off, probably just needs to be welded (TIGed) back on - the radiator itself looks ok.
Forks - look ok...? no visible signs of damage and appear relatively straight.
Front Wheel - looks ok
Indicators - Busted 3 out of 4 of them - they need replacing so it appears a set of four is in order.
Everything else appears to ok....?
I actually think the car will cost more to fix than the bike. Good job coz he's a cunt. The cop told me all I had to tell him was the incident report number, so that's all I gave him.
He says "I'll fight you tooth and nail to get this fixed" so fuck him. Have fun in the courts you dick!
Oh and I'm ok too! Sore shoulder and thats it.
(shit photo's but they're from a cell phone so that's good enough)
I must not forget - a huge big thanks to KB! Especially AJTurbo and Skunk. AJ was the first who answered the phone (coz he has no life!) and Skunk who answered his call and came to my rescue (about 1/2 a k from my home) and transported my bike back here and helped me take off fairing and mull over the damage or lack thereof. I got off pretty lightly all up. Without the great people that inhabit this place I'd be still sitting on the side of the road not wanting to pay for a towie!

Even when in a car those people fuck me off that dont actually indicate until they're turning. Hardly ever see anyone on the roads now that actually follows the road rules.
And WTF is up with people indicating right to go straight through a roundabout?

Yeah I agree on wishing a speedy recovery on both you and the Bike.
It never ceases to amaze me that people think they are driving trucks and need to go way wide or cross the centre of the road before turning into their driveway, most of these maneuvers can be completed from the left hand side of the lane....and he wasn't driving as practical to the left as possible so I suppose he could be done for inconsiderate use or even careless use, failure to indicate with sufficient warning, don't know what else .....ahhh they should just do the pecker for being a complete toss....

 I thought the law was to indicate your intended exit (same as any intersection) as you enter the roundabout, then indicate left as you leave the roundybout.

Bummer :(
Glad to hear you are ok. The bike got of light too except it looks a little sick there.
If he didn't give a three second indication (sounds like he didn't at all) then he's stuffed. Thats why there is a three second rule.
Too many dumb bunnies out there turning as they indicate.
For those who query the roundabout rules, you indicate right if turning around the roundabout but if going straight through you don't. BUT; whenever you leave the roundabout, including straight through traffic you indicate left to show you are pulling off it and that goes for straight through traffic as well.

So you were following him from behind?
He moved to the right and then indicated to turn left as he was turning?
and then turned left right in front of you?
Hmmmmm if it was this way...... could be a hard call by the cops.
Reason you were behind him.
So be prepared for a fight from the other side's insurance company.
Many car drivers do this..... and it is so frustrating when they do it.....
Same as many pull right over to the left of the roadside and turn right.

You might be right, but I was sure that you indictaed right first. I'll check sometime when I remember LOL.
You only indicate right when approaching a roundabout if you are going right (like taking the third exit on a four road roundabout) I've seen cagers indicate right and then go straight ahead since I got to New Zealand - I think it;s a result of some ham fisted wording in an earlier campaign to educate kiwis on the niceties of indicating at roundabouts.
Shame a lot of people haven't got the hang of it yet - makes roundabouts so dangerous - I've nearly been wiped out 3 times by going stright past a car that all of a sudden was taking the same exit as me without there being enough space!

I don't want to be a negative prick but i am tonight, if you undertake a car and they turn into you I wouldn't see that as solely their fault.
If they aren't indicating right (or stopped) then you can't pass......
Yeah, he could get a careless charge for lack of indicating, but would that necessarily imply fault (eg if i jumped on my brakes on the motorway i might get a careless or dangerous charge but would i be liable for the guy that drives into the back of me?)
As crashe said, expect a bit of a fight.

Similar thing happened to me 15 years ago. RG250 vs. Hillman Avenger. I t-boned him right where the drivers door meets the front guard, the bike swung around to slam into the side of the car. RG250 written off, dislocated Navicular (ankle bone) that required shitloads of Morphine & cutting & grinding. Those were the days of sheepskin moccasins - hutt Valley styles bro. You should always learn from your experiences, I learnt that moccasins make for shit motorcycle boots.
Ok, guess Im doing it wrong. I indicate right until I exit, when I then indcate left to get out. No ambiguity. Everybody knows where Im going.
I do this too, always have as I understood it to be the law. I get pissed when I approach a roundabout and oncoming traffic turn either way without any indication, the melling roundabout is bad for this.

