Any ideas or leads on finding a certain theiving mongrel (http://www.nzherald.co.nz/section/1/story.cfm?c_id=1&objectid=10458568) out there?
Fraudster extraordinaire, confidence trickster, and conned a KBer (no - not I) out of $3,000 they really could NOT afford. Anyone knowing his whereabouts or able to privide leads will be entitled to duty free booze for a year (i.e. every time I travel for a year, you get to choose what you want at a duty free cost)...
I'm keen to nail the bastard, the cops are too. His hot buttons are people looking to buy a car (he takes the deposit, never delivers and stops taking calls.). He's 52, largish and according to www.Oldfriends.co.nz (http://www.Oldfriends.co.nz) educated at Otahuhu college 1968 - 1971.
This is a genuine request - please keep the BS to a minimum. I plan to have some fun at his personal expense... getting the $3,000 back will be a good start, but far far far from the end.... and yes - it'll be all LEGAL.
PM me details if you can, open slather in here with any knowledge or suggestions. He's the director of Career Collections Ltd registered to an address in New Lynn (Auckland), but that's the house mentioned in the story (linked) above. It's BS, but probably gives an idea of his likely whereabouts.

Are the police investigating the people that own the house that she was conned into signing for?
Seems to me that it is them that are profiting more than this pig Max - but then again maybe they are in collusion?
To me the whole point of the con actually seems to be the 10% forfeited deposit. He must be getting some sort of kick back?

We sure do but given his track record of 100+ convictions (mostly for fraud) and the apparent lack of money from those keen to see him served justice, a non lawyer approach is being taken by me at this point. The Police can bring in those guns when they're ready, I'm willing to bet Max doesn't really care that much if he gets caught and processed... again...
So we need to find him and help him care, but... primarily - I want to get that $3,000 back...

Read the article again - the lawyer was operating under instruction in a legal arrangement. She volunteered her house having fallen for Max's BS but the arrangement is all legally ok.
She made a mistake, and Max helped her.

the typical scenario here in NZ is that the first time a lawyer sees a contract is AFTER it has been signed (because real estate agents have such a lock on the process.... I have an opinion about that, but its not relevant here). This is in spite of the big-ass warning just above where a purchaser signs that says "IF IN DOUBT GET LAWYERED UP FIRST". Often the contract will contain conditions subsequent (subsequent here being subsequent to formation of the contract) such as a purchaser arranging finance sufficient to complete, or the purchaser selling a house, or subject to a purchaser arranging experts to check it out. My reading of that linked article suggested the silly woman signed up unconditional contracts on property worth $5M. She is fucked and burned. That contract says "I will pay you this much money on this date in exchange for your property". If she doesnt honour the contract, then the vendor has legal remedies, including obtaining a court order for specific performance (useless here) but also damages, including costs on the resale, and any loss sustained by the vendor including their legal fees.
The only malpractice here would be if the vendor's lawyers DIDNT sue her for loss.
Also that little nugget about GST is wrong on two counts: signing a contract "or nominee" in a transaction subject to GST signals to IRD that there are two transactions, (i.e. A sells to B or nominee, so IRD views it as A sell to B sell to nominee: this can have major effects particularly in respect of time of supply and if one party is not registered). the other is that the sale of residential property is an exempt supply not subject to GST.......
I feel sorry for this woman, I really do, but $200 spent early in the piece would have saved her a lot of heartache. But if in doubt kids, DONT FUCKING SIGN ANYTHING!!!!

Police 10 7 aired, 10 mins later the dude was arrested in Wanganui, he hits courts this morning (9 October) and I wish I was there...
Cops are worried he'll get bail, I'm worried he's going to rip someone else off ... so we might want/need to keep a reasonably close eye on him but... one thing at a time.
Sentencing next... time to make sure victim impact statements are up to scratch.

Yes that's my concern. A friendly detective has been giving some pointers along the way though... maximise the value opf the Victim impact statements at sentencing is a next key step... and the fact one of his victims attempted to take her own life has got to count for something.

Hope so - victim impact statements seem to be a joke when it comes to this new "restorative justice" - apparently you can't be too harsh in the victim impact statements as you might traumatise the poor criminal which might cause him to decide to stop being a crim AND WE CAN'T HAVE THAT, EH?
Here's hoping they work better when it comes to convincing morons that a person deserves the book thrown at 'em.

A few years ago I worked / sub'd for this guy on a couple of repo jobs and he was as letcherous then as he is now ... he's a stand over sort of guy ... I specialise in finding people ... he were contrated to find a guy in Invercargill and couldn't hence my involvement ... I found him, got the goods and got paid for my efforts ... He wouldn't dare not to .. 1) I have too much on him ... 2) I'm ex UK 2 Para (Intel) ... after the google anything you need is yours ... these c#ts need to be taken off the face of the earth ... NO exceptions !
Back then I had an NZD acc that he was using to try and find women while we were down there ... scary I know ... guess what ... they still there ... pages of them ... also one night he got a woman in gore to come to the motel and she came with her sister (just in case!) sister was tidy (mine) the other had to be "persuaded" not to cry molestation !!! Still have sister's number sure they'll testify !
He got arrested right after the police 10/7 prog and is due in court in Auck in Jan / feb

Would like to think so but he's been through the revolving doors of our justice system so often I don't fully expect anything to change. I'd love some real criminal charges to be dropped at his feet, and the Ministry of Economic Development are on his case (40 charges I think it is), with a few major ones pertaining to fraud... running a company while bankrupt - that sort of thing...). I understand he has Black Power links though - so will be looked after in prison.
Latest update is that he's on home detention as of October '08, due to hit court in October '09 (yes - 12 months later) but that might be brought forward to May '09. I also understand he has CYFS or WINZ or whoever providing him with home help to do the lawns and tidy the house while he's stuck there?!? That's from a reliable source but I have to stress it's hearsay.

Hey MDU, this fat bastard features in the Sunday Star Times this morning. Apparently he has been sentenced to 3 years and 9 months in prision ( a reduced time as he is morbidly obese) after being found guilty of 41 counts of fruad. He is appealing his sentence and wants to be remanded at large (tee hee) until the appeal is heard. He is saying he needs specialised medical treatment due to his morbid obesity (200kgs) and this cant be provided in prison.
Apparently it would be degrading for him as he needs help in going to the toilet. :rofl: What a joke, man he is one fat fucker!

Yeah mate - this is it... and no. It doesn't.
Anyone driving any friend of mine to attempt suicide gets nothing but contempt from me. He's also very very well known as a con artist, twisting the truth to achieve all sorts of ends.
If he can't wipe his arse in prison... what difference does it make if he's at home? Nope - sorry. I hope he gets taxed on all his ill gotten gains as well. 40% of $300k+ = OUCH!

That's what I thought - who wipes his fat arse when he's NOT in prison? Get them to spend the time in prison with him! Or buy him a long stick with a sponge on the end and surely he can wipe it himself!
I can't believe this waste of space is still living - wish he'd drop dead of a heart attack and save everyone the bother of looking after him.
