I got nailed. First crash.

I was heading to work at approximately 7.30am, travelling down Teed St in Newmarket, when a car pulled out of the street to my right and directly into me (I was travelling straight ahead with full right of way).

I checked, and I'm pretty sure it was a one-way street, but will do another proper check tonight and take pictures.

I got the guys registration. He gave me his number and dropped me at work, and he was with his mother, so I presumed I was pretty safe and he would sort it out- but the number isn't working.

I have a friend checking it out with Vodafone, will take his rego to the PO tomorrow and get his address, and someone else is checking his rego through other agencies to see what they can get.

The guy with Vodafone advised that the silence with no message would usually indicate a valid number with no voicemail message or box, and the phone either busy or turned off.

I'll keep trying, and if I can't get through by tomorrow, will have to lodge a dispute through the authorities- which will not be the best way for him to go.

I got off lucky, the bike did too, but I'm starting to ache all over now! Falling off sucks.

I believe there is a legal requirement to report the accident to the police within 24 hours if there is any kind of injury involved.

Think I'll be getting drivers licence number off the person if I'm ever involved in a prang. If they refuse to give it I'll be calling the cops.

I also think it's worth calling your insurance company from the scene so they can speak to the person and get the details they want. That way they can't complain you didn't get enough info should the person do a runner or give false details.

Yeah do notify the police and get checked over by your Dr etc. It helps to have all the boxes ticked if things turn bum shaped later. I thought I was going over the top when I got hit, similar thing, from the side and I got out of the lane the guy pulled into and onto the shoulder. Pity he was drunk, over corrected and sqashed me against the barrier once I was stopped anyway!! I was sore and bruised but felt fine, cops came cos I thought.. I'm in shock, I don't actually know how hurt I am, they got an ambulance and I saw my Dr the next day. back to work and just achey. Two days later I collapse and am taken to hospital with brain swelling and my brain has shut down! That was three months ago and I am going to try going back to work for 2 hours next week. Didn't even hit my head it just got shaken in the wrong way, have had 6 other hospitalisations from brain injury tho' so thats why it's taking longer to sort out.

My advice.... always get the police to turn up and make a crash report. They will (should) check the drivers for alcohol, check licences etc and take proper details and enable insurance companies to get an impartial report on fault.

The types all too keen to avoid having the "5 O" turn up usually have some reason for it... warrants to arrest, no licence, disqualified, uninsured, no WOF/rego etc etc.

You can still report the crash to a local station and ask they follow up with the other driver.

Reporting a crash

If you are involved in a crash while driving, and you are not badly injured, the first thing you must do is stop and check to see if anyone is hurt, and provide assistance.

If someone is hurt, you must tell a police officer as soon as possible and no later than 24 hours after the crash.

If no one is hurt, you must give your name, address and vehicle registration (and, if asked, the name and address of the owner of the vehicle you are driving, if it isn't your vehicle) as soon as possible but no later than 48 hours after the crash to:

* the owner or driver of any other vehicle that has been damaged
* the owner of any property that has been damaged.

If you can't find these people, you must tell a police officer as soon as possible and no later than 60 hours after the crash.

If your vehicle is insured, tell your insurance company as soon as possible after the crash.


If there are no injuries, there is no need to report,
if you think they are dodgy yes get the cops down to file a report which will make it easier.

If you don't have insurance and they have insurance you have to wait until they lodge a claim, you cant get anything out of their insurance company until the claim is lodged and liability is accepted by the driver at fault. It is not the insurance companies responsibility to advise you that a claim has been made so if the claimant doesnt advise you, you will need to check in with the Insurance company until its lodged.

If they dont have insurance (and neither do you) or they are fucking you about, get their details out of the system (Post Office) since they may have given you dodgy information and lodge a claim with the Disputes Tribunal, this costs about $35 and a letter from court usually hurries people up.

edit: there are limitations to the DT, you cant use them if your claiming for more than $7,500 or, if everyone involved agrees, up to $12,000.

I have, and they definately aren't coming that day........last time was when my bike was written off by a U turning driver and even given the amount of carnage involved in that, all I got was: "if there isn't anyone injured, we aren't coming to see, report it to your local police station if you wish to"

Rant over, but rely on gaining information yourself, without blood on the ground the plods aren't going to help....and this is in the centre of new age sensitivity (orcland) too!

I've been in 4 accidents. Hit in a car, on a push bike, on foot and lastly nailed on my old bike.

You really want a police report. Take it from me - being made of rubber dont mean shit if it sets you back weeks from work and you're down a few grand on the bike.

With a police report and a friend-of-a-friend lawyer (or look up how to write a letter or claim - private settlement is the way to go) you can normally make it back to 80% financially.

Also if your helmet / gear was wrecked. Claim it as well. A good lid isn't cheap and replacing it is HIS problem - not yours.

I've found saying things like 'that guy over there looks in pretty bad shape' and 'we are blocking the middle of the intersection' will help bring them along.

Don't say "nobody is hurt", instead try "I don't know if anyone is hurt" cetera etc .

Yeah that one way street is pretty narrow and I am always been caution riding there. Hope you are ok and make the idiot pay for it.

I found him through the phone book, he was very releved as he had realised he had given the wrong number, so assumed my next step would be a police report- leaving him with tickets for not giving way and going the wrong way on a one way street, as well as possibly giving false information after an accident (we aren't sure if there is a penalty for that, there should be).

He lodged a claim immediately, the insurance company is sending an assessor to view the bike. It's been quoted at $1130 for the repairs.

Overall, I came out of it pretty well considering, but still wish I could get some compensation for having to use public transport in the mean time- or a courtesy bike.

If it's bike v.s car you are hurt, call them. If it turns out later you don't need any other help thats great. If your in shock (unless your too tuff, heheheh. Being hit my a car puts the shits up me I don't mind saying) your not in a position to say if your hurt or not. When I got hit they was all buddy buddy trying to make me say it was all good and to leave. Bike has taken 3 months to fix and still all the parts aren't in. I'm not back at work yet either. Fine for 2 days then collapse with a brain injury, the first month I wasn't really around for and slowly getting better still.

Unless you don't want any more money or liability for injurys get the cops or an ambo there to check you out.
