Circuit operator John Cobb wrote to BikeSportNZ.com with this news:
“Phillips Fox, the lawyers representing the council, met with our lawyers and among other things, agreed that Phillip Barrett’s planning report (recommending our resource consent application be declined) was not an impartial report because he had been in contact with both the riders and the objectors as well as being the author of the report.
“The Council is also the landowner and is trying to make the decisions on both the lease and the planning consent. The lawyers are still discussing where we go from here, but Phillips Fox were not going to oppose our appeal in the Environment Court for a stay to reopen the track.
“The objecting residents however want to be a party to the appeal and are saying they would only be happy if we are restricted to one Sunday per month and Wednesdays from 10am to 5pm in both summer and winter.”
The court was to hear the appeal for a stay in the Environment Court today.