I also thought you indicate right until you get to your exit, then indicate left.
But if you look at the road code (http://www.ltsa.govt.nz/roadcode/giving-way/roundabouts3.html) it states
If you are going 'straight' through a roundabout:
don't signal as you come up to the roundabout
signal left before the exit you wish to take.

could be in a bit of grief here Colapop.
I had a similar problem some years back. It was night time and I had been in my small truck following a woman in her car(for f'n ages), we turned into a road that had a pretty steep uphill gradient and travelled half way up it, she pulled right over the centre line, no brake lights or indication, so i figured she was turning right as there was another road entrance there, so i go to pass on the left,(tons of room since she was half over the centre line) and she pulls hard left into a driveway. I smacked into her passengers door, hop out and ask her what she was thinking, and she says sorry i didn't know you were behind me. So it ended up that i (my insurance luckily) had to pay for all the damage. That said it was my fault as i undertook. Yeah whatever!
Hope it works out better for you.

As far as 'The Shitfight' goes, I'm pretty unconcerned. If it goes against me then I'll offer to pay... of course I'll only pay at $5/week forever and a day. If they want more it'll cost them more than its worth to recover the money. I can be as much of a prick as anybody. Just glad I didn't give the guy any personal details at all. Sorry about your "bit of a problem", Mr Colapop.
Similar thing happened to me a few years ago. I came up behind someone who'd just pulled out from the curb, and so i braked and slowed down )I was going to tootle him melodiously to make sure he knew I was there, but didn't....) He then pulled into the kerb and so I went "Oh - he's seen me" and started to accelerate past him, just as he started to crack a u-turn. :shit:
I swerved, but he was turning faster than I could.
Luckily, in my case he was at fault, as he turned across my path, didn't indicate, and was driving an Audi. So it was no fault as far as the insurance was concerned. Total damage to the VFR was $6800 - all cosmetic.
Anyway, enough burbling from me. I hope it all goes better for you than it has so far.

I also thought you indicate right until you get to your exit, then indicate left.
Not wanting to hijack the thread, but...
If you're going straight through but you indicate right as you enter then someone coming from the opposite direction (entering where you're going to exit) will think you're going to turn across their path and will have to give way to you. So they'll stop unnecessarily.
The closest call I've had on my bike was when I was going straight through a roundabout and there was a guy coming from the opposite direction who wasn't indicating. Sweet, I thought, he's going straight through, too, and I don't even need to slow down... Having got 1/4 of the way around the roundabout this guy then starts indicating right! Luckily I was able to stop. Now I ignore people's indicators at roundabouts because at least half the time people use them wrong so they're just bad information. If there's any chance someone can hit me, I take avoiding action. Always use extra caution at roundabouts (especially small ones).
Sorry to hear about your off, Col - glad you're ok and I hope the bike gets sorted ok.

Bad luck mate, but fucken take responsibility. You tried to undertake a moving car and you hit the car. If it was the other way around you would be cursing the car driver for trying to undertake.
It sucks your bike got a bit busted, glad your ok though. If the cops say your at fault, dont be a cunt. Pay the man, you did after all crash into his car. :nono:
Hahaha! No need to be an angry man! I'm not saying he was totally at fault - equal blame I'd say. But his attitude wasn't the best. His first comment was "I'm going to need your insurance company details" not "Are you ok?"
We'll just see what happens - don't judge me before you know me (yes, I am mental)
The only thing that's confusing me with the thread hijackers (It's all about me!!) is that hey're all talking about a roundabout when I was on a tee intersection??

Its a good reminder to never pass in suburbia. You're not going to get any where any faster with over/under taking. You will catch them up at the lights.

Many car drivers do this..... and it is so frustrating when they do it.....
Same as many pull right over to the left of the roadside and turn right.
The road code actually encourages this, if it is on a busy road where sitting in the middle of the road might be even more dangerous.
However, getting an average (impatient) kiwi driver to do this safely seems to be a challenge.
This thread has officially been hijacked, Cola!!! Fly us to Queenstown or we'll blow it up!!!
Glad you're OK!!!

he is at fault - rule 2 : indicate for 3 seconds before turning.
Didnt matter what you did if he didnt indicate
In the ideal world this is true,
however if you hit someone from behind, no matter how idiotic they are driving, you are in the wrong, based on the premise that when following someone you are suppossed to be able to stop in half the clear distance in front of you.
I also believe this sucks because if the driver in front does something wrong, the sucker behind pays for it...:argh:,
and yes I have had to pay (well the insurance company did) for damage caused by an idiot driver in front of me:gob:

Glad you're in one piece, Colapop.
Difficult to call re. that accident. You did, after all, overtake the cage on the left when he was neither stopped nor indicating to turn right. That arguably trumps a failure to indicate for the full three seconds prior to maneuvering. Best case outcome would be 50/50 responsibility, I'd say.
[Woops, Squeak beat me to it.]
Never mind. You're insured, right? Live and learn and ride again.

