Its a beautiful Sunday afternoon slighty overcast with a blue sky and sunshining, driving throught the peacful domain, past the people feeding ducks, past the tourists takeing photos, past the muesum and into a Sucidal Manic! :mad: This stupid woman in her 60s was walking on the left of the road ( its one way) so I move to the right of it. She had her back to me walking down the hill, I was going about 30km/hr and she started to walk acroos my path but there was heaps of room and I wouldnt have come close to touching her. So she looked over her should ( probbly because she could her my scooter ) and she freaked out and leaped into my fucking scooter. Police and ambulance came, the police talked to some people who saw it and said they could go, then he proceded to talk to me and then the sucidal maniac who was by this time in the ambulance with a oxygen mask on her face as she was freaking out. This is all good the police officer says its her fault rah rah rah, and then says Im not going to bother filing a crash report as there is no need, but I ask what shall I do about insurance you told my witnesses to take off and my insurance company will want to get the money off her. But no I dont get a crash report I have the ladys name, adress and phone number. What shall I do as there is over a grands worth of damage too my scooter its screwed needs panel beating to the leg covers mud gaurd and motor cover.......

No accident report for a possible injury accident?
Was he suffering doughnut withdrawal? Or was he falling behind in the days quota?
Reduce reported accident stats by not rep[orting them. Priceless!
Contact your insurance co and they might embarrass donut man into doing his job.

Yer, but all I want is the money to fix my bike as there is over a grand in damages but it will sort it self out, and if I clam the insurance I lose my no clams bonus my fees go up and I have to pay the excess.....

Yer he gave me that card with her name address and phone number but he said he wont file a report and it says on the card office hours 9am-4pm monday-friday so I cant do anything till monday....

I hope its got a few more riding days as it only done 280km's and its only 9days old (I brought it brand new)

i would be heading down to central today and filing a report. there will be an 'event number' that they can match with your report (ask them for it when you get there - it's a 30 second search as long as you have time/date). maybe take some digi shots of the damage to your scoot

Nobody has mentioned that although the blind/deaf old bat walked into you,
you didn't stop in time.
Could it be said you were travelling to fast, or without due care?
Could this be twisted against you?
Seems like a good idea to get that cops thoughts down on paper........

Don't worry about giving any relevant advice Lou - just take the opportunity to launch into the polcie..........again. You are nothing but a broken down miserable old git!!!
Why not go down to the station and report it, explain that a cop attended but said he would not put in a report, explain that you aren't happy with that outcome and fill in a report at the station. Ask the cop you speak to to get the event number if you don't already have it, this will be a link to the cop that attended the scene and therefore access to any relevant notes he made at the time, witness names etc.

There was advice in there, my tubiferous friend. It was to make a claim with his insurance co. and let them shake donut mans cage. Insurance co's are very interested in apportioning blame, possibly more so than the Pleece.
I'm sorry if my venting some spleen obscured that part. In future I'll try to give advice first so that you notice it, then launch into people too lazy to do their jobs properly.

So what was the outcome, Texmo? The reason I ask, is a similar thing happened to me (girl leaped in front of me, when I was trying to avoid her). The cops attended, asked lots of questions, filled out a report, and I left it with the insurance company. I had no names or anything, but IIRC, the police gave me an incident report number, then I gave this to the insurance company and everything was sorted. Didn't cost me a thing (apart from a roll of duct tape to hold the VFR together so I could ride it). Cost the girl a week in hospital, a leg broken in two places, and the repairs to my bike ($4800 or summat).

I have to foot the bill according to the insurance and the police, But fuck that I aint going to pay for it. I have the ladys address and when I get the insurance form in the mail and a quote for how much it will cost to get my bike fixed I'll go see the lady and ask her to pay if she doesnt the I'll take her to the small clams court...... Cos I dont wanna lose my no clams bonus + get a rase in my premium

And yes she was injured as I said the ambulance took her away if she needed a lie down they wouldnt take her to hospital....... She couldnt talk either this suggests she was badly injured.

I just got the claims form in the mail...... $900 excess that like $500 less than it will cost to fix.
I heard that I will have to wait a year before I can take her to the small claims court as the line is so big is this true?

Report the cop to teh police complaints authority if you don't get any action. Do you have the copper's name? You can alwasy subpeona him as a witness if youa re going to the Disputes Tribunall..
