Sigh, I got taken out this morning - I seem to be ok so no need to worry

I've already been to the doctors and done the acc, just got back from the police station after filing a report.

on to insurance now

as said, im ok and the bike isnt to bad (hopefully rideable after a bit)

details will be here soon but right now i dont have the time

It does seem like a lot of accidents are happening at the moment. Glad you're ok. I nearly got knocked off again this morning. Some idiot decides to pull across the road, decides then not to, then decides to pull infront of me, then decides they have seen me and slam their brakes on when they are half way into my lane. Jesus, some people.... Luckly i saw it coming and gave them the middle finger and kept going.

well i dunno..... when i binned it in october that was at about 8:15am and i posted at about 8:45, this time acident occured at 8:25am and i posted at 9:55, this time its more me and less bike

ok, so

it was the + intersection of Cornwall St and Raroa Rd, I stopped to turn right into Raroa, the other vehicle (yes it was a 4wd/suburu forrester if you must know but no slagging 4wds in here) stopped at the give way to turn right out of Raroa and into Cornwall, I proceeded as did he at the same time, front of the 4wd collided perfectly with the right side of the bike and the bike fell on its left with me in a spiderman pose over it

Fortunately the 4wd didn't have bull bars so the main injury to me is my leg where the bumper smashed into it, just a big bruise and fluids collecting underneath according to the doc

a workmate saw the whole thing happen and pulled up straight away and helped me out

The guy driving the 4wd was really great, he jumped out straight away too and helped my workmate pick me up and move the bike out the way, chatted for a bit then moved his car into a park and we exchanged details, then pushed the bike down the road to my works garage with me riding on it :D

then as i said, went to the doctors instead of a&e then did the police thing, still waiting on my insurance broker to call me back as he was busy/had visitors/in a meeting

damage to the Bandit, well - it was hit on its right hand side and fell on its left so damage is typical with a drop on both sides

left mirror and metal strut needs reaplacing, something up with the right indicator, clutch lever broken. probably more but havnt had a look yet, doubt full it will get written off (damn)

Damage to the 4wd

front bumper dented and number plate holder broken, front grill dented, bonnet/hood dented - all these have black scuff marks too and the dents are surprisingly big - probably atleast $500 in panelbeating?

Wasp sorry to hear of the accident ... bloody four wheel vehicle drivers (did you know I own one of those beasts) ....

I am glad that you are sorta ok ... I know the leg will hurt for a bit ... but it should come right ... Grub had a similar injury when he went over the handlebars of a push bike we own.

Finally got out of this morning's meeting and find this ... my god Doug, a close one. Very glad you're ok. Sounds like you played bouncy bouncy across the hood which was ucky because 4WD's being so high usually push you over and down.

I was going to say "... just as well it is the Banditto and not the 636 ..." but is it? That bumblebee has certainly come a long way with you, it's going to be hard to part.

Yea, it was the Bandit

Duc - he was on a give way, i was turning off the main street into the street he was comming out of

the driver of the 4wd admitted fault right away (it was his - failure to give way im guessing he might be chargd with or something to do with causing an injury) and ovbiously has insurance and is willing to sort it out

lets hope he stays that way

in all fairness though there was sun strike (i checked)

Glad to hear that you are OK. Its crazy town out there, almost got bowled today. My mate managed to get a 4x4 whacking into him. I think its fair to say we should watch ourselfs out there for the next few days!!

Good luck with insurance problems, and there's a wrecked bandit on TM. You might be able to pick parts off that pretty cheap. Got coils etc from it the other day.

Hey Doug, play the sympathy card while everyone remembers. Ring up the local cop shop, they'll be the one that attended yesterday (should be same section {shift} too). Ask to speak to the sergeant and ask about an exemption for the 636 until the bandit is back on the road. Given your height, you'd possibly get one anyway but that's a bit of a process.

They might just say ok since your full test is only a few days away and they will flag it against your license in their system

Next thing apply for an emergency exemption .. while you have injuries to show what happened :)

went to the police station and talked to the sargent, he said the AA handle it and he doubted i would get it

went to the AA and asked, i have to follow the normal applying method which apparently takes atleast 3-4 weeks

im going to try find some info on the ltnz website....

Yeah, I kind of agree, insurance is one thing but the $400 fine would be a bastard. I think you might end up having to wait another 7 months too, instead of just the one, if they still do the 6 month license term extension thing when you get caught (not sure though, its been about 15 years since I was last picked up for that).

unfortunately I can not do that

the bandit was my only form of transport, i was in the process of moving out which is heavily dependant on me being able to get about, the new place means about a 15 minute (guessing) commute to work

I have resigned from my job and will be leaving next friday, at which point I need convenient transport up to Kapiti

solutions:
1) ride the 636, the down side of this is very ovbious to me, loss of license, crashing etc
2) buy a car, i'm too broke and need to learn to drive before i sit my restricted anyway
3) public transport, there are no buses that run where I live (pathetic council...) from the new place to old work means 2 bus/train fares each way, train up to the new job is more feasible
4) borrow a bike, this is a very likely option and have already talked with my insurance co about doing this (anyone got a 250? 150?)