thats an interesting call. If dickless had stopped in the middle of the road and you'd stopped behind him, odds are you would have got rear ended, and not in a nice way.

yea, glad to hear you're still in one piece and shame about the bike. Its surprising the number of vehicles that pull off that manouver though. Coming from the other direction, I've experienced a couple of near misses as cars swing out over the center line to get a better angle into the driveway. Go figure

Some of them seem to have buggered shoulders, and can't turn properly.
You've seen those dorks who lean all-over their passenger seat while turning left, or nearly fall out the drivers window when turning right?
They make up for this lack of ability to, you know, turn the steering wheel, by swinging wide everywhere.
At least the rider was not too badly hurt in this one.
Cheers,

I don't understand why he needed to make a swan neck turn (out and then around and in). I've driven, and still drive, large 10t+ trucks and only rarely needed to use that manouver. This guy was driving a VW Golf GTI FFS! Fuck those things must have a shit turning circle.

just to help clear it up.....
Before entering a roundabout you must indicate if you are intending to exit left or right – if you’re going straight ahead, don’t indicate.
You must give way to all traffic that will cross your path from your right as you enter the roundabout.
You then need to signal left as you pass the exit before the one you intend taking.
At multi-lane roundabouts, you also need to approach and enter the roundabout in the correct lane for where you intend to exit.
Also you must give way to all traffic on a round a bout as technically they are coming from your right...happens to me all the time, ill enter a roundabout and some on from my right appears after i have moved off ..Ie: they have driven up to the roundabout and continued on with out slowing down and because Im large and heavy and takes a while to get up to speed they quite often end up waiting on the roundabout for me to continue , and to top it off they give me the fingers and yell abuse...however I am on the roundabout so they have to give way to me lol.

All KBers know (or should know) that I LIKE HUGS! I try to be gentle with the girls & DMNTD (he's a bitch anyway) and the guys should be man enough to handle them.
If the police attend all you are obliged to give is the incident number (and you don't even have to give that). Gone are the days of swapping numbers and all that bullshit.

Hey Cola,
Sorry to hear about your incident. It's good to hear you have not come out with any serious injuries.
Seems to me like your opponent doesn't know how to keep aware of what's going on around him (in the mirror) when he's in the middle of traffic and has forgotten about normal road courtesy like indicating a change in direction. These are all simple things to remember and do eh?
In my view - not much of a human being if he doesn't even check to see if a rider is okay first before launching another assault about insurance. I guess he just got it wrong again... wanker.
Hope all the scrapes and bruises heal soon and you get the bike fixed without too much breaking the bank.

You only indicate right when approaching a roundabout if you are going right
There were some changes with the new road rules a couple of years ago, this info is direct from Police, part of a powerpoint presentation for LTNZ and Police to explain new rules.
"Before entering a roundabout, indicate if exiting left or right (if you’re going straight ahead, don’t indicate)
Give way to all traffic that will cross your path from your right as you enter the roundabout
Signal left as you pass the exit before the one you intend taking.
On multi-lane roundabouts, you also need to approach and enter the roundabout in the correct lane for where you intend to exit"

Apparently its the law now.
Clarification: It's no indication going into the roundabout then indicate left if going straight ahead. Right indication only ever if going right of the opposing lane.

Sorry dude, but why were you following him so close? the 3 second rule applies so that if somone has to brake/move like a dickhead, you don't smash into him.
Its very easy to ignore this rule around the suburbs. Remeber this rule ias well as the 3 second rule, "your a dick if you over take in the suburbs/citys."
Overtaking somone in the suburbs/citys is not going to get you to your destination quicker, only running reds will. (but don't do it)

What is the rule for three exit roundabouts? Do you indicate if exiting the second exit, which in many roundabouts can effectively be straight through? Coming from the other direction it is first left and few people indicate.

(but don't do it)
I wasn't following that closely. I came over the crest over a hill and he was slowing at that time. I also slowed while approaching him and moved slightly to the left to avoid the possible obstruction (Ha!). Unfortunately he turned directly across my path, indicating only at the time of turning.

Yeah I was. The law clearly states that you are not allowed to pass on the left. It says that you may pass only when the way is clear. I checked.

Bad news indeed and its all to common that the biker gets the shafting for undertaking or something. Stand yer ground, he didn't indicate early enough and he moved right to turn left confusing you..Have fun

Yeah I think so...?
Just an update..
The insurance company are taking me to court to recover costs. I have all my evidence ready and will go to court to fight them (ok it's more like arbitration - but I'll call it court) If they win I will pay them off.. $1/month if I can... unless the court orders a full settlement.

All the best matey when it comes to the hearing! I know you'll do a spiffy wind-up and a closing along the lines of Boston Legal! "Hi, I'm Colapop..."