I'm open to suggestions as i'd also like to avoid riding the 636 if possible

also i've spoken with my insurance co about recovering inconvenience costs, they are willing to try but are very doubtful that State will pay (and i'd have to pay with my own cash first then try and get it back)

There is ample precedent for a culpable driver's insurance being liable for the cost of a rental car to cover essential transport requirements when their client's negligence has put an innocent party's car off the road.

If they pay up for rental cars, I do not see why they should not be equally liable for the cost of a rental bike.

yes but its state, when my parents van got hit by someone they wouldnt give a car/van to them - this would have meant that neither of my parents could work and my little brothers could not go to school. fortunately the panel beaters took pity on us and lent them a car just to help out

Well it is not entirely at their discretion. In law, the guilty party (the dude in the 4x4) is liable for damages for ALL loss you have suffered. Which includes conseqential loss. And they, as his insurer are presumably liable to defray such damages . That will of course depend on the terms of their contratc with their client. But if they don't pay up, you can sue the dude for the rental cost. There are insurance experts on here, maybe one of them will offer sime advice. It would seem the simplest solution, since I'm sure one of the local bike shops would be willing to negotiate a 4 week rental of a 250.

TSS, for instance, have a shitter GN250 that gets loaned out to people who are having their bikes serviced. They may be able to exchange that with one of their demo 250's for a few weeks.

Besides, I want a picture of you riding a GN250.

Did Tristan sell his FXR?

The other alternative is (might be) to get a shitter cage. Backpackers always seem to be desperate to sell a shitter for a couple of hundred bucks. Maybe trawl around them ... ummm .... somehow?

I just read state's policy; says it will cover the losses of the insured but nothing about me in there besides the manslaughter section which fortunately doesnt apply

I remember a crash umpteen years ago that ended up in court. The forms for that certainly included an amount I was claiming for a rental in the meanwhile. I believe the word "reasonable" was in there, but still.

BTW: 18 year old jumped the lights and hit me (Fiat Uno) on the passenger side front quarter. Sent the car a few metres down the road and physically bent it. F'kin wakes you up that does.

Well, in principle, your argument is with the 4x4 dude.

If he was rich, but had no insurance, you would sue him (probably before the Small Claims Tribunal), for the damage he has done you. (Technically I think it's called a tort) . Damage here is a legal term it doesn't just mean damage to your bike, it means all the losses you have suffered as a result of his negligence. So that would be the value of the bike (or the cost of fixing it) PLUS any other losses or costs you have incurred. You can't sue him for your pain and suffering, or injury, because that is barred by ACC legislation.But anything else is fair game. You are entitled to be put (insofar as it does not relate to any personal injury) in the same position you would have been if he had not hit you.

Now, since he does have insurance, what that means is that his insurance company say, in effect "If someone sues you, we will recompense you for the damages you have to pay". Of course, they may have clauses in their contract with him that restrict their liability - like an excess for instance.

For practical convenience , you are dealing direct with the insurance company. But it is the dude who is liable, it is just easier for you to talk directly with the company rather than him, and he have to pass it on to his insurers.

So , tell the insurers you will be entering a claim against their client for hire of a replacement vehicle until the case is settled. If they say "Who cares, our contract with client Dude excludes us from having to recompense him for that", then tell the dude you will be suing him directly

I think it costs $60 to lodge a Small Claims Tribunal case.

The only problem is that you would have to pay the rental cost up front (unless the insurance company come to the party), then claim it back.

But, I am not an insurance broker or a lawyer. Let us see if anyone more qualified will comment.

It's a good thing my Insurance is through Kiwibike - Dave has offered me great advice so far and I will talk to him tommorow (and probably the local bike shop about renting)

now.... the more modern vvt bandit? the weakling 40hp model bandit? or a hyosung? I think there is a vtr there too..... always wanted to try one of those.....

Make sure you get compensation for any bike gear that needs replaced due to the bin (as well as repairs for the bike).

Hey Wasp,

That really sucks bout the bike, pity tris had sold the FXR and we have left Welly.
I dont know much about the Tribunals part of courts, but you can make sure that the Police prosecute Mr 4WD for Careless Driving causing injury, and tell them all the costs that you have incurred, so that they can seek a reparation order (Include Dr costs, and anything else you can think of). They will hopefully also get you to fill in a victim impact statement, so the court will see your side, and order some money for you.
Of course if you dont get a payout, then u can take State and the driver to court. Like I said, I dont know much about Civil jurisdiction, but you should be able to rock up to the court and they should be able to help you out. I think that the filing fee is about $130, but you can claim that should you win.

I suggest talking to the Police about prosecuting, but let me know if you need anymore help, though I dont know many of the Lower Hutt Prosecutors.....
